Bird, FAICP, Director of Land Use and Long Range Plannin Fred Hahn, Director of Parks and Open Space SUMMARY: Ordinance 23-OS for Indian Run Falls Park located at 700 Shawan Falls Drive, is being forwarded for second reading. The proposal includes a Community Park containing walking paths, overlooks, shelters, and a small parking lot. On March 17, 2005, the Planning and Zoning Commission unanimously approved the request for a change in zoning for this 3.59-acres site from SO, Suburban Office and Institutional District to HR, Historic Residential District (See Record of Action OS-0172) with 1:he following conditions: 1) That the applicant obtain approval from the Architectural Review Board for the extended path system; 2) That the pedestrian bridge comply with Chapter 151 of the City's Codified Ordinances regarding its location within the designated floodplain; 3) That the applicant work with Engineering regarding the paving material for the proposed parking lot in order to meet all stormwater and Code requirements, and obtain a variance for the proposed alternative material, if necessary; 4) That the final location of the proposed bridge and walking paths be coordinated with the City Engineer; 5) That the applicant meet all current codes in regards to landscaping, or apply for the necessary variance; 6) That a mixture of deciduous and evergreen plant materials be used around the shelters and parking lot areas; 7) That the fence meet the zoning code standards and a fence permit be obtained from Land Use and Long Range Planning; 8) That the lighting conforms to the Dublin Exterior Lighting Guideline; 9) That the applicant submit evidence of parcel combination prior to issuance of building permits or certificate of zoning compliance; 10) That the applicant obtain all necessary building permits from the Division of Building Standards; and 11) That the plans be revised to show one curb c;ut for the parking area, subject to staff approval. All conditions will be addressed during the building permit process and monitored as this site develops. Parks and Open Space staff in conjunction with Kinzelrnan Kline and Hull & Associates have been field coordinating the location of the notable plant communities and trail alignment. The next step in the process is to look at the structural integrity of the site for overlook placement. An August or September bid opening is expected. Staff recommends approval of this request with conditions. Case Procedure: After recommendation by the Planning Commission, the rezoning application will be forwazded to City Council for public hearing and final vote. A t1N0-thirds vote by City Council will be required to override a negative recommendation made here. If approved by Council, the rezoning will become effective 30 days after passage. CONSIDERATIONS: Site Characteristics: Park Development. This is a very unique site for the City of Dublin and the preservation of this area is extremely important. Washington Township has taken an active role in the development of the pazk in an environmentally ~iiendly manner, and will be a financial partner with the City on this project. The applicant has been working in cooperation Dublin Planning and Zone -Commission ' Staff Report -March 17, _ _ JS Case 4 -Page 2 with the school property to the north of the site. The NRAC, Natural Resource Advisory Commission and PRAC, Park and Recreation Advisory Commission are also involved with the development of this passive park. These Commissions initiated the City's involvement in the acquisition of this site at City Council on June 6, 1994 (Resolution No. 10-94). Tluough cooperative efforts the property was purchased by the City of Dublin in June 1997 for development as a passive park. Location. The 3.59-acre site, consisting of two parcels, has approximately 500 feet of frontage on the east side of Shawan Falls Drive anti is lineaz in shape. The development of this site requires that the applicant combine the lots. Vehiculaz access to the site is provided off Shawan Falls Drive. A pedestrian only access is through the exiting bikepath located by the -Indian Run Cemetery in Historic Dublin. The applicant has a perpetual easement for the wooded azea along the falls that widens out to include the area around the cemetery. This easement width varies with the perimeter of the woods. Natural Features. The endangered species Arabic patens, Spreading Rockcress, exists on . this site. The City will be consulting with Hull and Associates, a wetland and ecological company, regazding the preservation of this species. The Ohio Department of Natural Resources will also be consulted on the construction of this park.. The site is heavily wooded and landmark trees exist on the site. The Indian Run has carved out a very unique topography through this site with natural cascading waterfalls and cliffs. Special measures are being taken by the applicant to preserve these natural elements. Zoning. The site is currently zoned SO, Suburban t)ffice and Institutional District, as are the properties to the west and northwest of the site. The permitted uses within the Suburban Office and Institutional District do not include pazks. The property located to the south is zoned CC, Community Commercial District. The Indian Run Estates subdivision to the northeast and the school site to the east are zoned R-2, Limited Suburban Residential District. The Online Computer Library Center, Inc., to the north is zoned LI, Limited Industrial District. Community Plan: • Land Use. The Future Land Use Plan within the Community Plan classifies this site as public park. The proposed use of the site matches the intended use as specified by the Future Land Use Map. Historic Dublin. A portion of the park's extended :pathway is located within the Historic Dublin District boundary, which will require plan approval from the Architectural Review Boazd. As recognized in the Community Plan, this site provides an opportunity to connect Historic Dublin and the Indian Run Falls, and to expand the Historic District to the west as property becomes available. • Rezoning_ On October 6, 2003, City Council adopted two new zoning classifications specific for Historic Dublin. Historic Residential District, HR, and Historic Business District, HB, have been created