129-02 ORDINANCE AMENDED RECORD OF ORDINANCES Dayton Legal Blank Co Form Na. 30043 129-02 (Amended) Ordinance No Passed AN ORDINANCE AMENDING CHAPTER 35 OF THE CODIFIED ORDINANCES TO REVISE THE FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND ESTABLISHING A SCHEDULE OF FEES AND SERVICE CHARGES FOR CITY OF DUBLIN SERVICES WHEREAS, the City of Dublin, Ohio has conducted an extensive analysis of its services, the full costs of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for the services; and, WHEREAS, based on this extensive analysis, a cost analysis document, dated October 2002, has been prepared; and, WHEREAS, the Finance Committee of City Council has held a public workshop to review the Cost analysis document, including percentage of recovery and the specific fees to be charged; and, WHEREAS, the specific fees to be charged for City provided services must be adopted by the City Council. NOW~REFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, members of the elected officials concurring: Section 1. Chapter 35 of the Codified Ordinance of Dublin, Ohio is hereby amended to read as follows: Chapter 35 FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND FEES Section 35.80 "Full Costs" Defined For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning. "Full Costs" includes the following elements: (1) All applicable direct costs including, but not limited to salaries, wages, overtime, employee fringe benefits, services and supplies, maintenance and operating expenses, contracted services, special supplies, and any other direct expense incurred. (2) All applicable indirect costs including, but not restricted to, building maintenance and operations, equipment maintenance and operations, communications expenses, computer costs, printing and reproduction, vehicle expenses, insurance, debt service, and like expenses when distributed on an accounted and documented rational pro-ration system. (3) Fixed asset recovery expenses, consisting of depreciation of fixed assets, divided by the approximate life expectancy of the fixed asset. (4) General overhead, expressed as a percentage, distributing and charging the expenses of the City Council, including the Clerk of Council, Department of Law, City Manager, Division of Accounting and Auditing, Division of Taxation, Information Technology, Economic Development, the Division of Human Resources and Procurement, and City promotional programs, and all other staff and support service provided to the entire City organization. Overhead shall be prorated between tax-financed services and fee-financed services on the basis of said percentage so that each tax-financed service and fee-financed service shall proportionately defray such overhead costs. (5) Departmental overhead, expressed as a percentage, distributing and charging the cost of each department head and his or her supporting expenses as identified in subsections 1, 2, 3, and 6 of this Section. (6) Debt service costs, including the payment of interest, and trustee fees and administrative expenses of all applicable bond, certificate, or securities issues or loans of whatever nature or kind. (7) The "full costs," in most instances, will be rounded to the nearest ten dollars, with the actual fee established by the ordinance establishing a schedule of fees and charges for City services. (Continued) Section 35.81 Findings and Intent (a) It is the intent of the City Council to ascertain and recover the specified percentages of full costs from fees, charges, and regulatory license fees levied in providing the regulation, products, or services set forth in this Chapter. (b) The fee and service charge revenue/cost comparison system set forth in this Chapter provides a mechanism for ensuring that fees adopted by the City for services rendered do not exceed the reasonable estimated cost for providing the services. (c) It is the intent of the City Council to achieve a more equitable and fair mix for financing services set forth in this Chapter in order to reduce or eliminate subsidizing these services with general tax revenue; thereby, allowing those general tax revenues to be used for general services, including infrastructure maintenance and replacement. Section 35 82 Dele>?ation of Authority and Direction to the City Manager (a) The City Manager is hereby delegated the authority and directed to provide documents to the City Council to implement its policy to adjust fees and charges to recover the percentage of full costs as established in this Chapter. (b) The City Manager is hereby delegated authority to issue Orders defining terms, setting out administrative, fee collection, and financial procedures, definitions, and establishing effective dates of all fees set by the City Council by Ordinance. All Orders shall be signed by the affected department head, shall be signed by the Director of Finance certifying the financial requirements of this Chapter have been met, and shall be signed by the City Manager specifying the effective date of the Order. (c) "Full costs" shall be as defined in Section 35.80. In adjusting fees and charges, the City Manager shall act in an administrative and ministerial capacity and shall consider only the standards and criteria established by this Chapter and the applicable State laws. All Orders issued shall comply in all respects with this Chapter, and the schedule of fees and rates as set by the City Council. Section 35.83 Schedule of Fees and Service Char>;es (a) The City Manager, Director of Finance, and each City department head, under the direction of the City Manager, shall review annually the fees and service charges listed in Appendix A- Schedule of Fees and Service Charges, and provide an adjusted fee or charge