Restaurant)
SUMMARY:
Rezoning application OS-1372 for 50 West Bridge Street, located on the north side of Bridge
Street, west of Darby Street, is being forwarded for second reading. This application requests a
change in zoning for 0.57 acre from CCC, Central Community Commercial District to HB,
Historic Business District. The intent of the new zoning designation is to protect the scale and
character of original Historic Dublin by allowing appropriate development standards for the
redevelopment of this site.
The Planning and Zoning Commission unanimously approved this rezoning on September 15,
2005 with one condition, which has been met. The applicant has applied for and received all
necessary building and zoning permits for the approved site modifications.
Condition:
1) That the applicant applies for all necessary building and zoning permits prior to construction
of any approved site modifications.
RECOMMENDATION:
Motion to approve the second reading of Ordinance #59-OS with the one condition adopted by
the Planning Commission on September 15, 2005.

Mr. Gerber swore in James Train, Bass Studio Architects, representing the applicant, and
asked if he agreed to the one condition. Mr. Train replied that he did.
Ms. Boring asked Ms. Reidler if this was a rezoning of the site. She asked if it were not the
condition of rezoning, would Planning and Zoning ever review the patio. She indicated they
had reviewed The Village Tavern last meeting and they were looking at the details. This
time we are not looking at the details, we're just looking at the rezoning. Do we have no
responsibility here? It appears to go to ARB, but nothing comes through here for final
clarification or approval. This is more than a patio, it is increasing the size of the building.
Ms. Reidler indicated that under the new zoning, patios are a permitted use and they are not
subject to additional review.
Mr. Rex responded that the ARB had already approved the enclosure of the current patio,
and the construction of the new patio.
Ms. Boring stated her question is a legal one. She thought that the ARB makes a
recommendation to Planning and Zoning, which then has the final say on building changes.
Ms. Reidler replied that because of this rezoning it is now a straight zone, and everything
that they are doing to modify the building is permitted in the new zone.
Ms. Boring continued that if we do not like the expansion of the building, could we discuss
it?
Ms. Reidler answered no. It is permitted under the zoning.
Ms. Boring indicated she would like to see the ARB minutes. She thought they had made it
a condition to have the minutes of ARB and BZA. She stated she is still a little confused
that the ARB has the final approval of everything. She did not know they had that kind of
leverage.
Ms. Wanner explained that the way we did it in the past for ARB, all patios are conditional
uses, which would require them to come to the Planning Commission for review and
approval. Under this new zoning district, patios are a permitted use, so it takes out that extra
layer of review that was being done before.
Mr. Gerber stated that was part of our Code modifications we made last year. What the
ARB is doing is making sure that the aesthetics and architecture are consistent with those in
the Historic District.
Ms. Boring continued that if they are proposing a patio, they go to ARB and we do not see
it?
Ms. Wanner replied that they would go to ARB and as long as they stayed within the
development standards of that district, they would be permitted to add or expand.

Mr. Gerber asked if this was consistent with the changes we made in the Code last year?
Ms. Wanner replied affirmatively.

BACKGROUND:
Case Summary:
This is a request to rezone a 0.57-acre parcel in the Historic District from CCC, Central
Community Commercial District to HB, Historic Business District. The applicant received ARB
approval for a patio expansion on August 24; 2005 (see Board Order OS-131ARB). A condition
of approval required that the applicant submit an application to rezone the property to Historic
Business. This application is being sponsored by the City but has been formally filed by the
property owner. Staff recommends approval of the rezoning with one condition.
Case Procedure:
After recommendation by the Planning Commission, the rezoning application will be forwarded
to City Council for public hearing and final vote. Atwo-thirds vote by City Council will be
required to override a negative recommendation by the Planning and Zoning Commission. If
approved by Council, the rezoning will become effective 30 days after passage.
CONSIDERATIONS:
Site Characteristics:
• Site Description. The site is generally a rectangular shape with 100 feet of frontage along
West Bridge Street. The site includes a rear access to the east on Darby Street. The site

