Form No. 30043 Ordinance No. 50-04 Passed 20 AN ORDINANCE TO ACCEPT AN ANNEXATION OF 12.3 ACRES, MORE OR LESS, IN WASHINGTON TOWNSHIP, FRANKLIN COUNTY TO THE CITY OF DUBLIN WHEREAS, on April 7, 2004 the Franklin County Commissioners approved the Regular annexation petition for 12.3 acres, more or less, from Washington Township, Franklin County to the City of Dublin, as filed on February 2, 2004 by Paul V. Pavlic, Agent for Petitioners Anthony Gioffre and John Gioffre, 6262 Eiterman Road, Dublin, OH 43016 ;and WHEREAS, the area proposed for annexation lies within Dublin's exclusive water and sewer service extension area, as provided under the agreements with the City of Columbus; and WHEREAS, the proposed annexation is in conformance with the annexation strategy contained in the Dublin Community Plan, adopted by Council on November 17, 1997. NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. That the petition for the annexation of 12.3 acres (see attached legal description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted. Section 2. Cox, P.E., Assistant Director of Engineering -Development Re: Ordinance 50-04 -Accepting an Annexation of 12.3 Acres, More or Less, in WashittQton Township, Franklin County to the City of Dublin Summary: This proposed annexation is for 12.3 acres, more or less, including 8.0 acres of developed property (Anthony and John Gioffre) and 4.3 acres ofright-of--way for Eiterman Road (see attached annexation plat). Per the Ohio Revised Code regarding annexations, the City of Dublin was required to provide a resolution stating what services the municipality will provide. Council passed Resolution 09-04 on February 17, 2004, and a copy is attached for reference. The Resolution was forwarded to the Franklin County Commissioners for their hearing on the annexation of the 12.3 acres. The hearing took place on Apri17, 2004, and the Commissioners approved the annexation with Resolution 290-04. A copy of Resolution 290-04 is attached for reference. Per Ohio Revised Code regarding a regular annexation, the City shall accept or reject the annexation petition by ordinance or resolution within 120 days after receipt of the record of the County's proceedings. If approved by Council at the second reading on August 16, 2004, Ordinance 50-04 will be effective thirty days after passage, and the property will be incorporated into the City of Dublin. Recommendation: This property is located within the exclusive Dublin service area as defined in the water and sewer agreements with the City of Columbus. Staff recommends approval of Ordinance 50-04 accepting the annexation of 12.3 acres, more or less, in Washington Township, Franklin County, to the City of Dublin. Pavlic, Agent for Petitioners Anthony Gioffre and John Gioffre, 6262 Eiterman Road, Dublin, Ohio 43016; and WHEREAS a public hearing has been scheduled before the Franklin County Commissioners on Wednesday, Apri17, 2004 at 10:00 a.m.; and WHEREAS, Section 709.023 of the Ohio Revised Code requires that, prior to the hearing ~ of the annexation petition, the Municipal Authority shall adopt a statement indicating what services, if any, the Municipal Corporation will provide to the territory proposed for annexation; and WHEREAS, the area proposed for annexation lies within Dublin's exclusive water and sewer service extension area, as provided under the agreements with the City of i Columbus; and R"" ~'I WHEREAS, the proposed annexation is in conformance with the annexation strategy i I' contained in the Dublin Community Plan, adopted by Council on November 17, 1997. The City of Dublin will provide the following municipal services for the N' ~ 8.0+/- acres in Washington Township, Franklin County upon the annexation of the area to c a y ~ the City of Dublin, Ohio: ~ ~ I Police. The City provides Police and Communications service on a twenty-four hour basis and also has mutual aid agreements with other municipalities. The annexation area • ~ . ' ( lies approximately three miles southwest of Dublin's P olice D ivision H eadquarters. Dublin operates with a minimum of four cruisers on duty. A response time of ~ ~ ~ approximately six minutes for an emergency situation should be expected for this area. 4 "o m ~ n a- o ~ Fire. Fire and emergency medical services protection is currently provided by a well- ' staffed department in Washington township. They, too, have mutual aid agreements with ~ ° o other municipalities and townships. This annexation would not change fire department jurisdictional boundaries, and therefore response times for fire and emergency medical m d I services will not be affected. The Washington Township Fire Station #91 is located approximately 1-1/2 miles east ofthe annexation area, and normal response time should ~ be approximately three minutes. I Sanitation. Residential refuse collection services are contracted by the City and are currently provided at no additional charge. Street Maintenance. The City's Streets and Utilities Division provides excellent service in the area of street and road maintenance. ~I i Section 2. The City has sewer and water service area contracts with the City of Columbus, and the subject property is within the service areas. The Petition meets all the requirements set forth in, and was filed in the manner provided in, Section 709.02 of the Revised Code. 2. The persons who signed the petition are owners of real estate located in the territory proposed to be annexed in the petition, and, as of the time the petition was filed with the Board of County Commissioners, the number of valid signatures on the petition constituted a majority of the owners of real estate in that territory. 3. The municipal corporation to which the territory is proposed to be annexed has complied with Division (D) of Section 709.03 of the Revised Code. The territory proposed to be annexed is not unreasonably large. W.r - 5. On balance, the general good of the territory proposed to be annexed will be served, and the benefits to the territory proposed to be annexed and the surrounding area wilt outweigh the detriments to the territory proposed to be annexed and the surrounding area, if the annexation petition is granted. As used in Division (A) (5) of this section, "surrounding area" means the territory within the unincorporated area of any township located one-half mile or less from any of the territory proposed to be annexed. 6. No street or highway will be divided or segmented by the boundary line between a township and the municipal corporation as to create a road maintenance problem, or, if a street or highway will be so divided or segmented, the municipal corporation has agreed, as a condition of the annexation, that it will assume the maintenance of that street or highway. For the purposes of this division, "street" or "highway" has the same meaning as in Section 4511.01 of the Revised Code. 7. The municipal corporation to which annexation is proposed has agreed to provide to the territory proposed for annexation the services specified in the relevant service ordinance #9-04 passed on February 17, 2004 by the Dublin City Council.