schedule to the City Council for its consideration so as to recover the listed percentage of full costs necessary to provide the listed regulation, product or service as modified by the "notes" following the list of services. These fees, unless otherwise specified, are for City of Dublin services and are in addition to any charges made by any other governmental agencies. (b) The services as listed in this Section shall be as defined in the document entitled "Cost Study for the City of Dublin, Ohio" dated October 2002, as produced by the City of Dublin. (c) All fees and charges set pursuant to this Chapter and Section shall take effect as specified in each Order. (d) The City Manager may vary the review schedule listed in the Section if, in the judgement of the City Manager and a directly affected and requesting department head, a gross inequity would be perpetrated by not revising a fee or charge prior to the next rate review. Any such special rate review shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. (e) If fees are not collected at the time that the service is provided, the City has the right to pursue collection of any of the fees listed in this Ordinance, including certification to the County Auditor, remittance to a collection service, or any other appropriate pursuit for payment. 2 RECORD OF ORDINANCES Dayton Legal Blank Co Form No. 30043 129-02 (Amended) Ordinance No Passed Section 1. (Continued) Section 35.83 Schedule of Fees and Service Charges (Continued) (f) Should it become necessary to establish a new service fee or charge during the year, the City Manager may set the fee administratively. Any such fees set by the City Manager shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. The new service will then be included and analyzed °e in the next rate review. Section 35.84 Fee Appeals and Waivers Irrespective of the percentage of recovery and the "notes" in Section 35.83 -Appendix A, the City Council reserves the right to waive any fee in order to encourage development projects that enhance the City's tax base as outlined in the City's Economic Development Strategy. The City Manager may recommend further waivers or fee adjustments, based on hardship, to be accepted or rejected by City Council at its next regularly scheduled meeting. Section 2. SEVERABILITY If any portion of this Chapter is found to be unconstitutional or invalid the City Council hereby declares that it would have enacted the remainder of this Chapter regardless of the absence of any such invalid part. Section 3. REPEALER All Ordinances, the Codified Ordinances of Dublin, Resolutions, City Council Motions, and all actions of all City Boards and Commissions in conflict here within are hereby repealed. The fees and charges established by this Chapter shall supersede all previously established fees or charges for the same regulation, product or service, and all such previous fees and kr charges are hereby repealed on the effective date of the Order of the City Manager. Section 4. EFFECTIVE DATE That this Ordinance shall take effect and be in force on the earliest date permitted by law. Grigsby, Assistant City Manager/Director of Finance ' Melody Kennedy, Financial Analyst ~`f`'i~ Re: Ordinance #129-02 (Amended) Revising the Schedule of Fees and Service Charges for City of Dublin Services Summary' Attached is the amended Ordinance #129-02, regarding the annual update to the City's schedule of fees and service charges. These fees will become effective on January 1, 2003. The Ordinance has been amended to reflect the recommendations made by the Finance Committee during its October 28, 2002 meeting. Detailed recap worksheets with results from that meeting are attached for review. The following is a summary of notable changes, comments, and/or questions raised by the Finance Committee pursuant to its review: Division of Building Standards 5-039 & 5-040 Minor & Major Building Revisions -Commercial The Committee asked the Chief Building Official (CBO) to define what constitutes a minor commercial building revision versus a major commercial building revision. A memo is attached from the CBO with regard to this. These definitions will be added to the detailed Cost Study binder for the next review. S-149 Building Plan Revision -Residential The CBO spoke about the volume of residential revisions his Division receives as well as an approximate 40% rejection rate for non-compliance. To discourage premature submittal of plans, the CBO suggested implementing a prohibitive fee. The Committee approved the CBO's recommendation. The Ordinance has been amended to reflect a $20 administrative fee, plus $50 fee for each Division (Building, Planning, Engineering) reviewing the plans. 5-152 Special Inspection -Gas Line Permit This is a new inspection fee. Previously, Columbia Gas completed these inspections, but has discontinued this service. This involves permitting and inspecting natural gas lines in residential and commercial structures to insure compliance of work with applicable codes. The Committee agreed this was a service that needed to be performed by the City, but requested additional information with regard to legal liability. The City's Legal Counsel has been contacted, and when we receive their response, it will be forwarded to City Council. Members of City Council Page -2- Division of Building Standards (continued) 5-153 Homeowner Improvements This category encompasses deck and small accessory buildings, remodels and basement finishes. The Committee felt it was important to encourage residents to apply for these permits and not be discouraged by a higher fee. They approved a decrease in the fee to a flat $50. The Ordinance has been amended to reflect this change. Division