AN ORDINANCE VACATING A SANITARY SEWER
EASEMENT IN LOTS 7 AND 8 OF WILCOX PLACE
WHEREAS, the City of Dublin desires to vacate a portion of a sanitary sewer
easement located in Lots 7 and 8 of Wilcox Place; and
WHEREAS, Council finds that there is good cause for vacating the sanitary sewer
easement because the sanitary sewer was never constructed in the easement and it is
no longer necessary for one to be located in this easement; and
WHEREAS, Council finds that vacating the sanitary sewer easement will not be
detrimental to the interests of the City of Dublin, Ohio,
NOW,THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Ohio, ~ of the elected members concurring:
Section 1. That the sanitary sewer easement located in Lots 7 and 8 of Wilcox
Place, of record in Plat Book 85, Page 55, of the Recorder's Office, Franklin County,
Ohio, is hereby vacated, provided, however, that the City of Dublin, Ohio, reserves its
rights pursuant to any and all other easements located thereon or thereunder. The
sanitary easement is more fully depicted in Exhibit "A".
Section 2. That the City Engineer is hereby instructed to coordinate with the City
Attorney to prepare the proper instrument to be recorded at the office of the Franklin
County Recorder to vacate the easement.
Section 3. That the Clerk of Council is directed to notify the Auditor of Franklin
County of the vacation, by forwarding a copy of this ordinance to the Auditor of
Franklin County.
Section 4. That this ordinance shall take effect and be in force from the earliest
date allowed by law.

Vacating a Sanitary Sewer Easement in Lots 7 and 8 of Wilcox Place
Summary:
Kinetics Noise Control (Kinetics), located at 6300 Irelan Place, has submitted plans to expand their
current facility. This expansion includes an addition to the existing building to the west and
reconfiguring their parking areas. During the staff's review of their proposed building expansion, it
was discovered that the building would encroach an existing easement. Staff provided this information
to Kinetics and informed them that if they desired the expansion in that location, a written request to
vacate the easement would be needed. This written request is attached.
The easement located along the western boundary of Lots 7 and 8 was created on the Wilcox Place
plat (Plat Book 85, page 55) for a sanitary sewer. This proposed sewer to be within the easement was
to be installed to serve Lots 7 and 8 as created on the same plat. The property line between Lots 7 and
8 and the Kinetics property has been adjusted, so now the easement is located on the Kinetics property.
A copy of the plat and the proposed site plan are attached for reference.
We investigated if the sewer was installed. When we inspected the manhole in the trunk sewer, there
was not a sewer entering the manhole from the south. We performed several other items to determine
if a sewer exists in this easement. Please see the attached memo regarding other details of the
Division's investigation. We also verified with the inspector on the project, who indicated that the
proposed sewer was not used to service the buildings in Wilcox Place. This indicates that the sewer
was never installed in the easement.
Recommendation:
Staff recommends approval of Ordinance 104-03 to vacate the easement depicted on the attached
Exhibit "A". The land surrounding the proposed sewer has already been developed and served. If
approved, the legal description and exhibit for the vacation will be recorded.

Dear Mr. Hammersmith,
Kinetics Noise Control is located in the City of Dublin at 6300 Irelan Place. We
are planning a 52,500 sq. ft. expansion to our existing facility. During the
process of engineering this expansion, our civil engineer brought to our attention
a sanitary easement was granted to the City of Dublin along our eastern property
line. Our proposed expansion will encroach this easement.
After review with your department it was determined that no sanitary piping has
ever been installed in the easement. We are requesting that the City of Dublin
release this easement so an expansion can go forward as planned. (See Exhibit
A)
We agree that should a future need arise for the easement, we will grant a
revised easement building line. (See Exhibit B)
Please call me with any questions regarding this matter. We would like to begin
construction within the next 3 weeks.

Per your request I investigated the sanitary sewer easement vacation request from Kinetics
(attached). In order to determine if a line does exists I reviewed several sources of
information. The following is a list of those activities and the findings.
1. I asked Grady McGraw pull the lid of existing manhole 17 to determine if a pipe ran
to the South, which was proposed to connect with manhole 4. Grady stated no pipe
ran to the South out of the manhole.
2. Reviewed plans to determine where the buildings were served. Grady made a copy of
a site plan for me showing how buildings in the Wilcox Commercial subdivision were
serviced. I asked him to return to the field to verify the locations of cleanouts. He
was only able to find one but felt that the others most likely existed as shown but were
buried in the landscaping.
3. Next I completed a file review to determine if anything had been put n writing on this
sewer line. In the file I
found reference to the fact that no public sewer was installed
in Past 2(Phase 2), which would include this line. We did not receive a bond for this
sewer.
4. I also reviewed as-built plans. This line was not crossed out, but there were not any
as-built corrections either.
5. Finally I called Darcy Dom at Bird & Bull to determine if she, as the design engineer,
remembered anything. She remembered that the thin strip of
property where the
sewer was to be placed was either purchased by or in negations with Kinetics at the
time of construction. Therefore, the sewer would not be needed since Kinetics was
already served.
Due to this information and the fact that all other properties are served in the area, I feel it
will not be a problem for us to vacate this easement. Please see me if you have any further
questions.
