This application requests a change in zoning for 0.148-acre lot from CCC, Central Community Commercial District to HB, Historic Business District. Two new zoning classifications for Historic Dublin were adopted by City Council, on October 6, 2003. This new zoning designation is to promote the scale and character of original Historic Dublin by allowing appropriate development standards for the redevelopment and preservation of the District's historic character. The Planning and Zoning Commission approved this rezoning on February 2, 2006 with one condition: 1) That the applicant apply for all necessary building permits prior to construction of any approved site modifications. The Architectural Review Board also reviewed this case in conjunction with a proposed addition to the structure. Its approval included conditions associated with the addition and can be found in the attached record of action. Additional information regarding this case is available for public viewing at 5800 Shier- Rings Road in the offices of Land Use and Long Range Planning. The public hearing (2°a reading) on the requested change is scheduled for Monday, March 6, 2006. RECOMMENDATION: Staffrecommends approval of this rezoning with the one condition approved by Planning and Zoning Commission on February 2, 2006. BACKGROUND: Case Summary: This is a request to rezone a 0.148-acre parcel in the Historic District from CCC, Central Community Commercial District to HB, Historic Business District. The applicant received Architectural Review Board approval for site and building modifications on January 25, 2006 and Board of zoning Appeals approval on January 12; 2006 (see Board Orders OS-149ARB and OS-189BZA). A condition of approval required that the applicant submit an application to rezone the property to Historic Business District. This application is being sponsored by the City but has been formally filed by the property owner. Staff recommends approval of the rezoning with one condition. Case Procedure: After recommendation by the Planning Commission, the rezoning application will be forwarded to City Council for public hearing and final vote. Atwo-thirds vote by City Council will be required to override a negative recommendation by the Planning and Zoning Commission. If approved by Council, the rezoning will become effective 30 days after passage. Dublin Planning and Zoning Commission Staff Report -February 2, 2006 Case OS-1512 -Page 2 of 3 Historic District Intent: The intent of the Historic Business District is to improve economic viability and to provide a greater mix of uses with an emphasis on historic preservation and traditional development patterns. Utilization of the district is intended to foster pedestrian-oriented development that will enhance Historic Dublin as a community focal point. It is intended to discourage auto-oriented uses, uses with fleet parking, commercial storage and other uses that would detract from the visual quality and scale of the district. Its goal is to foster appropriate development standards to preserve historic character by promoting the re-use of existing buildings when compatible with the district and the addition of suitable infill development. CONSIDERATIONS: Site Characteristics: Site Description. This 0.148-acre site is located on the south side of West Bridge Street, 300 feet west of High Street. The site is relatively flat and rectangular in shape with a depth of 140 feet and 38 feet of frontage along West Bridge Street. The building is two-stories and is comprised of framed construction with a slate roof. The site includes driveway access from West Bridge Street and parking to the rear of the structure. Alley access is available to the site from Franklin Street and Mill Lane. . Site Modifications. On January 25, 2006, the ARB approved building and site modifications (see Board Orders OS-149ARB). No building permits have been issued to date. • Zoning Description. The site and the properties to the north and east are zoned CCC, Central Community Commercial District. This zoning classification includes retail, eating establishments, administrative, business and professional offices and personal and consumer services. Properties to the west and south are zoned PUD, Planned Unit Development as part of the Town Center I and II. Land Use and Zoning: • Rezoning. On October 6, 2003 City Council adopted two new zoning classifications for Historic Dublin. The Historic Residential (HR) and Historic Business (HB) designations were created to establish suitable development standards for the Historic District. The intent of the two zoning districts is to protect the scale and character of original Historic Dublin by allowing appropriate development standards for the redevelopment and preservation of the District's historic character. Development Standards. The proposed district includes a minimum width and frontage of 60 feet, rear yard of five feet, side yard total of five feet with a minimum of zero feet, and lot coverage not to exceed 80 percent unless ARB approves an increase. This site received approval for an increase of lot coverage to 82 percent. Architectural Review Board. The Code explains that the ARB is responsible for promoting the educational, cultural, and economic well being of the Historic Dublin Planning and Zoning Commission Staff Report -February 2, 2006 Case OS-1512 -Page 3 of 3 