07-04 OrdinanceRECORD OF ORDINANCES inc Ordinance No. 07-04 Passed 2~ AN ORDINANCE TO AMEND CHAPTER 151: FLOOD CONTROL, OF THE DUBLIN CODIFIED ORDINANCES REGULATING THE BASIS FOR ESTABLISHING THE AREA OF FLOOD HAZARD AND DECLARING AN EMERGENCY WHEREAS, the provisions of Chapter 151: Flood Control of the City of Dublin Codified Ordinances minimize public and private losses due to flood conditions in specific areas; and WHEREAS, revised flood elevation data recently evaluated by the Federal Emergency Management Agency (FEMA) will become effective March 16, 2004; and WHEREAS, FEMA and the Ohio Department of Natural Resources (ODNR) require that legislation adopting these changes be enacted prior to March 16, 2004; and WHEREAS, the City of Dublin's continued participation in the National Flood Insurance Program is contingent upon enactment of legislation that adopts revised flood elevation data. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: SECTION 1. That Section 151.04 BASIS FOR ESTABLISHING THE AREA OF FLOOD HAZARD and Section 151.21 (D) be repealed in its entirety and replaced as follows: 151.04 BASIS FOR ESTABLISHING THE AREA OF FLOOD HAZARD The areas of special flood hazard have been identified by the Federal Emergency Management Agency in scientific and engineering reports entitled "Flood Insurance Study for Franklin County, Ohio and Incorporated Areas", dated March 16, 2004, "Flood Insurance Study for Delaware County, Ohio and Incorporated Areas", dated April 21, 1999 and "Flood Insurance Study for Union County, Ohio and Incorporated Areas", dated September 27, 1991. These studies with accompanying Flood Insurance Rate Maps and any revisions thereto are hereby adopted by reference and declared to be a part of this Chapter. The Flood Insurance Studies are on file at the Office of the City Engineer. 151.21 D (D) Manufactured homes and recreational vehicles. The following standards shall apply to all new and substantially improved manufactured homes not subject to the manufactured requirements of R.C. § 3733.01, and recreational vehicles. (1) Manufactured homes shall be anchored in accordance with § 151.20(A)(2). (2) Manufactured homes shall be elevated on a permanent foundation such that the lowest floor of the manufactured home is at the base flood elevation. (3) Recreational vehicles shall: (a) not be located on sites in special flood hazard areas more than 180 days, or (b) be licensed and ready for highway use, or (c) meet the standards of § 151.22(D)(1) and (2). Hammersmith, P.E., Director of Engineering/City Engineer ~ Jay Herskowitz, P.E., Assistant Director of Engineering - Utilities`~~ Re: Ordinance to Amend Chapter 151: Flood Control Ordinance Number 07-04 Summary: Federal Emergency Management Agency (FEMA) and Ohio Department o f Natural Resource (ODNR) rules require that Chapter 151: Flood Control of the City of Dublin Codified Ordinances be revised to reflect the effective dates of the most current flood plain studies. Additionally, ODNR recommends that minor changes be made in Section 151.22(D) of Dublin's present flood control ordinance to establish language more consistent with National Flood Insurance Program Standards. The attached Ordinance for Council consideration amends Chapter 151: Flood Control accordingly. Recently, FEMA approved a flood plain study prepared by the consultant firm of Bauer Davidson and Merchant on behalf of Bob Webb Builders, Inc. As a result of this study, FEMA will issue new Flood Insurance Rate Maps (FIRM) for Franklin County, effective March 16, 2004, reflecting new 100-year base flood elevations along the entire course of the North Fork Indian Run and at several points along the South Fork Indian Run. Study results were generated using better topography data than that previously used to study this area. The new FIRMs will be published in auuer-friendly format that takes advantage of recent aerial photography depicting current street name and building location information. The new data format will help facilitate decision-making relative to flood plain determinations. In general, study results show that flooded areas as reflected by 100-year floodwater elevations lie farther away from buildings. FEMA will supply printed copies of the new FIRMS for Franklin County to our attention once ODNR review of this adopted Ordinance is completed. It should be noted that the FIRM effective dates of September 27, 1991 for Union County and Apri121, 1999 for Deleware County are still in effect as areas covered by these studies were not affected by the North Fork Indian Run study. Recommendation: Staff recommends this Ordinance amending Chapter 151: Flood Control of the City of Dublin Codified Ordinances be adopted by Council. Emergency action upon adoption is requested to allow the required FEMA and ODNR review prior to the March 16, 2004 FIRM effective date. RECORD OF ORDINANCES Blank, Inc. That this Ordinance be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health, welfare and safety of the citizens of Dublin by enabling Dublin to continue to participate in the National Flood Insurance Program and, therefore, this Ordinance shall take effect and be in full force immediately upon its passage.
