47-03 Ordinance RECORD OF ORDINANCES Dayton Legal Blank, Ina Form No. 30043 Ordinance No. 47-03 Passed 20 AN ORDINANCE AMENDING SECTION 31.06 OF THE CODIFIED ORDINANCES OF THE CITY OF DUBLIN WHEREAS, currently, t he City of Dublin Codified Ordinances do not permit Code Enforcement officers to enforce parking restrictions on public property; and WHEREAS, the City has public parking areas with parking restrictions; and WHEREAS, these public parking restrictions have been enforced solely by City police officers; and WHEREAS, the City wishes to have Code Enforcement Officers enforce parking restrictions in public parking areas, NOW, THEREFORE, BE IT ORDAINED, by the Council, of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. That Section 31.06 of the Dublin Codified Ordinances be revised to read as follows: SECTION 31.06 CODE ENFORCEMENT OFFICERS. (A) Code Enforcement Officers may be commissioned by the City Manager. Code Enforcement O fficers a re r esponsible f or t he e nforcement o f t he C ity C odified Ordinances, including but not limited to, the Zoning Code, Property Maintenance Code, Animal Regulations, Parking Regulations and Health and Safety Regulations. Code Enforcement Officers may issue citations for minor misdemeanor and unclassified minor offenses only. Code Enforcement Officers do not have arrest powers or the right to carry weapons. Any such commission may be terminated by the City Manager. (B) The City Manager may commission other employees as deemed necessary to effectively administer this section. Section 2. That this Ordinance shall take effect and be in force from and after the earliest date permitted by law. Crandall, Management Assistant Summary As part of a new effort to establish and enforce limited hour parking restrictions in a specified section of Historic Dublin, Staff is requesting an amendment to our City code allowing code enforcement officers to enforce parking limitations on public property. This is being proposed as a "test" program. A detailed overview follows: Background Since the opening of the Old Dublin Town Center (phase I) in Spring, 2001, the City has received numerous comments related to the parking duration of vehicles in the public lot adjacent to the Center. Employees of several of the area businesses use many of the spaces to park for extended periods of time, leaving few spaces for patrons to conveniently park. Understanding that this absence of convenient parking could have a negative effect on patrons choosing to frequent area shops and restaurants, Staff is interested in addressing this issue. The City's Community Plan also identified this issue and recommended for Historic Dublin that "every effort should be made to assure a regular turnover in parking and to encourage employees and other non-patrons to park at more remote locations"(section attached). Several attempts have been made to rectify this situation since November of 2001 by approaching the businesses having employees parking in this lot and encouraging them to park off-site. These friendly attempts, proved unsuccessful. In January 2002, signs were installed in the lot that read "Customer Parking Only". These sign have also been unsuccessful in dissuading employees of area businesses from parking in the lot. Proposed Signage Having exhausted several possible alternatives, Staff has determined that the installation of limited hour parking signs in this lot is the next best solution to increase the availability of convenient patron parking. The exact wording of the signs has not yet been determined but will limit parking to 2 hours, Monday though Saturday, between the hours of 8 a.m. and 5 p.m. Attached please find a diagram showing the location of parking spaces that will be designated for this signage. One sign will be placed in each section of spaces. Additionally, 2-hour limited parking signs have been in place for several years along the southwest side of High Street. These will also be enforced as part of this program. Historic Dublin Parking Study In March of 2000, prior to the completion of the Old Dublin Town Center, ms consultants, inc. completed a comprehensive parking study for all four quadrants of Historic Dublin. This study did determine that peak times for parking in the southwest quadrant are during the daytime hours. Attached are bar charts taken from this study showing weekday parking trends for both the southwest and the southeast areas of Historic Dublin. Taking into account the types of businesses included in the Old Town Center, it can be assumed that the current space usage during the peak hours is now even higher. Enforcement of Parking Restrictions In order for these restrictions to affect parking habits in this lot, enforcement of the limitations is crucial The attached ordinance makes a slight change in the City's current code to allow code enforcement officers to enforce parking restrictions on public property. Currently, code enforcement officers do have the ability to enforce parking restrictions on private property. With this code change in place, both code enforcement officers and police officers will have enforcement authority. A copy of the current code section is attached. Code Enforcement Workload Impact It is anticipated this will have a minimal workload impact on the City's code enforcement team. Immediately following the installation of the signs is when the most significant amount of time would be dedicated to this effort. Following this, periodic enforcement would occur. The time needed between "monitoring checks" of vehicles in the lot and on High Street, could be spent examining other code issues in the area. Future Parking Needs While the addition of 57 spaces in the public parking lot currently being constructed just southwest of Old Dublin Town Center (phase I) will provide additional patron and merchant parking, long-term needs will continue to be addressed. Staff is planning on holding a meeting with all the area business owners to examine parking issues and to continue looking at long-term solutions. Additionally, Staff is planning on monitoring the success and workload associated with enforcement of parking restrictions in this limited area. The degree of success and time commitment necessary for enforcement will determine the continuation of this program and/or the expansion of the program to other areas in Historic Dublin as deemed necessary in the future. Recommendations Passage of the attached ordinance that will allow for code enforcement officers to enforce parking restriction in public parking lots. Challenge C: To increase the parking resources within Old Dublin's current boundaries, while decreas- ing their visual impact on the townscape. Recommendations: • Establish shared parking to the rear of existing commercial buildings. (Cl ) This initiative would require along-term working relationship between the public and private sectors in Old Dublin. Efforts should be made to maximize the parking availability by combining small, individual lots, thereby increasing effi- ciency. This will improve access to both commercial and residential properties. ~ • Establish a convenient municipal parking facility for Old Dublin patrons. (C2) The City designed and installed convenient off-street parking on South High ~ Street. This is a model example of how the shared parking lots and correspond- ~ ~ ing signage should be designed. With the proposed public square, and minimal ~ site demolition, a larger municipal lot could be developed in the northwest quad- ~ ~ ~ i ~ rant with convenient access to the public square. • Maximize the use of on-street parking spaces for patrons. (C3) On-street parking in Old Dublin is a valuable asset for businesses and patrons. (This is not mapped.) Most of the Old Dublin lots are small, and the standard off-street parking requirements are not feasible. However, the current Code requires businesses to meet the same parking standards that apply to the rest of Dublin where land is more plentiful. To facilitate re-use of existing buildings, and to assure the contin- ued preservation of historic structures, the City should adopt reduced parking standards for Old Dublin. • Provide buffering of the parking areas along residential areas. (C4) Providing a successful mix of uses within Old Dublin is an essential element of y its success. This includes protection of the residential back yards along proposed parking areas. A buffer standard should be established. Stone walls should be considered as a defining feature. j • Provide stornwater infrastructure. (This is not mapped.) The Old Dublin area does not have typical urban infrastructure to handle 29 South High Street. stormwater runoff. The parking recommendations of this section may increase runoff. The provision of stormwater infrastructure will serve to eliminate poten- tial flooding of adjacent residential areas. No person, corporation or organization shall make and no candidate shall-accept a contribution of more than $100 to any candidate for city elective office. (B) Application. This section shall apply to all candidates for all elected city offices. (C) Contribution Definition. Contributions include monies, loans, debts incurred, property-in- kind, or things having a monetary value incurred or received by a candidate or his agent or other person on behalf of the candidate for use in advocating or influencing the election of the candidate. (D) Candidate Resources. The limitations imposed by this section shall not apply to contributions ~f a candidate's own resources to the candidate's own campaign. 2000 S-6
