18-04 Ordinance RECORD OF ORDINANCES Dayton Leeal Blank lnc Form No. 30043 Ordinance No. 1g-04 Passed , 20 AN ORDINANCE TO ACCEPT THE LOWEST/BEST BID FOR THE 2004 STREET MAINTENANCE PROGRAM AND DECLARING AN EMERGENCY WHEREAS, after advertising, receiving and opening bids on February 25, 2004 bids were received for the 2004 Street Maintenance Program; and WHEREAS, Council has determined that the lowest and best bid for said project is from, Strawser Paving Company in the amount of $1,779,971.94; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities; and WHEREAS, it is in the best interest of the City to execute this contract as soon as possible, so that construction can start in the spring of 2004. NOW, TI~EREFORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio, of the elected members concurring: Section 1. That the bid from Strawser Paving Company in the amount of $1,779,971.94 be, and hereby is, accepted. - Section 2. That the City Manager is hereby authorized and directed to execute a contract with Strawser Paving Company for completion of said project pursuant to the bid specifications and documents on file in the office of the City Engineer. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health or welfare of the residents of this City, and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Richardson, P.E., Assistant Director of Engineering -Design Fred W.Tennyson, P.E., Civil Engineer Re: 2004 Street Maintenance Bid Acceptance Ordinance Bid Acceptance Ordinance Ordinance No. 18-04 Background An overview of the proposed 2004 Street Maintenance Program was presented to City Council at their February 17, 2004 meeting. The proposed program was divided into four categories: street maintenance; ditch enclosure; bikepath maintenance; and bikepath connections/additions, with the associated cost identified. All items in the 2004 program, as estimated, totaled $1,875,000 and were less than the $1,925,000 budgeted for 2004. The program was first advertised for bids beginning February 11, 2004 and bids were opened on February 25, 2004. Over the past year, in cooperation with many surrounding communities, including the City of Columbus, staff has been researching the requirement for ADA (Americans with Disabilities Act) detectable warnings _ (truncated domes) for curb ramps. Truncated domes are the ADA requirement for detectable warnings that provide an indication of the boundary between the sidewalk and street for people with visual disabilities. A suspension was placed on this requirement through July 26, 2001, which allowed ten (10) years for conducting research. The suspension expired on July 26, 2001. Consequently, local governments are now required to place detectable warnings when constructing or altering pedestrian facilities. The 2004 Street Maintenance Program includes installing detectable warnings at 2091ocations throughout the City at a cost of $82,000. Summary On February 25, 2004 seven (7) bids were received, publicly opened and read for the 2004 Street Maintenance Program, as shown on the attached tabulation of bid opening results. Staff has reviewed all bids. The Engineer's estimate was $1,875,000. Strawser Paving Company submitted the lowest and best bid of $1,779,971.94. Recommendation Staff recommends this ordinance accepting the bid of Strawser Paving Company be adopted by Council. The resulting total program cost of $1,779,971.94, remains less than the $1,925,000 budgeted for 2004.
