Form No. 30043 Ordinance No. 41-03 (Amended) Passed 20 AN ORDINANCE ACCEPTING THE LOWEST/BEST BID FOR THE WOERNER TEMPLE COMMUNITY POOL PROJECT, AND DECLARING AN EMERGENCY WHEREAS, after advertising, receiving and opening bids on April 2, 2003 for the Woerner Temple Community Pool Project, Council has determined that the lowest and best bid for said project is from Gutknecht Construction Company in the amount of $4,048,000 base bid and $34,500 for Alternate 1; and WHEREAS, it is necessary to amend the annual appropriations ordinance to provide funding authorization for the project. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio, T of the elected members concurring: Section 1. That the bid from Gutknecht Construction Company in the amount of $4,048,000 and Bid Alternate #1 in the amount of $34,500 are hereby accepted. Section 2. That the City Manager is hereby authorized and directed to execute a contract with Gutknecht Construction Company for completion of said project pursuant to the bid specifications and documents on file in the Office of Grounds & Facilities. Section 3. That there be advanced from the Capital Improvements Tax Fund the amount of $2,565,000 to the Swimming Pool Construction Fund, said advance to be reimbursed from proceeds of a future debt issue. Section 4. That there be appropriated from the unappropriated balance in the Swimming Pool Construction Fund the amount of $4,490,000. Section 5. That this ordinance is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety or welfare, and emergency action is necessary in order to initiate the project as soon as possible so that the facility can open in the spring of 2004. Therefore, this ordinance shall take effect upon passage. (~~1 ~ of Council, Dublin, Ohio DECLARATION OF OFFICIAL INTENT For Reimbursement of Expenditures from Bonds/Notes This is a Declaration of Official Intent under Treasury Regulations Section 1.103-18. 1. The City of Dublin (the City) declares that it reasonably expects that the capital expenditures described in Item #2 will be reimbursed with the proceeds of bonds, notes, certificates, or obligations under a financing lease, installment purchase or loan agreement, representing a borrowing by the City in the maximum principal amount, for such reimbursements, of $2,565,000. 2. The capital expenditures to be reimbursed are for community recreation facilities. The specific project is the construction of a new outdoor swimming pool facility in the southwest area of the City. 3. This Declaration of Official Intent is consistent with the budgetary and financial circumstances of the City of this Declaration, in that no money (including the money advanced to make the expenditures that are to be reimbursed) is, or is reasonably, allocated on a long-term basis, or otherwise set aside by the City or any other entity, with respect to the expenditures described in Item #2. 4. Within 30 days from this date this Declaration of Official Intent shall be made available as a public record subject to inspection by the general public or at the main administrative office of the Issuer for reasonable public inspection during all normal business hours. This project is an approved Capital Improvement Program. The publicly announced base bid was estimated at $4,700,000.00. Six (6) bids were received. Base Bid Bid Alter. #1 1) APEX/M&P $4,349,585.00 $38,700.00 2) Thomas Marker Construction Company $4,058,700.00 $43,000.00 3) Gutknecht Construction Co. $4,048,000.00 $34,500.00 4) Miles McClellen $4,427,000.00 $38,536.00 5) Wayne Builders Co., Ltd $4,600,000.00 $50,000.00 6) Contrak Corporation $4,693,000.00 $39,356.00 This project consists of the construction of two pools, bathhouse/offices, mechanical building, concession stand, parking lots, retention basins, associated site work and landscaping. The one bid alternate consists of the construction of a small restroom attached to the concession building. Park users could utilize this structure without needing to enter the pool area. RECOMMENDATION: Staff is recommending adoption of Ordinance no. 41-03, accepting Gutknecht Construction Co.'s base bid of $4,048,000.00 and bid alternate #1 for $34,500.00. Gutknecht Construction has done previous work for the City of Dublin including, most recently, the construction of the new Service Center and previously the construction of the Earlington Pool.
