Form No. 30043 59-04 Ordinance No. Passed . 20 AN ORDINANCE WAIVING COMPETITIVE BIDDING REQUIREMENTS, PURSUANT TO SECTION 8.04 (`CONTRACTING PROCEDURES'), PARAGRAPH (C) ("WAIVER OF COMPETITIVE BIDDING") FOR THE PROCUREMENT OF SERVICES FOR THE INSTALLATION OF THE DUBLIN COMMUNITY RECREATION CENTER BOILER, AND DECLARING AN EMERGENCY WHEREAS, Section 8.04(c) of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) members, to waive competitive bidding requirements if Council determines that it is in the best interest of the City to do so; and WHEREAS, Council has determined that there is a legitimate basis on which to justify a waiver of competitive bidding for the procurement of labor for installation of a boiler at the Dublin Community Recreation Center (DCRC) and that such waiver is in the best interest of the City; and WHEREAS, this project is an approved 2004 Capital Improvement Project; and WHEREAS, quotes for installation services have been received and Council has determined that the quote submitted by J. A. Guy, Inc. in the amount of $66,300 is the lowest quote for the project. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That competitive bidding requirements are hereby waived for the procurement of services related to the installation of a boiler at the Dublin Community Recreation Center. Section 2. That J. A. Guy, Inc. is hereby designated as the contractor for provision of labor for the installation of the DCRC boiler in an amount not to exceed $66,300. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health or welfare of the residents of this City, and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Brautigam, City Manager~a.,r..~-- J`~ • ~j DATE: August 5, 2004 INITIATED BY: Fred Hahn, Director of Grounds & Facilities RE: Waiver of Competitive Bidding for the DCRC Boiler Installation Labor SUMMARY: The approved 2004 Capital Improvement Program contains the replacement of the four (4) pool water heaters for the Dublin Community Recreation Center. These pool heaters were part of the lawsuit filed against Moody Nolan and other's in which we claimed design flaws pertaining to the original design of Phase I of the Dublin Community Recreation Center. In evaluating the replacement options of the pool heaters, we decided our best course was to incorporate the pool water plumbing into the overall building plumbing, utilizing a boiler to both heat pool water and to supply additional capacity and redundancy of the overall building needs. We also decided to purchase the additional boiler and miscellaneous supplies outright and to contract independent trades associated with the installation, essentially the City acting as the general contractor. We solicited quotes for the various trades and all is in order with the exception of the installation of the boiler itself. Our original budget estimates were based upon the assumption that this labor would be around $26,000. After receiving two quotes, this labor cost submitted by J.A. Guy Inc. for the lowest quote is $66,300. The large increase is partially due to our failure to account for prevailing wages during our preparation of the budget. Also the original design did not include the labor required for installing a filtering system that helps protect all of the boilers and various control valves, which should be included to allow for the full benefit of the redundancy capabilities. I am still convinced we are monetarily and functionally ahead by going this route, but we do encounter the problem of dealing with the bidding threshold for labor. Dublin currently has a maximum of $30,000, above which requires competitive bidding unless Council rules it is in the best interest of the public to waive this. This is a case in which the public would be better served by doing so. The existing pool heaters are in bad shape and any further repairs would be money wasted. The time and money required for design work, plan preparation, bidding and award could well be longer then the life of the existing heaters. We have ordered the new boiler and associated equipment under the assumption the labor costs associated with the installation of them would be less then $30,000. RECOMMENDATION: Staff is recommending waiving the competitive bidding and accepting the lowest quote submitted by J.A. Guy Inc. for $66,300 for the labor associated with the installation of a new boiler for the Dublin Community Recreation Center based upon this being in the overall best interest of the City of Dublin.
