67-04 Ordinance RECORD OF ORDINANCES Dayton L,eQaI Blank Inc Form No 30043 67-04 Ordinance No. Passed 20 AN ORDINANCE TO ACCEPT THE LOWEST/BEST BID FOR THE SHIER RINGS ROAD STORMWATER SYSTEM IMPROVEMENTS AND DECLARING AN EMERGENCY WHEREAS, after advertising, two bids were received and opened on September 28, 2004 for the Shier Rings Stormwater System Improvements Project; and WHEREAS, Council has determined that the lowest and best bid for said project is from The Righter Company, Inc. in the amount of $243,505.00; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities; and WHEREAS, it is in the best interest of the City to execute this contract as soon as possible so that construction may commence immediately. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio, of the elected members concurring: Section 1. That the bid from The Righter Company, Inc. in the amount of $243,505.00 be, and hereby is, accepted. Section 2. That the City Manager is hereby authorized and directed to execute a contract with The Righter Company, Inc. for completion of said project pursuant to the bid specifications and documents on file in the office of the City Engineer. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health or welfare of the residents of this City, and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Jay Herskowitz, PE, Assistant Director of Engineering -Utilities Re: Shier Rings Road Stormwater System Improvements Bid Acceptance Ordinance No. 67-04 Summary On September 28, 2004 two (2) bids were received, publicly opened and read for the Shier-Rings Road Stormwater System Improvements project. A summary of the bids is shown on the attached bid tabulation. The Engineer's estimate for this project was $235,000. The Righter Company, Inc. (Righter) of Columbus, Ohio, submitted the lowest and best bid of $243,505, exceeding the estimate by approximately 4%, an amount most likely amibutable to bidding this project later in the construction season and also reflective of contractor workloads. As originally programmed, prior to the new Department of Service facility and the Ballantrae Golf Community being fully developed, the intent of this project was to improve the hydraulic capacity of Cosgray Creek in an area where the existing channel was known to flood and contribute to safety concerns along Shier-Rings Road. During design of this project, analysis to account for the effects that retention at the Service Complex and Ballantrae might have on downstream flows was examined. Model results showed that flow reductions attributable to these projects eliminated the need for two large sized culverts previously thought to be required. Elimination of these structures dramatically reduced the estimated construction cost for the Shier-Rings project to a level well below the $537,000 initially programmed. The current project design incorporates natural channel design elements that will restore the hydraulic capacity of the creek, provide in-stream habitat improvements and reconnect the channel to a newly constructed flood plain. Re-establishment of the flood plain will provide a water quality benefit by allowing an opportunity for sediment filtration to occur. The project also includes construction of new ditch sections and installation of reinforced concrete sewers and stone-faced headwalls. As a result of the refinement in the scope, the 2005-2009 Capital Improvement Program recently adopted by Council programmed $275,000 for construction of this project. For Council reference and review, a reduced set of project construction drawings for this work has been placed in the Council planning room. Although staff has had limited previous experience with Righter Company, Inc., the design consultant for this project, Camp, Dresser & McKee, reports Righter did an excellent job during the Lane Avenue Culvert Replacement Project. Components of this project included bank stabilization work along Evans Run, a large tributary to the Scioto River. Righter has demonstrated sufficient qualifications and experience to successfully construct and complete this project. Recommendation Staff recommends Council adopt this ordinance accepting the bid of The Righter Company, Inc.