to establish compatible development standards for the entire Historic District and other historic properties. The intent of the two Districts is to protect the scale and character of original Historic Dublin and to create appropriate development standazds that allow for the redevelopment and preservation of the District's historic character_ The application of the Historic Residential District on this site will be the first property being rezoned to the new classification. Dublin Planning and Zoning Commission Staff Report - Mazch 17, 2005 Case 4 -Page 3 Site Layout: General Layout. The proposed layout includes a parking area, shelters, picnic azeas, a series of bike and walking paths, and a bridge over the Indian Run. The entrance to the site and pazking area is located off of Shawan Falls Drive. The two proposed shelters aze adjacent to the pazking area, with adjoining picnic azeas. An asphalt bikepath, a concrete sidewalk, or a gravel or mulch-walking path will provide connection throughout the pazk. A botanical assessment determined a preferred w.ilking path alignment along both sides of the Indian Run and the south side of the property. The walking path on the east side of the Indian Run will connect with a pathway stub south of the Indian Run Cemetery, west of North High Street. The paths will be connected by a bridge, similar to the type used in the Amberleigh subdivision. The bridge will be located in a FEMA designated floodplain and the applicant must meet comply with Chapter 151 of the City's Codified Ordinances. There aze four overlooks proposed along the walking path that will be placed in open aze:as along the Indian Run. Overall, the proposed elements will be placed so as not to disturb the existing vegetation and character of the azea. • Vehicle Access. The site has frontage along Shawan Falls Drive, a cul-de-sac that currently serves five different properties. The applicant was originally proposing-two vehiculaz access points, but Engineering requested. that one be eliminated_ The applicant has agreed to this. • Pedestrian Access. Pedestrians can enter the site ifrom two access points. The first entry point is from the bikepath stub located west +~f North High Street, which will be connected with the development of the proposed pathway system of the park. The second entry point is from Shawan Falls Drive. Currently, no sidewalk exists along Shawan Falls Drive and the applicant is not proposing to construct one. However, Engineering has indicated that this sidewalk may be constructed in the future as pazt of larger sidewalk project. • Parking. The applicant is proposing to use a porous pavement material for the small parking lot located off Shawan Falls Drive, and will work closely with Engineering on this project. The porous pavement allows water to~ penetrate the surface. The small sized aggregates aze removed leaving only the lazger pieces in place to provide durability and a much more environmentally friendly product. Code requires pazking lots to be a hazd surface with asphalt, concrete or a combination meeting the ODOT, Ohio Department of Transportation for construction and material spe<;ification. The applicant needs to meet this requirement or apply for the necessary vazianc:e for this alternate material. • Landscaping/Tree Preservation. This site is heavily wooded with deciduous trees, mature shrubs, and a diverse array of wildflowers. Blue Ash is a native species to the western pazt of the state and is located throughout this site. Sycamore trees are located along the northern slopes of the creek. The applicant will field stake the location of the walking paths to preserve the existing vegetation. Additionally, landscaping is being proposed azound the shelters and pazking lot. No landscaping details have been provided at this time. Staff recommends a mixture of deciduous and evergreen materials be used within the shelter and parking areas. • Bufj`ering/Screening. Landscape Code requires a perimeter buffer between office and residentially zoned property consisting of a six-foot high opaque screen plus one shade tree per 40 feet. Existing deciduous trees may be used to meet the tree-planting requirement. The Landscape Code also requires the screening of vehicular use azeas. Dublin Planning and Zoning Commission _ ' Staff Report -March 17, 2005 Case 4 -Page 4 Code requires that street trees be installed along the public right of-way. The site must meet these Code requirements. Fencing The applicant is working with the school to provide a fence along the southern edge of the site to provide a visual barrier for the students. Although the proposed fence details. have not been determined at this time, it must meet the requirements specified in the fence code. Utilities and Storm Water. The applicant will continue to work with the City Engineer on the placement of the bridge over the falls and the location of the path along Shawan Falls Drive to ensure the floodplain of the Indian Run will not be affected. Due to the passive nature of the park, no restroom or other utilities aze; to be constructed. This site will need to comply with the adopted stormwater management regulations and other development standards for the City of Dublin. Lighting and Signage. As a passive park, no main identification sign has been submitted. The applicant is proposing to have internal directional signage along the walking paths. No lighting information has been submitted but: staff recommends that any lighting conform to the Dublin Exterior Lighting Guidelines. Mr. Frimerman responded that both pieces of property Crave been for sale for a few years, but there ~ has been renewed interest in development of the sites in recent weeks_ Mr. Strip made a cautionary note to the property owner that swift passage of this rr~olution indicates only that Council is interested in working with the Nature Conservancy in purchase of the land; it does trot mean that a land purd?ase is imminent. Mrs. Boring expressed concern about taking emergency action tonight before learning about other ~ options for preservation of the lands. ~ - " Mrs. Stillwell added that this is a resolution of intent; it does not commit the City to expenditure of ~ funds, but only commits that the City will work in ooopec~ion with the Conservanry.
