Form No. 30043 51-06 (Amended) Ordinance No. Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO DONATE A 0.069 ACRES, MORE OR LESS, UTILITY EASMENT, TO THE OHIO DEPARTMENT OF TRANSPORTATION, LOCATED NORTH OF I-270 AND SOUTH OF JENMAR COURT, CITY OF DUBLIN, TOWNSHIP OF WASHINGTON (FORMERLY PERRY), COUNTY OF FRANKLIN, STATE OF OHIO, AND DECLARING AN EMERGENCY. WHEREAS, the State of Ohio Department of Transportation is preparing to install underground conduit to service a radio repeater for the ITS (Intelligent Transportation System) and message boards; and WHEREAS, said installation requires the City of Dublin to donate a general utility easement in and to the premises described on the attached Exhibit "A" located in the City of Dublin, Township of Washington (formerly Perry), County of Franklin, Ohio; and WHEREAS, the City desires to donate to the State of Ohio Department of Transportation a general utility easement, described in the attached Exhibit "A," located in the City of Dublin, Township of Washington (formerly Perry), County of Franklin, State of Ohio; and WHEREAS, this donation will require the City to execute an Easement to the State of Ohio, Department of Transportation without consideration or compensation being paid to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute an easement related to its donation to the State of Ohio, Department of Transportation. Section 2. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt installation of underground conduit to service a radio repeater for the ITS (Intelligent Transportation System) and message boards is necessary to improve traffic circulation and relieve traffic congestion for the citizens of Dublin. Therefore, this ordinance shall go into immediate effect. Passed this day of , 2006. Smith, Law Director DATE: August 16, 2006 RE: City Donation of Utility Easement to ODOT Ordinance No. 51-06 SUMMARY: The State of Ohio, Department of Transportation, has requested the donation of a 0.069 acre, more or less, utility easement located north of I-270 and south of Jenmar Court for the installation of an underground conduit to service a radio repeater for the ITS (Intelligent Transportation System) and message boards. A drawing of the proposed utility easement is attached for your review. ODOT has agreed to relocate the underground conduit when the City needs to extend this part of Emerald Parkway. Ordinance No. 51-06 has been submitted to Council for approval of this donation.
