Form No. 30043 50-OS Passed _ . 2~ Ordinance No. AN ORDINANCE AUTHORIZING THE PURCHASE OF A 0.10 ACRE, MORE OR LESS, TRACT OF LAND, FROM CONTINENTAL SAWMILL LIMITED PARTNERSHIP, LOCATED WEST OF VILLAGE PARKWAY AND SOUTH OF TULLER ROAD, CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO. WHEREAS, as a condition of zoning, an access drive open to the public is required off of Village Parkway into Greystone Mews development; and WHEREAS, the City desires to enter into an agreement with Continental Sawmill Limited Partnership to purchase a 0.10 acre, more or less, tract of land, for the construction of an access drive open to the public off of Village Parkway into Greystone Mews development for $20,000.00; and WHEREAS, the aforementioned objectives will require the City of Dublin to obtain a fee simple interest in the 0.10 acre, more or less, tract of land, located west of Village Parkway and south of Tuller Road as described in the attached Exhibit "A" located in the City of Dublin, Franklin County, Ohio. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Franklin, Union and Delaware Counties, Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute a Contract for Sale and Purchase with Continental Sawmill Limited Partnership and any necessary closing documents related to the acquisition of the 0.10 acre, more or less, tract of land and payment of any related costs. Section 2. There be appropriated from the unappropriated balance in the Capital Improvements Tax Fund Twenty Thousand Dollars and 00/100 Cents ($20,000.00) to account 401-0314-780-2510 for the purpose of acquiring the 0.10 acre, more or less, tract of land and payment of any related acquisition costs. Section 3. This Ordinance shall be in full force and effect on the earliest date permitted by law. Passed this / ~f day of ~ b ~ , 2005. A drawing of the right-of--way is attached for your review. The City has reached an agreement with Continental Sawmill Limited Partnership on compensation for this parcel. Ordinance No. 50-OS has been submitted to Council for authorization of Dublin's acquisition of this parcel for right-of--way.
