Gunderman, Assistant~~~ of Planning~~~ SUMMARY: As part of the on-going "Area Rezoning" project these rezoning applications will establish Dublin zoning for properties in the middle portion of Dublin bounded by Brand Road, Dublin Road, I-270/161 and Hyland-Croy Road. These properties, listed in Ordinances 84-03 85-03, 86-03, and 87-03, include "estate-lot" residential properties, parkland, Coffman high school, and a few churches. Although this systematic rezoning method is very time-intensive undertaking, progress is being made. The goal is to have this project completed by the end of the year. An introductory letter was mailed on July 14 to all of the affected landowners, along with the applicable zoning regulations and a copy of the attached map(s). An informal question and answer forum for these residents is scheduled for July 29, 2003. RECOMMENDATION: Introduction of the ordinance and referral to the Planning and Zoning Commission. BACKGROUND: On the advice of Dublin's Law Director, staff is systematically reseazching Dublin zoning activity on all pazcels annexed into Dublin. The Planning Division is responsible for compiling and processing these "azea rezoning" applications to formally establish Dublin zoning wherever there is ~ question about the zoning history. The first major azea rezoning was undertaken in 2001, and it covered the northeast quadrant of Dublin. City Council has introduced additional rezonings since last yeaz. The subject sites in this case were annexed in 1965, 1973, 1980, and 1988; there is no history of zoning action since that time. The pazcels have reflected R-1, Restricted Suburban Residential and R, Rural Districts on Dublin's zoning map for many years. Ordinance #86-03 was introduced at City Council on July 21, 2003. It will establish Dublin R-1 and R Districts on these properties. A special informational meeting was held on August 26, 2003 at the Dublin Recreation Center and only a few property owners from this area attended, although staff did speak on the phone with three other property owners. After the Planning Commission makes its recommendation, the case will be forwazded to City Council for a public hearing and final vote. With a positive recommendation from the Commission, a simple majority vote is required for passage. A negative Commission recommendation requires five votes for passage. If the ordinance is approved, it will take effect in 30 days. CONSIDERATIONS: Site Characteristics: • The subject sites aze parcels along the south side of Brand Road, east of Coffinan Road, west of Dublin Road, and north of I-270. The total azea being rezoned is 83 acres. The pazcels consist of four single-family homes, two vacant residential parcels, land associated with Coffman high school, and one property owned by the City of Dublin. The parcels range in size from one acre to almost 28 acres. Dublin Planning and Zoning Commission Staff Report -September 18, 2003 Page 17 • This rezoning proposes to establish the Dublin R-1 District for all parcels except those associated with Coffinan high school, which will receive the R category. All legally non- conforming uses will be subject to the requirements of Section 153.004 (C). The parcels are bordered by various residential and office uses. Those properties closest to the Brand and Dublin Road intersection are nestled between several sections of Coventry Woods and Killilea. Properties associated with Coffman high school and the City of Dublin parcel are surrounded by office uses including the Cardinal Health west campus and Verizon buildings on the south, single-family development on the west, and additional school offices and single-family residential along the north and east. A letter was mailed to the affected property owners listed in this application. A sample copy is attached, and it outlines the circumstances, procedures, and proposed zoning, as well as dates for public meetings. An informational meeting was held on August 26, 2003, for the affected property owners. Less than five property owners from this area attended the informational meeting, although staff did have phone conversations with three property owners regarding this application. Community Plan, Land Use and Zoning Issues: • On August 12, 2002, City Council amended the Future Land Use Map (Map 8) of the Community Plan. All of the properties in this application are shown on the Future Land Use Plan as having an existing land use as "Residential" or "Public/Institutional Buildings." • This rezoning is primarily a housekeeping issue and will not have an immediate impact on the majority of the surrounding residents and property owners. Legally non-conforming uses cannot be expanded, and they cannot be re-established after being discontinued for a period of two years. • Even without Dublin zoning, most of Dublin's development standards would apply. A 1976 ordinance requires adherence to Dublin standards, wherever they are stricter, following annexation. However, the failure to establish Dublin zoning on the property could make administration and enforcement difficult in some circumstances. It can also be rather confusing for landowners. Development Standards: • The properties listed in this application were annexed from Washington Township (Franklin County) in the various years of 1965, 1973, 1980 and 1988. Relying on the correct township zoning district for these areas is not precise or advisable. However, the table at the end of this report illustrates the zoning for the proposed Dublin R-1 District as compared to the Washington Township R-lA, Restricted Suburban Residential District. The permitted uses are very similar. The development standards listed for side yards is more restrictive in the Washington Township regulations, but the other development standards are very similar (see table at end of report). Utilities: • This is an action to establish Dublin zoning. No development is proposed as part of this application, and it has no effect on utilities. • New development anywhere in Dublin, including on these parcels, must comply with adopted stormwater management regulations for the City of Dublin. The zoning does not affect utility status. Undeveloped parcels will need to tap into the existing utilities per City Code. STAFF RECOMMENDATION: The staff research indicates these properties were not placed in a Dublin zoning classification by a formal rezoning ordinance following annexation. They have been reflected as R-1, and R on the zoning map for many years. This application is City-sponsored and legally advisable. It is intended to avoid any future potential Code enforcement problems arising from township classifications and inconsistencies within the Dublin zoning map. This action provides proper zoning and is primarily a housekeeping effort. Staff recommends approval of this rezoning. Bases: 1) This rezoning will provide an appropriate Dublin zoning classification for land within the City limits to provide for the effective administration of development standards, procedures, etc. 2) The rezoning will maintain the established development pattern that has been in place for many years and establishes land uses consistent with those listed in the Community Plan. Gunderman, Assistan~~~ of Planning~~ SiJMMARY: As part of the on-going "Area Rezoning" project these rezoning applications will establish Dublin zoning for properties in the middle portion of Dublin bounded by Brand Road, Dublin Road, I-270/161 and Hyland-Croy Road. These properties, listed in Ordinances 84-03 85-03, 86-03, and 87-03, include "estate-lot" residential properties, parkland, Coffman high school, and a few churches. Although this systematic rezoning method is very time-intensive undertaking, progress is being made. The goal is to have this project completed by the end of the year. An introductory letter was mailed on July 14 to all of the affected landowners, along with the applicable zoning regulations and a copy of the attached map(s). An informal question and answer forum for these residents is scheduled for July 29, 2003.
