AN ORDINANCE TO ACCEPT THE LOWEST/
BEST BID FOR THE AVERY ROAD AND BRAND ROAD
LANDSCAPE IMPROVEMENTS PROJECT,
AND DECLARING AN EMERGENCY
WHEREAS, after advertising, receiving and opening ten bids on December 13, 2002
for the Avery Road and Brand Road Landscape Improvements project; and
WHEREAS, Council has determined that the lowest and best bid for said project is
from EarthCo Inc. in the amount of $48,365.20;
WHEREAS, this project is an approved Capital Improvement project; and
WHEREAS, it is necessary to amend the annual appropriations measure to provide
funding authorization for the project,
NOW THEREFORE BE IT ORDAINED by the Council of the City of Dublin,
Ohio, ~_ of the elected members concurring:
Section 1. That the bid from EarthCo, Inc. in the amount of $48,365.20 be, and
hereby is, accepted.
Section 2. That the City Manager is hereby authorized and directed to execute a
contract with EarthCo Inc. for completion of said project pursuant to the bid
specifications and documents on file in the office of the City Engineer.
Section 3. That there be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the amount of $50,800 to account number 401-0314-780-
2550 for the project.
Section 4. That this Ordinance is declared to be an emergency measure necessary for
the immediate preservation of the public peace, health, safety or welfare, and therefore
shall be effective upon passage.

Summary
On December 13, 2002 ten bids were received and publicly opened and read for the Avery Road
and Brand Road Landscape Improvements project. All bids have been reviewed.
Recommendation
I recommend this contract be awarded to Earthco, Inc., the lowest and best bidder. Earthco, Inc.'s
bid was $48,365.20. The Engineer's estimate for this project is $120,000. The anticipated
completion date is May 28, 2003.
Attached is an ordinance for approval by City Council prior to awarding the contract to Earthco, Inc.
