Schulze, 110 S. Main Street, P.O. Box 562, Marysville, OH 43040, Agent for Petitioners Anna James; Jon Shoemaker; Leslie H. and Mary S. Gates; Shirley Gates, Trustee; Robert Gates; Shirley Gates, Herbert Hoffinan, Trustee; and Shirley Bergemann; and WHEREAS, Council is of the opinion that this territory should be annexed to the City of Dublin. Corey Colombo DATE: May 20, 2002 RE: Ordinance 71-02, and impact of new annexation law On October 18, 2001, petitioners filed a petition for the annexation of 215.65 +/- acres in Jerome Township, Union County to the City of Dublin. On October 26, 2001, petitioners filed an amended petition for the annexation of 220.522 +/- acres. On February 14, 2002, the amended annexation petition was approved by the Union County Commissioners. Senate Bi115, the Ohio General Assembly's re-write of the state's annexation laws, was to have taken effect on October 26, 2001. As you are aware, the new law met resistance from municipalities throughout the state, and areferendum-petition was filed on October 25, 2001. On March 27, 2002, the Ohio Secretary of State ruled that the referendum-petitioners failed to gather enough signatures. Since then, county prosecutors throughout the state have offered opinions to their respective county commissioners regarding the effective date of the new annexation law. This office was able to obtain a copy of an opinion drafted by Union County ~ Prosecutor Alison Boggs, which was released on May 10, 2002. A copy of this opinion is attached to this memorandum for your reference. This opinion was released in response to ;v,~4vsze.~Qm another Dublin-sponsored annexation petition for 1.319 acres of land. In that instance, the Commissioners approved the petition pursuant to the new law due to its April 17, 2002 filing Columbus date. Essentially, Ms. Boggs opined that the Commissioners should follow the old law for Cleveland petitions filed before October 26, 2001, the Commissioners should follow the new law for Cincinnati petitions filed after March 26, 2002, and Commissioners will have to decide which law they want to follow for petitions filed between October 26, 2001 and March 26, 2002. {tiol99716.1 }The Huntington Center, 41 South High Street, Suite 2600, Columbus, Ohio 43215-6106 . voice 6141462-2700. fax 614!462-5135 SCHOTTENSTEIN ZOX & DUNN a legal professional association As to annexation petition for 220.522 acres, this office takes the position that the Commissioners approved it pursuant to the old law as the initial petition was filed on October 18, 2001 (prior to October 26, 2002). Additionally, the Commissioners approved the petition on February 14, 2002, which was during the period that the referendum petition was pending. This office has conducted a through review of the new annexation law. It should be stressed that the new annexation law has left many details unclear. As a result, future litigation maybe necessary to clarify what was intended by the Ohio General Assembly in the passage of Senate Bill 5. There was not any legislative history lending meaning to several of the provisions. For example, the new law does not discuss the post annexation application of boundary adjustments as they relate to situations in which the land is brought into another township as well as many other issues. The new law does not specify whether the reimbursement to the former underlying township must be made for ALL future boundary adjustments or just the ones where annexation occurred after the new annexation law took effect. On these previously mentioned issues, this office takes the position that the City is justified in arguing that the City is not responsible for reimbursing the former underlying townships for any land that was annexed into the City pursuant to petitions that were filed before the new law took effect. The Board of County Commissioners who may take the alternative viewpoint is also the political entity responsible for approving the boundary adjustments. Additionally, in the instance of Union County, the County Commissioners have indicated they will not consider boundary adjustment petitions until the Ohio Attorney General issues an opinion to answer some of their unresolved questions regarding the boundary adjustment process. This office has maintained regular contact with the Attorney General's Office, and they decline to specify when an opinion will be issued. This office will continue to provide monthly or bi-monthly updates of any developments pertaining to Senate Bill 5, any potential litigation or clarification of the meaning of its provisions, and the status of the Attorney General's Opinion. A response time of approximately 3 minutes for an emergency situation should be expected for this area. Fire. Fire and emergency medical services protection is currently provided by well-staffed departments in Jerome and Washington townships. They, too, have mutual aid agreements with other jurisdictions. This annexation would not change fire department jurisdictional boundaries, and therefore response times for fire and emergency medical services will not be affected. The Jerome Township Fire Station is located approximately 2 miles from the annexation area, and normal response time would be approximately 3 minutes. However, due to an existing automatic response agreement, the area is also served by the Washington Township Fire Station 93 which is located approximately 2 miles to the southeast, and normal response time would be approximately 3 minutes.
