Ordinance No. 90-03 Passed 20 AN ORDINANCE AUTHORIZING THE ACQUISITION OF A 1.384 ACRE, MORE OR LESS, P ARCEL O F L AND A ND A 1.341 ACRE, MORE OR LESS, PARCEL OF LAND FROM THE ESTATE OF PATRICIA G. SCHUMANN, LOCATED ON DUBLIN ROAD, SOUTH OF EMERALD PARKWAY, WASHINGTON TOWNSHIP, FRANKLIN COUNTY, APPROPRIATING FUNDS THEREFOR, AND DECLARING AN EMERGENCY WHEREAS, a goal of Dublin City Council is to continue to acquire land for parkland purposes; and WHEREAS, the City of Dublin was awarded a grant from the Clean Ohio Conservation Fund for the acquisition of the two parcels of land identified in the attached Exhibit; and WHEREAS, the City desires to enter into an agreement to purchase the 1.384 and 1.341 acre parcels of land for parkland purposes in the amount of $190,000. NOW, THEREFORE, BE IT QRDAINED by the City of Dublin, Franklin, Union and Delaware Counties, Ohio, ~_ of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute the funding agreement for the Clean Ohio grant, a Real Estate Purchase Agreement, and any necessary closing documents related to the acquisition of the 1.384 and 1.341 acre parcels of land and paying any related closing costs. Section 2. There be appropriated from the unappropriated balance in the Clean Ohio Grant fund the amount of $190,000 to account 439-0314-780-2510 for the purpose of acquiring the two parcels of land identified in the attached Exhibit. Section 3. This Ordinance is declared to be an emergency to protect the health, safety and welfare of the citizens of Dublin and to further meet the terms as agreed to by t}le parties; therefore, this Ordinance shall take effect immediately upon its passage. Grigsby, Deputy Assistant City Manager/Director of Finance `c`~~ Re: Ordinance No. 90-03, An Ordinance Authorizing The Acquisition of Land Along Dublin Road Summary: Ordinance No. 90-03 authorizes the acquisition of two parcels of land located along Dublin Road, south of Emerald Parkway and the I-270 overpass, as identified on the Exhibit to the Ordinance. As you are aware, the City recently received notice from the Natural Resources Assistance Council for Franklin County that the Clean Ohio grant application submitted by the City for the acquisition of the referenced parcels was successful. A grant in the amount of $121,940 was approved and will assist in the acquisition of the two Dublin Road parcels. The City will receive grant-funding agreements from the Ohio Public Works Commission (OPWC) in late August. We have initiated the process to have an environmental phase I assessment completed. We will not close on the property until the required OPWC documents have been executed and a satisfactory environmental report has been received. If the environmental report is not satisfactory, we will not proceed wit the acquisition. The OPWC requires that a separate fund be established to account for financial transactions related to acquisitions funded by Clean Ohio grants. Ordinance No. 90-03 establishes a Clean Ohio Grant Fund to comply with this requirement. The City will receive grant funds in the amount of $121,940 once the closing on the parcels has been completed. The city's share of the acquisition will be $68,060. The amount will be transferred from the Parkland Acquisition Fund to the newly established Clean Ohio Grant Fund. The Clean Ohio program also requires that the land acquired with funds from Clean Ohio grants remain in the ownership and control of the grant recipient in perpetuity. Deed restrictions, which are commensurate with the purpose identified in the application, will be recorded as required. Recommendation: Staff recommends the adoption of Ordinance No. 90-03 at the September 2, 2003 City Council meeting.
