AN ORDINANCE AUTHORIZING THE PURCHASE OF A
0.623 ACRE, MORE OR LESS, TRACT OF LAND, FROM
B.B.C., CO. LOCATED SOUTH OF BRIDGE STREET
AND EAST OF MONTEREY DRIVE, IN THE CITY OF
DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO,
AND DECLARING AN EMERGENCY.
WHEREAS, a goal of the Dublin City Council is to acquire land for continued
development within the City; and
WHEREAS, the City desires to enter into an agreement with B.B.C. Company to
purchase a 0.623 acre, more or less, tract of land, for continued development within the
City for the purchase amount of $500,000.00; and
WHEREAS, the aforementioned objectives will require the City of Dublin to obtain a
fee simple interest in the 0.623 acre, more or less, tract of land, located south of Bridge
Street and east of Monterey Drive, City of Dublin, Franklin County, State of Ohio, as
described in the attached Exhibit "A"; and
WHEREAS, it is necessary to amend the annual appropriations ordinance to provide
funding authorization to acquire the property.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Franklin, Union and Delaware Counties, Ohio, of the elected members concurring
that:
.~t~ ic,n 1 _ The City Manager is hereby authorized to execute a Purchase Agreement
with B.B.C. Company and any necessary closing documents related to the acquisition of
the 0.623 acre, more or less, tract of land and paying any related costs.
.~t~n 2= There be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund Five Hundred Ten Thousand Dollars and 00/100 Cents
($510,000.00) to account 401-0314-780-2510 for the purpose of acquiring the 0.623
acre, more or less, tract of land and paying any related acquisition costs.

~~n This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is that the prompt acquisition is necessary for the continued development of
the Historic District. Therefore, this ordinance shall be in full force and effect
immediately upon passage.

SUMMARY:
In conjunction with Dublin City Council's goal to acquire land for continued
development within the City, the City desires to acquire a 0.623 acre, more or less, tract of land
located south of Bridge Street and East of Monterey Drive from B.B.C. Co. (Duke & Duchess).
The City and B.B.C. Co. have agreed on an amount for compensation and need to close on the
property no later than September 25, 2005.
RECOMMENDATION:
Legal Staff recommends approval of Ordinance No. 52-05.
