If an offer is not received which will result in a savings to the resident, a proposal will not be brought forward. For gas, with fluctuating rates, the options are to look for a fixed rate that will offer price certainty or a rate that is simply less than the gas company's rate. It is possible that another supplier may have a lower rate, such as a fixed one-year rate. Ms. Chinnid-Zuercher stated that if a resident opted in and then decided to switch, the documents indicate there is a switching fee. Mr. Sloan stated that it would be in the form of an early termination fee. Typically, the fee for early termination is in the range of $25. This can be negotiated with the supplier. It may sometimes make sense for someone to switch, even with the $25 early termination fee. Many don't understand the market and may trust the local government to negotiate for them with the local utilities. Mr. McDaniel added that, in general, these plans are fairly standard. AMP Ohio represents 30 or more other communities, and this is not uncharted tertitory." He noted that staff may request emergency action at the second reading to waive the 30~ay waiting period, depending upon the market conditions. She said this area rezoning includes 14 parcels totaling 26 acres located between Dublin Road and the Scioto River in Delaware County. Three parcels are on Dublin Road, and the remaining parcels are within Deer Run Estates, originally platted in 1984. There are two homes in Deer Run Estates on Deer Run Drive, which is private. She said Dublin R-1, Restricted Suburban Residential District is proposed. Land immediately to the south was rezoned to a PUD, Planned Unit Development District last year which changed the entrance of Deer Run Drive, approximately 1,600 feet to the south. As part of that rezoning, the applicant was to file a revised plat, but it has not yet been received. She said staff has spoken with a few property owners. The informational meeting was sparsely attended. Ms. Wanner said this was a housekeeping effort and is intended to avoid any future enforcement problems arising from township or county zoning. It will establish the R-1 District, and staff recommends approval of this rezoning. The subject sites in this case were annexed in 1977 and there is no history of zoning action having been taken since that time. The parcels have reflected R-1, Restricted Suburban Residential District on Dublin's zoning map for many years. Ordinance #96-03 was introduced at City Council on August 18, 2003. It will establish the Dublin R-1, Restricted Suburban Residential Districts on these properties. A special informational meeting was held on August 26, 2003 at the Dublin Recreation Center. No property owners from this area rezoning case attended. However, staff has talked with one property owner and a property owner representative on the phone. After the Planning Commission makes its recommendation, the case will be forwarded to City Council for a public hearing and final vote. With a positive recommendation from the Commission, a simple majority vote is required for passage. A negative Commission recommendation requires five votes for passage. If the ordinance is approved, it will take effect in 30 days. CONSIDERATIONS: Site Characteristics: The subject area is comprised of 14 parcels, which are all located between Dublin Road and Muirfield Drive, north of the Delaware County Line. The total area being rezoned is 26 acres. Three of the parcels, which are located along Dublin Road, contain single- family houses. The other 11 parcels are part of the Deer Run Estates, which were originally platted in 1984. This property currently has two single-family houses on a private Deer Run Drive. This drive runs approximately 1,600 feet to the east end of the property. Dublin Planning and Zoning Commission Staff Report -October 2, 2003 Page 5 The Deer Run Drive entrance was relocated approximately 380 feet to the south last year. A condition of approval was that the Deer Run Estates plat be modified to reflect the proposed changes, subject to staff approval. (See Case #02-039FDP Wasatch Estates Phase I). This is still outstanding, but it should be resolved soon. The R-1 lot standards require all lots to have access to and abut on a public right-of--way for a distance of 60 feet or more. The property owner is concerned that the layout of the platted lots, including the private drive changes, will not conform to this requirement. The subdivision was clearly platted based on a private not public street. The revised plat will merely show the relocated entry. This rezoning proposes to establish the Dublin R-1 for all properties. All legally non- conforming uses will be subject to the requirements of Section 153.004 (C). The smaller three properties along Dublin Road are bordered by single-family subdivisions on the north, east, and west. Deer Run Estates is bordered on the north and east by single-family development, Amberleigh North, and east by the Scioto River. A letter was mailed to the affected property owners listed in this application. A sample copy is attached, and it outlines the circumstances, procedures, and proposed zoning, as well as dates for public meetings. An informational meeting was held on August 26, 2003, for the affected property owners. No property owners attended this meeting. In two cases, staff has spoken on the phone with the property owner, or property owner's representative. Community Plan, Land Use and Zoning Issues: On August 12, 2002, City Council amended the Future Land Use Map (Map 8) of the Community Plan. The properties listed in this application are shown as "Existing Residential." Implementation of this rezoning will ensure conformity with all adopted Dublin standards, protecting the public health, safety, and welfare. This rezoning is primarily a housekeeping issue and will not have an immediate impact on the majority of the surrounding residents and property owners. Legally non- conforming uses cannot be expanded, and they cannot be re-established after being discontinued for a period of two years. Even without this area rezoning, most of Dublin's development standards would apply. A 1976 ordinance requires adherence to Dublin standards, wherever they are stricter, following annexation. However, the failure to establish Dublin zoning on the property could make administration and enforcement difficult in some circumstances. It can also be rather confusing for landowners. Development Standards: The properties listed in this application were annexed from Concord Township (Delaware County) in 1977. Relying on the township zoning from this time for these areas is not precise or advisable. Based on discussions and research with the township zoning officers and township codes, the current property uses are consistent with historically permitted uses at the time of annexation. Utilities: This is an action to establish Dublin zoning. No development is proposed as part of this application, and it has no effect on known utilities. Currently, municipal water and sanitary services reach some of these properties. The zoning does not affect utility status. Undeveloped parcels will need to tap into the existing utilities per City Code. Dublin Planning and Zoning Commission Staff Report -October 2, 2003 Page 6 New development anywhere in Dublin, including on these parcels, must comply with adopted storm water management regulations for the City of Dublin. STAFF RECOMMENDATION: Staff research indicates these properties were not placed in a Dublin zoning classification by a formal rezoning ordinance, following annexation. They have been reflected as R-1 on the zoning map for many years. This application is City-sponsored and legally advisable. It is intended to avoid any future potential Code enforcement problems arising from Township classifications and inconsistencies within the Dublin zoning map. This action provides proper zoning and is primarily a housekeeping effort. Staff recommends approval of this rezoning. Bases: 1) This rezoning will provide an appropriate Dublin zoning classification for land within the City limits to provide for the effective administration of development standards, procedures, etc. 2) The rezoning will maintain the established development pattern that has been in place for many years and establishes land uses consistent with those listed in the Community Plan. As with everybody that received this notice, I'm sure she was somewhat surprised. In reviewing the requirements for the Restricted Suburban Residential District (R-1), it appears that those requirements are essentially what Deer Run has been developed under anyway. I am concerned, however, that the passing of this ordinance may immediately create non-conforming uses, particularly in the areas of lot size and lot dimension. You will recall that the code under the lot dimension portions (paragraph 153.020B2) require frontage on a public right-of--way. As everyone is aware, none of the lots in Deer Run front on a public road. I discussed this issue with Anne on the. 19°i and she assures me that as the intent of the ordinance is merely to loot: to zoning, but not eli-ect any substantial property rights, the building on any of parcels in Deer Run Estates would not require anything special from Dublin. 03-0822 Deer Run In particular, ibis ordinance would theoretically require a variance being applied for, due to the lack of frontage, if any other buildings were to be constructed. Anne indicated that all that would be required would be the regular application. for building permit process irrespective of lot dimension, size, and%or frontage.