was originally developed as a bank and drive-thru. The brick and stone building includes
a slate roof and architectural accents. One-way circulation with adjacent parking is
provided on both sides of the building and a turn azound lane is located in front of the
building. A brick paver patio is located south of the building and aground-mounted sign
located north of the public sidewalk.
• Approved Site Modifications. On January 26 and August 24, 2005, the Architectural
Review Boazd approved several site modifications and a building addition (see Boazd
Orders 04-179ARB and OS-131ARB). Restriping of the pazking lot was approved along
with the enclosure of the existing 570-square-foot patio and construction of a new 430-
square-foot patio in front of the building. Although the applicant has applied for a
building permit for these modifications, construction has not begun.
• Zoning Description. The site and properties to the east and southeast are zoned CCC,
Central Community Commercial District. Permitted uses in this district include retail,
office, and personal and consumer services. Outdoor patios are considered a conditional
use. t
• Surrounding Zoning. North of the site is Krema Products, zoned CB, Central Business
District. Permitted uses in this district include residential, retail, offices, and personal
and consumer services. The school and daycare located to the west of the site aze zoned
R-2, Limited Suburban Residential District, which permits schools and accessory uses,
single-family residences, churches, and parks. The parking lot to the south is zoned
PUD, Planned Unit Development District, as part of the Town Center II project.
Community Plan Issues:
• Land Use. The updated Future Land Use Map in the Community Plan does not identify a
preferred future land use for this site. The map indicates an existing land use of "Non-
Residential". Rezoning the property to Historic Business will ensure the continuation of
non-residential uses along Bridge Street.
Land Use and Zoning
• Rezoning. On October 6, 2003 City Council adopted two new zoning classifications for
Historic Dublin. The Historic Residential (HR) and Historic Business (HB) designations
were created to establish suitable development standards for the Historic District. The
intent of the two zoning districts is to protect the scale and character of original Historic
Dublin by allowing appropriate development standards for the redevelopment and
preservation of the District's historic character. This application will be the first
property in the Historic District rezoned to this new classification.
• Development Standards. To achieve the intent of the HB zone, several key standards
have been included in the Code pertinent to this case. In most commercial zoning
districts, outdoor patios aze a conditional use requiring the approval of the Commission.
Outdoor patios aze a permitted use in the Historic Business District. No minimum lot
azea requirement exists in the HB zone and buildings are not required to be setback a
minimum distance from the property lines. The Code also grants the Architectural
Review Board the ability to approve increases in lot coverage above the 80 percent
allowed. The site conforms to all the development standazds listed in the Historic
Business District portion of the Code.

Architecture:
• Architectural Review Board. The Code explains that the ARB is responsible for
promoting the educational, cultural, and economic well being of the Historic District.
The Board accomplishes this by regulation of all construction, alteration, maintenance,
and demolition within the Review District. Various changes to this site have been
reviewed and approved by the ARB (see attached Board Orders). Additionally, the
Board has indicated support for rezoning this property to Historic Business. Because site
modifications, including landscaping and architecture, have already been approved by the
ARB, the Commission is only reviewing the appropriateness of rezoning this site.
STAFF RECOMMENDATION:
After reviewing the applicant's request, staff recommends approval of the rezoning with the
following one condition:

1) That the applicant applies for all necessary building and zoning permits prior to
construction of any approved site modifications.
Bases:
1) This rezoning will provide an appropriate zoning classification for this site within
the Historic District and provide for effective administrative of development
standards and procedures; and

Chair Staub asked what material would be used on the patio and if the patio will look
good in the winter time with nothing out there.
Timothy Bass of Bass Studio Architects, representing the applicant, responded they
would use pavers with earth tones. There will be an evergreen surround, which will
keep it from appearing bare in the winter.
Mr. Staub asked if the drive-thru on the slide of the front elevation was no longer
there, and if the tree would stay. He asked about the landscape plan, especially for
the winter, and if the sign would change.
Mr. Bass clarified that the drive-thru would be removed and the tree is where the
addition will be built. The addition will move the same patio pictured 20 feet closer
to the street. He added that the addition meshes well with pedestrian traffic on that
corner. The majority of the landscaping will be evergreen for year-round interest,
. with the east side being fully enclosed with evergreens. The sign will not be
touched.
Member Taylor inquired about additional lighting, especially night lighting. He
asked how close the patio will be to the sidewalk and street.
Applicant Jeichun Liu responded they would do seasonal lighting, like Christmas
lights.
Member Bryan asked staff if a temporary lighting permit was needed.
Ms. Devlin clarified that a permit is not needed for seasonal lighting.
Chair Staub made a motion, seconded by Mr. Taylor to approve this application for a
205-square-foot patio expansion and an increase in lot coverage, with three
conditions listed in the staff report. All members voted in favor (3-0).
