WHEREAS, a petition for an Expedited II method of annexation of 1.186, more or less acres from Concord Township, Delaware County was filed in the offices of the Board of County Commissioners of Delaware County, Ohio on May 22, 2003 by Robert E. A response time of approximately five minutes for an emergency situation should be expected for this area. YF:1R Fire. Fire and emergency medical services protection is currently provided by , well-staffed departments in Concord and Washington townships. They, too, have mutual aid agreements with other municipalities and townships. This annexation would not change fire department jurisdictional boundaries, and therefore response times for fire and emergency medical services will not be affected. Sanitation. Residential refuse collection services are contracted by the City and are currently provided at no additional charge. These services will be provided to the annexation area upon annexation. Street Maintenance. The City's Streets and Utilities Division provides excellent service in the area of street and road maintenance and has adequate staffing to provide these services to the annexation area upon annexation. Finances. The City is financially capable of providing all necessary services to the annexation area upon annexation. Section 2. The City has SEWER and WATER service area contracts with the City of Columbus, and the subject property is within the service areas. The annexation area already receives WATER service from the City of Columbus and this will remain unchanged by the annexation. The City of Dublin will provide SEWER services to the annexation area upon annexation if not sooner by agreement of all relevant parties. Section 3. Albright filed an annexation petition, on behalf of South Heidelberg Inc., with the Delaware County Commissioners. The petition is for a portion of the Bogey Inn property, 1.186 acres in Concord Township to be annexed into the City of Dublin. The South Heidelberg petition was filed pursuant to R.C. 709.023(B), which is also known as the "Expedited Two" method of annexation. On May 23, 2003, notice of filing of the annexation petition was submitted to Dublin Clerk of Council. The "Expedited Two" method of annexation has some timing requirements that are extremely demanding on municipalities. First, within twenty (20) days after the petition is filed, the municipality must adopt an ordinance or resolution relating to municipal services. Second, within twenty (20) days after the petition is filed, the municipality must adopt an ordinance or resolution relating to land uses and zoning buffers, if the territory proposed to be annexed is currently subject to either county or township zoning. This office has prepared both of these resolutions for your consideration. The county commissioners shall grant the proposed annexation, without a hearing, if neither the municipality nor the township object to the annexation by ordinance or resolution ~vithir. twenty-five (25) days of the petition being filed. A RESOLUTION ADOPTING A STATEMENT REGARDING POSSIBLE INCOMPATIBLE LAND USES AND ZONING BUFFER FOR A PROPOSED ANNEXATION OF 1.186 ACRES, MORE OR LESS, FROM CONCORD TOWNSHIP, ,~~:'~~ DELAWARE COUNTY TO THE CITY OF DUBLIN, OHIO AS REQUIRED BY SECTION 709.023(C) OF THE OHIO REVISED CODE. WHEREAS, a petition for an Expedited II method of annexation of 1.186, more or less Acres from Concord Township, Delaware County was filed in the offices of the Board of County Commissioners of Delaware County, Ohio on May 22, 2003 by Robert E. Albright, 600 South High Street, Columbus, Ohio 43215, Agent for Petitioner South Heidelberg, Inc., 4333 Sharon Avenue, Columbus, Ohio 43214; and WHEREAS, the Expedited II method of annexation, pursuant to Section 709.023(C) of the Ohio Revised Code, requires that within 20 days of the petition being filed, the municipality to which annexation is proposed must adopt an ordinance or resolution relating to land uses and buffers if the territory proposed to be annexed is currently subject to either county zoning pursuant to Chapter 303 of the Ohio Revised Code or township zoning pursuant to Chapter 519 of the Ohio Revised Code; and WHEREAS, the territory proposed for annexation is currently subject to township zoning pursuant to Chapter 519 of the Ohio Revised Code; and WHEREAS, pursuant to Section 709.023(C) of the Ohio Revised Code, this resolution must state that should (a) the territory be annexed and (b) subsequently becomes subject to municipal zoning, and (c) the municipal zoning permits uses in the annexed territory that the municipal corporation determines are clearly incompatible with the uses permitted under current county or township zoning in the adjacent land remaining in the township from which the territory was annexed, then the Dublin City Council will require, in the zoning ordinance permitting the incompatible uses, the owner of the annexed territory to provide a buffer separating the use of the annexed territory and the adj acent land remaining within the township; and 0 ~~ ,~ ~ r, .o Q` 41 O ~ .C '= o O z c ~ .c o .o G ' ~ "J .~ G O d o L V J 01 O ~; .._ ? ~ o r a o ~+ c~ as -~ ~~ v .~ =I o ~. .~~ -~ WHEREAS, pursuant to Section 709.023(C) of the Ohio Revised Code, "buffer" includes open space, landscaping, fences, walls, and other structured elements; streets and street rights-of--way; and bicycle and pedestrian paths and sidewalks; and WHEREAS, Section 153.004(D) of the Dublin Codified Ordinances requires that ~ upon annexation, the annexed territory be automatically rezoned to R-Rural District ~~ subject to regulations and procedures contained in the City of Dublin Zoning Code o and amPnrlmPnts• and c ~; WHEREAS, the territory proposed for annexation is adjacent to Glick Road to the north, the City of Columbus to the east, the City of Dublin to the south, and the d Village of Shawnee Hills to the west; thereby apparently leaving no adjacent `~ unincorporated territory that would require a buffer.
