AN ORDINANCE ACCEPTING THE LOWEST AND BEST
BID FOR THE LANDSCAPE MAINTENANCE NORTH
AND LANDSCAPE MAINTENANCE SOUTH PROJECTS,
AND DECLARING AN EMERGENCY
WHEREAS, after advertising and receiving bids on January 19, 2005 for the Landscape
Maintenance North and Landscape Maintenance South Projects, Council has determined
that the base bid submitted by TruGreen Chemlawn in the amount of $49,230.00 (North)
and $68,345.00 (South) for a total amount of $117,575.00 is the lowest and best bid for
the project; and
WHEREAS, this project was an approved 2005 CIP project; and
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, ,~~ of the elected members concurring:
Section 1. That the base bid submitted by TruGreen Chemlawn in the amount of
$49,230.00 (North) and $68,345.00 (South) for a total amount of $117,575.00 for the
Landscape Maintenance North and Landscape Maintenance South Projects is hereby
accepted.
Section 2. That the City Manager is hereby authorized to enter into a contract for the
project as listed above, and as specified within the bid proposal and the City's bid
documents on file with the Director of Parks and Open Space.
Section 3. That this Ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public peace, health, safety or welfare, and therefore shall
be effective upon passage.

SUMMARY:
On Wednesday, January 19, 2005 bids were opened for the Landscape Maintenance North
and Landscape Maintenance South Projects. The total budgeted amount for both projects is
$137,776.00, which is included in the 2005 Operating Budget.
Three (3) bids were received for each project:
1). Environmental Management Services
2). Peabody Landscape Construction
3). TruGreen Chemlawn

This project consists of weeding, mulching, bed edging, spraying pre-emergent and plant
maintenance for right of ways, medians and green spaces throughout the City of Dublin.
There have been problems in previous years with contractor's adherence to the terms of the
maintenance contract. Staff' is optimistic this years contract compliance will be better achieved.
This is based upon several factors including: 1) a pre-bid meeting that emphasized staffs
resolve to effectively and tenaciously administer the terms of the contract 2) strengthening of
contract language that includes the owners right to do work in overtime status with the
accompanying premium pay deducted from invoices 3) the recommended contractor's
familiarity with the land masses included in the contract and 4) staff being better prepared
internally to oversee contract compliance.
RECOMMENDATION:
Staff is recommending adoption of Ordinance no. 09-05, accepting TruGreen Chemlawn's base
bids in the amount of $49,230.00 (North) and $68,345.00 (South).
The bid results show a measurable difference of costs between the three (3) bidders with only
TruGreen Chemlawn being in line with the budget. TruCrreen has assured us they are confident
in their bid and will comply with all the terms of the contract.
