Form No. 30043 Ordinance No. 30'04 Passed , 20 AN ORDINANCE WAIVING COMPETITIVE BIDDING REQUIREMENTS, PURSUANT TO SECTION 8.04 (`CONTRACTING PROCEDURES'), PARAGRAPH (C) ("WAIVER OF COMPETITIVE BIDDING") FOR ALCOHOLIC BEVERAGES, SOFT DRINKS AND BOTTLED WATER FOR . THE DUBLIN IRISH FESTIVAL WHEREAS, Section 8.04(c) of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) members, to waive competitive bidding requirements if Council determines that it is in the best interest of the City to do so; and WHEREAS, Killian's Irish Red and Pepsi-Cola Bottling Company have served as sponsors for the Dublin Irish Festival over the past several years, contributing a substantial amount of financial and promotional support to the Festival; and WHEREAS, Coors is the parent company of Killian's Irish Red, and Central Beverage Group of Columbus is the sole distributor for Killian's Irish Red and Coors products in Central Ohio; Pepsi-Cola Bottling Company is the sole distributor of Pepsi-Cola products; and WHEREAS, it has been recommended by staff that it would be in the City's best interest to waive competitive bidding requirements to designate the Central Beverage Group as the provider of Killian's Irish Red and Coors products and the Pepsi-Cola Bottling Company as the provider of Pepsi-Cola products and bottled water at the 2004 Dublin Irish Festival due to the financial and marketing benefits this sponsorship provides to the Festival and the City, NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. That Central Beverage Group of Columbus is hereby designated as the provider for Killian's Irish Red and Coors beer products and that the Pepsi-Cola Bottling Company is hereby designated as the provider for soft drinks and bottled water for the 2004 Dublin Irish Festival. Section 2. That competitive bidding requirements are hereby waived for these purchases, as it has been determined to be in the City's best interest to do so. Section 3. Hoyle, Director of Fiscal Administration Re: Ordinance No. 30-04 Waiving Competitive Bidding Requirements for the Purchase of Alcoholic Beverages, Soft Drinks and Bottled Water for 2004 Dublin Irish Festival Summary: Attached for your consideration please find Ordinance 30-04 waiving competitive bidding requirements for the procurement of alcoholic beverages, soft drinks and bottled water for the 2004 Dublin Irish Festival. (Section 8.04 (c) of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) members, to waive competitive bidding requirements if it determines that such waiver is in the best interest of the City.) This year, as in years past, the alcohol (beer) sponsor for the Dublin Irish Festival is Killian's Irish Red and the sponsor for soft drinks and bottled water is the Pepsi-Cola Bottling Company. In exchange for the sponsorship dollars and advertising support provided by Killian's and the Pepsi-Cola Bottling Company, the Festival serves only products offered by Coors, the parent company of Killian's Irish Red and the Pepsi-Cola Bottling Company. Expenditures for the purchase of alcohol (beer) for the 2004 Festival are estimated at $65,000 and the expenditures for the purchase of soft drinks and bottled water are $38,000. The 2004 Operating Budget has authorized appropriate funding for these purchases. Recommendation: Staff recommends Council adopt Ordinance No.30-04 waiving competitive bidding requirements for the purchase of Alcoholic Beverages, Soft Drinks and Bottled Water for the 2004 Dublin Irish Festival.
