70-03 OrdinanceRECORD OF ORDINANCES Ordinance No. ~n~. 70-03 Passed , 20 AN ORDINANCE TO ACCEPT THE LOWEST/ BEST BID FOR THE SOUTHWEST AREA TRAFFIC CALMING PLAN -PHASE 4 PROJECT AND DECLARING AN EMERGENCY WHEREAS, after advertising, receiving and opening bids on June 3, 2003 bids were received for Southwest Area Traffic Calming Plan -Phase 4 project; and WHEREAS, Council has determined that the lowest and best bid for said project is from, Columbus Asphalt Paving Company in the amount of $728,635.83; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities; and WHEREAS, it is in the best interest of the City to execute this contract as soon as possible so that construction may commence immediately. N0,~3'HEREFORE BE IT ORDAINED by the Council of the City of Dublin, Ohio, ~~ of the elected members concurring: Section 1. That the bid from Columbus Asphalt Paving Company in the amount of $728,635.83 be, and hereby is, accepted. Section 2. That the City Manager is hereby authorized and directed to execute a contract with Columbus Asphalt Paving Company for completion of said project pursuant to the bid specifications and documents on file in the office of the City Engineer. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health or welfare of the residents of this City, and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Richardson, P.E., Assistant Director ofEngineering -Design Re: Southwest Area Traffic Calming Plan -Phase 4 Bid Acceptance Ordinance Ordinance No. 70-03 Summary: On June 3, 2003 three (3) bids were received and publicly opened and read for the Southwest Area Traffic Calming Plan -Phase 4 project. A summary of the bids is shown on the attached bid tabulation. All bids have been reviewed by Division of Engineering staff. The engineer's estimate for this project is $760,000. These improvements, as depicted on the attached exhibit, consist of constructing traffic circles at the intersections of Rings Road with Wilcox Road and Rings Road with Brighton Hill Lane, and providing landscape treatments at the intersection of Rings Road with Norn Street. Columbus Asphalt Paving, Inc. of Columbus, Ohio, submitted the lowest and best bid of $728,635.83, which is $31,364.17 less than the engineer's estimate. Columbus Asphalt Paving, Inc. successfully completed in 2001 the Southwest Area Traffic Calming Plan -Phase 2. They also are nearing completion of the Southwest Area Traffic Calming Plan -Phase 3. They performed well and work was completed on schedule. As a result, there are no concerns with them performing this project. All necessary right-of--way and temporary construction easements from adjacent property owners have been appropriated. Previously, Council expressed concerns about the conformance of the various phases of the Southwest Area Traffic Calming Plan with the adopted tree preservation requirements of the City. Staff has reviewed the tree preservation plan for all six phases of the Southwest Area Traffic Calming Plan project. The Tree Preservation Ordinance states that protected trees are trees that are at least 6-inch diameter breast height. In essence, the Ordinance states that the total number of caliper inches of replacement trees for a site shall equal or exceed the combined diameter of the protected trees removed and that the trees should be of a deciduous species, which are indigenous to the region, and the new trees shall not be less than 2 %z -inches caliper. The City does allow some flexibility to the Ordinance because deciduous healthy trees of this size can be difficult Memo to Members of Dublin City Council Southwest Area Traffic Calming Plan -Phase 2 June 19, 2003 Page 2 to locate in large quantities. The City allows a variety of trees, such as evergreens and ornamental trees to be installed to maintain visual interest and still meet the requirements of the Ordinance. Based on both office and field research, staff has determined that a total combined diameter of 791-inches of trees will or have been removed. A combined total of 517-inches are to be or have been installed through landscape and streetscape efforts. Of this total, 22.5-inches are trees that are 2-'/2 inch diameter and meet the ordinance as written. The remaining trees are a combination of 2-inch caliper trees and 1-%2 -inch ornamentals. This total also includes the required street trees, which are required to be 1 3/4-inch diameter. In addition, 231 evergreens of varying heights have been or will be installed. Furthermore, the Southwest Area has three parks that have had additional trees planted. The Rings Road Greenspace, planted in the spring of 2002, added a total of 262 %2 total inches of 1 3/4-inch diameter deciduous trees. The Balgriffin Disc Golf Course, planted in the fall of 2001, added a total of 90 inches of 2- inch diameter deciduous trees and 101 evergreens. The Balgriffin/Sandy Corners Park Development Project, planted in spring of 2003, added a total of 260 inches of 2-inch diameter deciduous trees and 149 evergreen trees. These three parks have added an additiona1612-'/2 inches of deciduous trees and 250 evergreen trees. Recommendation: Staff recommends this ordinance accepting the bid of Columbus Asphalt Paving, Incorporated be adopted by Council. Emergency action upon adoption is requested to allow the work to commence immediately and be mostly performed during the more favorable summer weather, and thus be substantially completed by the final project completion date of October 24, 2003. b 0 ...
