AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO EXECUTE MUTUAL AID AGREEMENTS WITH
OTHER POLITICAL SUBDIVISIONS
WHEREAS, there may be times where the cooperation of numerous political
subdivisions is necessary to provide the most efficient public service;
WHEREAS, many of the political subdivisions in the Franklin County area
enter into mutual aid agreements for the interchange of public safety related
services and/or equipment; and
WHEREAS, these types of mutual aid agreements are authorized under Ohio
law; and
WHEREAS, the immunity afforded the City under Ohio law would still be
applicable in the event that the City provided equipment and/or services
pursuant to a mutual aid agreement.
NOW, THEREFORE, BE IT ORDAINED by Council of the City of Dublin, State
of Ohio, of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute agreements
for mutual aid with other political subdivisions for the interchange of public
safety related equipment and/or services.
Section 2. This Ordinance shall take effect and be in force from and after
the earliest date permitted by law.

Summary
As requested at the May 1, 2006 City Council meeting, this memorandum and attached report provide
additional information regarding mutual aid issues within our Police Division.
Currently, the Division of Police has agreements with the following agencies: Columbus Police, Union
County Sheriff, Franklin County Sheriff, Delaware County Sheriff, Madison Township Police, Mifflin
Township Police, Grove City Police, Sharon Township Police, Bexley Police, Grandview Police, Hilliard
Police, Worthington Police, Whitehall Police, Blendon Township Police, Minerva Park Police, Obetz Police,
Valleyview Police, Reynoldsburg Police, Village of Brice Police, Pickerington Police, Westerville Police,
New Albany Police, Perry Township Police, Upper Arlington Police, Gahanna Police, Groveport Police,
Clinton Township Police, Ashley Police, Delaware Police, Powell Police, Sunbury Police, Genoa Township
Police, and Shawnee Hills Police.
The 2005 Mutual Aid Summary gives an overview of all mutual aid responses that we provided as well as
those we received. The vast majority of responses we provided to other agencies involved minor assistance,
such as backing up officers on burglar alarms or traffic stops.
The Columbus Police Department is the agency we request mutual aid from most frequently (20 incidents in
2005). It is worth noting that these requests are usually for specialized equipment or resources such as their
helicopter.
Our Risk Management Specialist has informed us that when responding on mutual aid our officers are
covered under the City of Dublin's workers compensation insurance.
Recommendation
Staff recommends passage of Ordinance 30-06.

RE: Mutual Aid Contracts
Many of the surrounding political subdivisions are in the process of updating their mutual
aid agreements. These agreements provide for cooperation among the various political
subdivisions in emergency situations and are mostly symbolic in nature. The Ohio Revised Code
provides a statutory basis for these types of agreements. These agreements are unique in that
they are done on a no fee basis. Additionally, the agreements, by their own terms, are non-
binding in the sense that they impose no liability on the political subdivisions for failure to act or
respond in emergency situations. Finally, it should be noted that in the event that the City were
to provide equipment and/or services under these agreements to another political subdivision, the
City would be afforded the same immunities under Ohio law that it would have if the equipment
and/or services were being used in the City.
