Form No. 30043 Ordinance No. 43-03 Passed . 20 AN ORDINANCE AMENDING CERTAIN SECTIONS OF ORDINANCE NO. 98-96 (COMPENSATION PLAN), AUTHORIZING THE CREATION OF A NEW POSITION (ASSISTANT DIRECTOR OF STREETS & UTILITIES), AND AMENDING THE 2003 ANNUAL APPROPRIATIONS. WHEREAS, Council has determined, upon the recommendation of the City Manager, that certain sections of Ordinance No. 98-96 (Compensation Plan for non-union 'i personnel) should be amended; and WHEREAS, Council has determined that adoption of these amendments is necessary to the administrative/operational effectiveness of the City; and WHEREAS, it is necessary to amend the 2003 annual appropriations ordinance to provide funding for the personnel changes associated with the structural re-organization proposed by Ordinance No. 42-03. I NOW, TH BEFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That Section 2. ("WAGE & SALARY STRUCTURE/ DMINISTRATION"), subsection A of Ordinance No. 98-96 be amended by re-titling the "Director of Finance" I job classification to "Deputy City Manager/Director of Finance" under the "Finance/Accounting" categorical heading. ' Section 2. That Section 2. ("WAGE & SALARY STRUCTURE/ADMINISTRATION"), subsection A. of Ordinance No. 98-96 be amended by re-titling the "Director of ~ Development" job classification to "Deputy City Manager/Director of Development" under the "Planning, Development, & Zoning" categorical heading. Section 3. That Section 2. ("WAGE & SALARY STRUCTURE/ADMINISTRATION"), subsection A. of Ordinance No. 98-96 be amended by re-titling the "Director of Service" job classification to "Deputy City Manager/Director of Service" under the "Service, Maintenance, Streets & Utilities, Grounds & Facilities" categorical heading. I Section 4. That Section 2. ("WAGE & SALARY STRUCTURE/ADMINISTRATION"), subsection A. of Ordinance No. 98-96 be amended by reclassifying the Management Assistant classification, under the "General Management/Administration" categorical heading, and reassigning said classification from its existing pay grade (Pay Grade 9) to the following: Classification Title Pay Grade Assistant City Manager 11 ~ ~ Section 5. That Section 2. ("WAGE & SALARY STRUCTURE/ADMINISTRATION"), I'~, subsection A. of Ordinance No. 98-96 be amended by deleting the last paragraph in said j section. (This paragraph authorizes the City Manager, at his/her discretion, to assign the "Assistant City Manager" title to any existing Department/Division Head classification ~ title.) Section 6. That the creation of a new "Assistant Director of Streets & Utilities" position is hereby authorized and that, in accordance with the authority provided to Council under Section 6.06 (a) of the Revised Dublin Charter, this position be filled, by promotion, without a competitive selection process. That there be appropriated from the unappropriated balance in the General Fund the amounts of $43,500 to account 101-031.3-720-2110 and $10,600 to account 101-0313-720-2120 to provide funding for transfer of the Development Project Coordinator position from the Division of Economic Development to the Division of Building Standards. Section 9. That appropriations be reduced in the General Fund in the amounts of $43,500 in account 101-0314-720-2110 and $10,600 in account 101-0314-720-2120 as a result of transferring of the Development Project Coordinator from the Division of Economic Development to the Division of Building Standards. Section 10. That there be appropriated from the unappropriated balance in the Street Maintenance Fund the amounts of $40,500 to account 210-0631-770-2110 and $15,100 to account 210-0631-770-2120 to provide funding for the newly created Assistant Director of Streets and Utilities position. Harding, Director of Human Resources Re: Ordinance No. 43-03 Amending Certain Sections of the City Compensation Plan SUMMARY: Attached for your consideration, please find Ordinance No. 43-03 amending certain sections of the City Compensation Plan (Ordinance No. 98-96). This Ordinance is regarded as companion legislation to Ordinance No. 42-03, which involves the amendment of the City Organization Chart. All proposed amendments to the Compensation Plan relate directly to the re-organization proposed within Ordinance No. 42-03. Passage of Ordinance 43-03 would accomplish the following: ? The re-titling of the Director of Finance, Director of Service, and Director of Development positions to Deputy City Manager/Director of Finance, Deputy City Manager/Director of Service, and Deputy City Manager/Director ofDevelopment respectively. Presently, these three Department Head positions carry the working title of Assistant City Manager, in conjunction with their formal classification titles. The proposed amendment will formally establish the classification title of "Deputy City Manager" within the City's classification and compensation system. This re-titling will better reflect "second-in-command" nature of these positions. ? The reclassification of the existing "Management Assistant" position to "Assistant City Manager" and reassignment of this classification from Pay Grade 9 ($46,184 - $67,544) to Pay Grade 11 ($54,974 - $80,397). This classification's changing role has been re-evaluated (quantitatively) using the established job evaluation instrument ("Position Appraisal Method"). Based upon the changing concept/nature of the job and the proposed evolution in duties/responsibilities, Staff has concluded that this classification should be reassigned to Pay Grade 11. ? Deletion of the last paragraph under Section 2.A. of the Compensation Plan, which presently authorizes the City Manager to assign the "Assistant City Manager" title (as a working title) to any existing Department/Division Head classification title. (The intent of the paragraph was to allow the City Manager the flexibility to informally confer the "Assistant City Manager" title upon aDepartment/Division Head in conjunction with their formal classification title; hence the title was not a formalized classification title.) Given the above- mentioned amendments regarding the "Deputy City Manager" and "Assistant City Manager" classification titles, this paragraph is no longer functional. ? Creation of a new "Assistant Director of Streets & Utilities" position/classification and the authorization to fill this position, by promotion, without a competitive selection process. Staff has determined that the volume, scope, and complexity of work within the Division of Streets & Utilities necessitates the creation of a higher-level management position. This position's role has been evaluated (quantitatively) via the established job evaluation system, which reflects that this position should be assigned to Pay Grade 10 ($50,387 - $73,692). Given that there is a uniquely qualified internal candidate for this position, Staff proposes that this position be filled internally, by promotion, without a competitive election process. (Section 6.06(a) of the Revised Dublin Charter authorizes Council to provide for appointments and promotions through means other than the normal competitive selection process.) Passage of this legislation will also amend the 2003 Annual Appropriations. These amendments involve the appropriation and transfer of funds to address the salary and benefit impacts associated with the structural reorganization proposed by Ordinance No. 42-03. RECOMMENDATION: Staff recommends that the attached legislation (Ordinance No. 43-03) be adopted by Council at the second reading on Apri121, 2003. /lcw Attachment
