63-03 Ordinance RECORD OF ORDINANCES Dayton Legal Blank, Ina Form No. 30043 Ordinance No. 63-03 Passed 20 AN ORDINANCE TO ACCEPT THE LOWEST/ BEST BID FOR THE HISTORIC DUBLIN STORM AND SANITARY SEWER IMPROVEMENTS -PHASE 1 PROJECT AND DECLARING AN EMERGENCY WHEREAS, after advertising, receiving and opening bids on May 29, 2003 for the Historic Dublin Storm and Sanitary Sewer Improvements -Phase 1 Project, Council has determined that the lowest and best bid for said project is from R. E. Holland Excavating, Inc. in the amount of $1,883,472.00; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities; and WHEREAS, it is in the best interest of the City to execute this contract as soon as possible so that construction may commence immediately, NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio, of the elected members concurring: Section 1. That the bid from R. E. Holland Excavating Inc. in the amount of $1,883,472 be, and hereby is, accepted; Section 2. That the City Manager is hereby authorized and directed to execute a contract with R. E. Holland Excavating, Inc. for completion of said project pursuant to the bid specifications and documents on file in the office of the City Engineer. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health and welfare of the residents of this City, and, therefore, shall take effect and be in force immediately upon its passage. Herskowitz, P.E., Assistant Director ofEngineering -Utilities ~ Y' Re: Historic Dublin Storm and Sanitary Sewer Improvements- Phase 1 Bid Acceptance Ordinance Ordinance No. 63-03 Summary: On May 29, 2003 three (3) bids were received, publicly opened and read for the Historic Dublin Storm and Sanitary Improvements -Phase 1 project. A summary of the bids is shown on the attached bid tabulation. All bids have been reviewed by the Division of Engineering staff. The engineer's estimate for this project was $2,373,000. The Phase I improvements will occur in areas along High Street and east of High Street, including the alleys, and along Darby Street beginning at the school property and continuing east to North Black Smith Lane. The improvements will consist of new storm sewers and street rehabilitation to add concrete curb to better direct stormwater to the new storm sewers, ADA (Americans with Disabilities Act) compliant curb ramp improvements, sidewalks, and roadway resurfacing with new asphalt. R.E. Holland Excavating, Inc. of Springfield, Ohio, submitted the lowest and best bid of $1,883,472, which is $489,528 less than the Engineer's estimate, but only 12% less than the high bid of $2,113,888 and 6% less than the second lowest bid of $1,991,054. A difference of about 12% between a high and low bid is not considered significant and generally suggests that all bidders had a reasonably clear uderstanding of the project scope and work, and the methods and means required to perform and complete the work. Staff has not had recent experience with R.E. Holland Excavating, Inc., and therefore contacted several references familiar with the R. E. Holland's work. References contacted included the City of Dayton Water Department, the Public Works Division of Hamilton, Ohio and the Cincinnati Metropolitan Sewer District (MSD). Work performed by R. E. Holland for these agencies involved installation of sanitary and storm sewers and included a $5 million sanitary sewer construction project performed for Cincinnati MSD. E. Holland's work performance, and overall were generally satisfied. Recommendation: Staff recommends this ordinance accepting the bid of R. E. Holland be adopted by Council. Emergency action upon adoption is requested to allow the work to commence immediately and be mostly performed during the more favorable summer weather, and thus be substantially completed by the final project completion date of November 21, 2003.