of Court Services S-077 Fine Processing It was felt that an increase in fees was warranted for court services. The Director of Court Services suggested increasing the fine processing fee rather than increasing the court service fee. The Committee approved a $2 increase in the fine processing fee. The Ordinance has been changed to reflect the $12 fee. Division of Recreation Services 5-089 Ball~eld Rental The Committee discussed the DYA and DSL programs, and how they benefit the residents of the City. The issue of oversight authority, and fees charged by these groups was raised. The Committee asked Staff to research fees charged by these groups and report back to them at a later time. The Committee also felt it would be beneficial to have aone-page fact sheet for Council Members documenting the history of these groups and the City's involvement with them. Staff will complete this research and report back to City Council. 5-172 Theater Rental The Committee discussed the rental policy for those groups falling under the umbrella organization of the Dublin Arts Council. These groups, such as the Emerald City Players, are currently not paying rent for their use of the Theater. However, they pay technician fees during certain times, as well as a collection fee if the City administers the sale of their performance tickets. The Division of Recreation Services reports that for the year 2002, the Emerald City Players have requested four performances in the Theater, taking two to three weeks of Theater space for each of those performances. Staff also reported the Emerald City Players rented a portion of the Community Hall several times during the year for dessert theater. This involved a Friday and Saturday night performance where food and beverages were served. To guarantee the space, the Emerald City Players were asked to pay rental fees (not-for- profit) covering the period of time their equipment was in the space. Since this is a rentable venue, the group was asked to remove their equipment when the space was rented to others. Space was provided by the DCRC for their equipment. Theater, Community Hall, and Upstairs Meeting Room Rentals and Usage The Committee asked Staff to provide them with a breakout of usage for the theater, community hall, and upstairs meeting rooms. Staff reports for 2001 are attached for review. The Committee also requested that Staff initiate a newspaper article or other forum to provide residents with information about City meeting spaces available without charge. The Department of Finance Staff will work with the appropriate individuals to determine the spaces available to the public without fees and publish them for community awareness. Members of City Council Page -3- Division of Recreation Services (continued) Theater Community Hall and Upstairs Meeting Room Rentals and Usage (continued) Open Gym There was a brief discussion about a complaint that birthday parties were being held in the gymnasium at the DCRC and thus disrupting open gym. Recreation Staff reported that birthday parties are not held in the gym. The incident in question was a fifth grade year-end school party held in half of the gymnasium. Notification (via signage) was postal that the party would be held in the gym, and half the gym was still provided for open play. There was a heated discussion between the DCRC Manager on Duty, and one of the open gym participants when it was realized that both sides of the gym would not be available as usual. According to the Director of Recreation, the gentleman later called and apologized for the incident. Parks & Recreation Advisory Commission (PRAC) Recommendation During the February 20, 2002 meeting of PRAC, a recommendation was made to ask the Finance Committee to review the possibility of a "military recognition" event in which members of the military and their families would be permitted free use of the DCRC for one designated weekend per year. The Finance Committee thanked PRAC for bringing this recommendation forward to them for review, but preferred that a military group bring a request to the Committee if certain recognition was desired. Subsequently, no changes were made with regard to this issue in the Ordinance. Division of Streets & Utilities 5-145 Fire Hydrant Permit A general question was raised with regard to this service and what it means to "pump the hydrant." According to the Division of Streets & Utilities, every time a hydrant is used (usually by a contractor), the permit-holder must flush/pump the water from the barrel before they close the hydrant. Crews from Streets & Utilities check the hydrants after the duration of each permit to verify the hydrant has been properly pumped and closed. If the hydrant isn't in compliance and the City's crew has to pump the hydrant, the contractor is charged the permit fee again. Streets & Utilities reported that it is essential to check the hydrants this time of year so that water is not left in the barrels to freeze, which would render the hydrant unusable in the event of an emergency. Division of CommunitXRelations 5-109 Service to Special Events The Committee discussed Staff's participation in special events and stated that some concerns had been expressed by event sponsors with regard to the number of Police Officers present at most events. Prior to each event, representatives from the various affected City Divisions meet with the event sponsors to review what City services will be needed. Staffing levels are reviewed and evaluated based on each individual event. Recommendation: Staff recommends approval of Ordinance 129-04 during the November 4, 2002 City Council Meeting. Information on pending items will be distributed to City Council at a later date.
