Gunderman, Assistant Director of Pla g SUMMARY: Consistent with the "Area Rezoning" project, these ordinances will formally establish the Dublin R-l, Restricted Suburban Residential District for all properties except the Muirfield Reserve. This reserve is proposed to have the R, Rural District established, due to its undeveloped natural reserve status. [See application 03-0542.] The staff held a public informational review of these proposals on June 25, 2003 for the property owners. Several residents attended, gave comments, and expressed thanks to the staff for the presentation and informational meeting. On July 31, 2003, the Planning Commission approved each rezoning application individually (4-0). A condition was added to Ordinance #65-03 which stated that if the Hansel property (File no. 02-1382) rezoning application is approved by City Council, prior to this application moving forward, that the site be deleted from this rezoning. The PUD rezoning for the Hansel Property is still pending, and it will not be necessary to remove it from this R-1 area rezoning. RECOMMENDATION: Approval of Ordinances 65-03, 67-03 and 68-03, as recommended by the Planning and Zoning Commission. Area Rezoning 03-0572 -River Forest Bobbie Clarke said she was presenting all three of the area rezoning applications tonight on behalf of Anne Wanner who had done all the research, maps, coordination and resident meetings. She said Ms. Wanner had done all the work on all these area rezonings. Ms. Clarke said River Forest is 217 acres consisting of 12 lots. It was constructed prior to annexation into Dublin in the 1970s. There is no record of an ordinance to establish R-1 zoning had been passed by Council. Since prior to 1985, Dublin's zoning map showed River Forest as zoned R-1. This area rezoning assignment began following a legal problem. Staff was advised by the Law Director's office that systematic zoning was needed on all Dublin properties. Ms. Clarke said there was an informational meeting held with the neighborhood about a month ago. She was asked what was the worst thing that could happen if these properties were not placed in Dublin zoning districts. She said if a neighbor starts a business, there is no record that indicates that it is residential property. Ms. Clarke said the City's request is to establish R-1 zoning on these properties in River Forest. The first major area rezoning was undertaken in 2001, and it covered the Northeast Quadrant of Dublin. City Council has introduced additional rezonings since last year. The subject site in this case was annexed in 1974; there is no history of a formal rezoning ordinance for the River Forest neighborhood since that time. Ordinance #68-03 was introduced at City Council on July 21, 2003. It will establish Dublin R-1, Restricted Suburban Residential District zoning on these properties. A special informational meeting was held on June 25, 2003 at the Dublin Recreation Center and several property owners from this neighborhood attended. After the Planning Commission makes its recommendation, the case will be forwarded to City Council for a public hearing and final vote. With a positive recommendation from the Commission, a simple majority vote is required for passage. A negative Commission recommendation requires five votes for passage. If the ordinance is approved, it will take effect in 30 days. CONSIDERATIONS: Site Characteristics: The subject area is comprised of the entire 121-lot River Forest subdivision, covering a total area of 217 acres. The neighborhood is located on the west side of Dublin Road, north of Rushwood Drive. The subdivision has two points of access to Dublin Road, at both River Forest and Ashford Roads. Streets within the subdivision include Indian Hill, River Forest and Ashford Roads, and Bennett Court. The lots range in size from about one acre to almost three acres on some lots. This rezoning proposes to establish the Dublin R-1, Restricted Suburban Residential District for all properties. All legally non-conforming uses will be subject to the requirements of Section 153.004(C). The area was platted in 1956 through Franklin County. It was annexed into Dublin in 1974 as a complete and maturing neighborhood. Utilities were installed sometime subject to our assessment. To the north and west are single-family homes zoned PUD as part of Muirfield Sections one, 13, and 40, respectively. To the southwest is a parking area used during the Muirfield Tournament and additional single-family homes zoned PLR, Planned Low Density Residential District, as part of the Bristol Commons subdivision. Along the southern border of the site is the Woods of Dublin subdivision, zoned R-2, Suburban Residential District, and one single-family house which is currently part of a separate area rezoning (see case #03-056~Z.) Across Dublin Road to the east are additional single-family homes zoned PUD, as part of the Amberleigh developments. A letter was mailed to the affected property owners listed in this application. A sample copy is attached, and it outlines the circumstances, procedures, and proposed zoning, as well as dates for public meetings. An informational meeting was held on June 25, 2003, for the River Forest property owners. Several residents attended this meeting and wanted to be assured that the existing conditions of their subdivision, such as the absence of curbing, lighting, and sidewalks, would not be changed or altered. As the Commission is aware, this is an assignment to establish a formal rezoning paper trail. No development or improvements of any type are associated with it.