District. The Board accomplishes this by regulation of all construction, alteration, maintenance, and demolition within the Review District. Architectural and site improvements been reviewed and approved by the ARB (see attached Board Orders). Additionally, the Board has indicated support for rezoning this property to Historic Business. The Commission is to review the appropriateness of rezoning this site. STAFF RECOMMENDATION: Staff believes that the proposed rezoning will continue the preservation of the Historic District character and facilitate future growth. After reviewing the applicant's request, staff recommends approval of the rezoning with one condition and with the conditions carried over from the ARB and BZA approval. Conditions: 1) That the applicant applies for all necessary building permits prior to construction of any approved site modifications. Bases: 1) This rezoning will provide an appropriate zoning classification for this site within the Historic District and provide for effective administrative of development standards and procedures; and 2) This zoning classification will establish development patterns and land uses consistent with those listed in the Community Plan. Ms. Ochal presented this variance application. She said there is an application to the Architectural Review Board for the site modifications. She said the current building under the current uses would need nine parking spaces and with the addition they would need a total of 15 parking spaces. The applicants is putting eight pazking spaces on the site and is asking for a variance for the seven spaces they are short. Ms. Ochal said as with many other cases in Historic Dublin, staff cannot identify a specific hardship or practical difficulty for this case. Staff will continue to support applications that are appropriate to the general development patterns and goals for Historic Dublin. After reviewing the application, staff recommends approval of the parking variance with the one condition as listed in the staff report and the findings. Tom Bassett said he is the owner and the applicant. He said the intent is to renovate the property in Old Dublin. The house is in need of some updating, and the plan is to add a separate outbuilding in addition to the main house and create a courtyard effect where the asphalt is now. The pazking lot will be reconfigured and will be very attractive. There was some discussion regarding pazking ratios and types of uses. There were no further comments or questions from the Board or audience regarding this case. Rickey and Co., the City's historical consultant, had recommended; on the south elevation, the hayloft door be reduced to 2/3 the size and be rectangular in shape to be more authentic; and, on the north elevation, a more window-like structure 2-on-2 or 4-over-4, above the proposed French doors. The applicant is proposing to use HardiplankTM siding and a standing seam roof, along with windows with muntins. Ms. Ochal noted the applicant will return to the Board with a more detailed application showing the building materials, the architecture, and the landscaping. He would welcome comments from this Board regarding this request for review. She offered to answer any questions, noting the applicant was also present. Mr. Staub asked the applicant, Tom Bassett, if he wished to add anything to the presentation. Mr. Bassett stated the goals of this project are to improve the appearance of the existing structure, and to remove the driveway, which has access onto Bridge Street. The driveway is being replaced with a brick walkway, which is more in the character of Historic Dublin. Mr. Bassett said he plans to clean up the appearance of the existing building, and will come back in December with more detail. He has rebuilt the whole front porch. The east side is an eyesore where a previous owner had put electric conduit running up the sides of the building, and wires running into the building. He stated he plans to clean all that up and to bury the lines. Mr. Bassett stated this proposal does more to preserve the character and improves the parking area. He stated they actually end up with more parking spaces than with the existing plan, because presently everyone pulls in anywhere. He asked if it was about the size of one of the carriage houses Mr. Bassett had recently done. Mr. Bassett replied that the addition is about the size of half of one of the carriage houses, or 19 x 28 feet, each half of the carriage houses measuring 24 x 28 feet. Mr. Staub asked Joanne Ochal about the six staff recommendations listed in the staff report, and the recommendation that "the applicant address the following issues prior to a formal review by the Boazd." Ms. Ochal explained that staff is asking that those items be addressed by the applicant prior to re- appearing before the Board with the completed application. Mr. Bryan asked if the illusion of the hayloft doors was something the applicant was going to change. Mr. Bassett said it can change if the consultant and the Board feel it is too large. Mr. Bryan said he liked the loft doors, but he did not know about the peak over them. Mr. Bales stated on the two items from the historical consultant, he agreed with the recommendation on the hayloft door. Mr. Bales stated the four-over-four actually has a nicer appearance. `The design is very nice, and fits the character of