Ordinance No YE 1R AN ORDINANCE VACATING 3.575 ACRES, MORE OR LESS, OF PERIMETER LOOP ROAD LOCATED WEST OF AVERY ROAD AND SOUTH OF PERIMETER DRIVE, CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, AND DECLARING AN EMERGENCY WHEREAS, in 2000, the City of Dublin worked with Ruscilli on the development of the Perimeter West zoning area including the extension of Perimeter Drive westward to Post Road and a section of Perimeter Loop Road; and WHEREAS, during the development of the Dublin Methodist Hospital campus, Perimeter Loop Road was realigned to the west to increase the amount of developable land; and WHEREAS, the realigrunent of Perimeter Loop Road requires the vacation of 3.575 acres, more or less, of previously dedicated right-of--way (3.105 acres, more or less, on the west side out of Instrument No. 200002250037975 and 0.470 acres, more or less, on the east side out of Plat Book 95, Page 51) located west of Avery Road and South of Perimeter Drive, City of Dublin, County of Franklin, State of Ohio, and more fully described and depicted on the attached "Exhibit A". NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, ~ of the elected members concurring that: S . tec .inn 1. The 3.575 acres, more or less, of existing Perimeter Loop Road located west of Avery Road and South of Perimeter Drive, City of Dublin, Franklin County, State of Ohio, and more fully described and depicted on the attached "Exhibit A" is hereby vacated. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare, and for the further reason that the prompt vacation of the land will provide for the realignment of Perimeter Loop Road. Therefore, this ordinance shall take effect upon passage. Hammersmith, P.E., Director of Engineering/City Engineer Re: Ordinance 47-05, Vacating 3.575 Acres, More or Less, of Perimeter Loop Road Located West of Avery Road and South of Perimeter Drive, City of Dublin, County of Franklin, State of Ohio and, Declaring and Emergency. (Request to dispense with public hearing) Summary In 2000 the City worked with Ruscilli on the development of the Perimeter West zoning area. This included the extension of Perimeter Drive westward to Post Road and a section of Perimeter Loop Road. This section of Perimeter Loop Road was constru:ted to serve the Pacer Global Logistics building. Ruscilli dedicated the right-of- way for Perimeter Loop Road across the remaining land that they owned. During the development of the hospital site, Perimeter Loop Road was realigned to the west to aggregate the hospital site inside "the loop." The City approved this revised alignment. Perimeter Loop Road (to be renamed Hospital Drive) construction is currently under way. The previously dedicated right-of-way requires vacation and the realigned right-of--way needs to be dedicated. Council approved the dedication and vacation plats for the new alignment of Perimeter Loop Road by motion on May 16, 2005. In order to record the vacation plat with Franklin County, legislative action by Council supporting the vacation is necessary to accompany the vacation plat. Recommendation Staff recommends approval of Ordinance 47-OS to vacate a portion of Perimeter Loop Road (3.575 Acres) as it facilitates the campus to be created by the Dublin Methodist Hospital.
