AN ORDINANCE TO ACCEPT THE LOWESTBEST BID FOR THE CLOVER COURT CHANNEL IMPROVEMENTS PROJECT AND DECLARING AN EMERGENCY WHEREAS, after advertising, two bids were received and opened on October 26, 2004 for the Clover Court Channel Improvements project; and WHEREAS, Council has determined that the lowest and best bid for said project was received from The Righter Company, Inc. in the amount of $60,760.80; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities; and WHEREAS, it is in the best interest of the City to execute this contract as soon as possible so that construction may commence immediately. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio, ~_ of the elected members concurring: Section 1. That the bid from The Righter Company, Inc. in the amount of $60,760.80 be, and hereby is, accepted. Section 2. That the City Manager is hereby authorized and directed to execute a contract with The Righter Company, Inc. for completion of said project pursuant to the bid specifications and documents on file in the office of the City Engineer. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety or welfare, and for the further need to immediately commence the work in order to complete the project during the remaining period of favorable weather, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Martin, ASLA, Streetscape Specialist F_Fr,~ Re: Clover Court Channel Improvements Bid Acceptance Ordinance No. 76-04 Summary On October 26, 2004 two (2) bids were received, publicly opened and read for the Clover Court Channel Improvements project. A summary of the bids is shown on the attached bid tabulation. The Engineer's estimate for the project was $60,000.00. The Righter Company, Inc. submitted the lowest and best bid of $60,760.80, exceeding the estimate by approximately 1%, an amount most likely attributable to bidding this project later in the construction season and also reflective of contractor workloads. Although funds for construction of this project were not specifically budgeted in 2004, sufficient stormwater improvement funds are available as a result of the bid for the construction of the Shier-Rings Road Stormwater System Improvements project being $293,495 less than the programmed funds. At the August 2, 2004 City Council meeting, staff provided a status report and recommendation of the continuation of the channel erosion improvements along Clover Court initially completed at 230 and 238 Clover Court in November 2003. City Council unanimously endorsed the recommended continuation completing the improvements from 238 Clover Court to the 42-inch storm outlet beneath Monterey Drive, located west of 278 Clover Co rt. All of the Clover Court residents affected by this improvement are agreeable participants in its construction and completion. The preliminary cost estimate reported to Council was $39,000. The Engineer's estimate of $60,000 was established from the completed construction plans. The difference reflects the required excavation on three properties, demolition of existing wood and stone retaining walls, connection of existing downspouts and 12-inch pipe, the removal of existing plant material and the addition of two (2) replacement deciduous trees. For Council reference and review, a reduced set of project construction drawings for this work has been placed in the Council planning room. This work consists of the installation of a 5-foot wide channel lined by 2-foot high Mosaic Versa-Lok retaining walls within the 30-foot easement located along the rear properties of 246, 254, 262, 270 and 278 Clover Court. Staff has limited prior experience with The Righter Company, Inc. Currently, they are the general contractor for the Shier Rings Road Stormwater System Improvements project, which bid on September 28, 2004. They demonstrated sufficient qualifications and experience to successfully construct and complete that particular project and staff finds no reason not to accept their bid for this project. Recommendation Staff recommends Council adopt this Ordinance accepting the bid of The Righter Company, Inc.