the house and the area. He questioned the planned use for the new structure. Mr. Bassett said the original request is for a restaurant or ice cream shop. There are several different options being looking at; a Coney Island Restaurant that wants to locate in Dublin, or a wine bar, providing they could get a liquor permit. It would be a small operation. Mr. Bales asked about parking spaces with the added square footage, along with the proposed use of the new building. You have eight parking spaces, and are not reducing the number of parking spaces for the existing facility, but are adding square footage, impacting parking in Historic Dublin. Ms. Ochal said they calculated the two-story building as a restaurant at one space per 50 square feet, and the office building at one space per 200 square feet. With the restaurant use and the additional office use, the maximum number of spaces the applicant would need is 31. He is proposing eight pazking spaces. With the proposed uses he must go to the Board of Zoning Appeals to ask for a variance for parking. Mr. Bales said one of the biggest issues the City faces is parking. As nice as the addition is, eight out of 30 is a big span. He said that this consideration is not necessarily part of the function of the Review Board, the Board is looking at this architecturally, but in the interest of the community we are making some wonderful improvements and running out of space to use them. It is something to be looked at. He stated that he felt architecturally speaking, the recommendations of the historic consultant should be incorporated. Mr. Bassett replied yes, but it was really deteriorated and part of his specific proposal next month is to replace parts of the main structure with new HardiplankTM siding so that you would not be able to tell the difference from the original. He noted certain elevations are in terrible shape. Mr. Bryan said he liked the proposal, but with the property next door potentially being developed as Town Center II, is there any chance of being lost in that development. He said he understands the visibility issue with Bridge Street, and did not know if there was an advantage being on the alley edge, unless Town Center II would be coming all the way back and this would be recessed to a degree. He stated he felt that it may or may not work. Mr. Bassett said he always feels historic areas like this need more than just street facades. He has tried to do this with the carriage house and the additions he has done at 35 South High Street, where you have the street and also alley appeal. He said walkways should be created where people enter from the rear. He said that is part of the objective of this project, to appeal from the rear as well as the front. Mr. Staub asked if the city parking was just across the alley way. Mr. Bassett said yes. Mr. Staub stated that the uses proposed, from a parking standpoint, may not be the type you would drive to for a sandwich shop or an ice cream shop, and are more pedestrian-friendly. Maybe that is the way to work with the parking issue. Mr. Bassett said the second-story office may end up ultimately as just storage. If there is a little restaurant in it, it may be used as an office or storage for the restaurant, not as an additional tenant. Mr. Staub said he thought this proposal would look great. Mr. Bryan asked about the trees, if they would be affected badly by construction. Mr. Bassett said construction would come six feet short of the first tree, and come pretty close to the second tree. He intends to save the tree if possible. He said it is interesting that the buildings take up hardly more impervious surface than what you see there, by the time you dig out the asphalt driveway, and the walkways are all replaced with brick. The brick walkways will not cause the runoff problems of a concrete surface. Mr. Staub noted it is a nice plan and good for the area. He asked if the State Farm Insurance building next door shares the parking. Mr. Bassett said they do not have any parking. He then asked Ms. Devlin for clarification that if they make a recommendation for approval on this, are they recommending approval overall, or just recommending design changes and plans. Ms. Devlin replied that they are offering feedback to the applicant. She suggested they may want to ask the public if anybody has any comments to make as well. Then staff and the applicant will take your comments from tonight and try to incorporate them into the detailed submittal that will come back in December. Mr. Staub asked if there was any public comment. There was none. Mr. Bassett said he would like to comment on the second floor doors on the front, that the idea was to have atrium doors that would open. He noted the second floor is just one large room, and if it becomes an ice cream shop it could be used for kid's parties or other functions. The idea was they could swing the doors open. It is not shown on the drawings, but there will be some kind of a railing you could open to the dining area and the patio below it. That was the logic behind the two sets of atrium doors on both levels, and the second floor is not necessarily meant to be just windows. Mr. Staub said that will become clearer as they get a better feel for use. Mr. Bales agreed. The Board was in general agreement that the proposal would blend appropriately with the Historic District.
