Smith, agent for Petitioners Dublin City School District and the City of Dublin; and WHEREAS, Council is of the opinion that this territory should be annexed to the City of Dublin. NOW, THEREFORE,~E IT ORDAINED, by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. That the petition for the annexation of 2.697+/- acres (see attached legal description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted. Section 2. Corey Colombo DATE: September 16, 2002 RE: Ordinance 123-02 (Accepting Annexation of 2.697 acres) On June 5, 2002, the Franklin County Commissioners approved the city-sponsored annexation of 2.697+/- acres from Washington Township (Franklin County) to the City of Dublin. This land is a portion of roadway, which is located in front of the new City Service Complex at 6665 Shier-Rings Road. This roadway is owned by three landowners: the City of Dublin, the Dublin City School District, and the Alvin Rings family. Authorized officials of the City and School District signed the annexation petition. On March 22, 2002, the City filed the annexation petition pursuant to the majority owner method in accordance with the "old" annexation law. As the title of the ordinance indicates, Ordinance 123-02 would be the City's acceptance of the annexation of 2.697+/- acres from Washington Township to the City of Dublin. Corey Colombo DATE: March 13, 2002 RE: Ordinance Authorizing City Manager to Sign Annexation Petition In the upcoming weeks, this office intends to file a petition with the Franklin County Commissioners in order to annex 2.697 acres of Shier-Rings Road into the City of Dublin. This portion of roadway is located in front of the City Service Complex, which is under construction and located at 6665 Shier-Rings Road. The City intends to build a turn lane in this roadway, which will be built to City specifications. This roadway is owned by three landowners: the City of Dublin, the Dublin City School District, and the Alvin Rings family. The attempts to contact the Rings family had been unsuccessful. Therefore, the decision was made to secure the signatures of the City and School District in order to have a majority of the landowners sign the petition. Christopher Mohr, Treasurer and Director of Business Affairs for the School District, has already signed the petition on behalf of the School District. This ordinance would authorize the City Manager to sign the annexation petition on behalf of the City of Dublin. IZings, Jr.; and • ~VIIEREAS, the City will need a majority of landowners under the current Ohio law, therefore requiring two (2) of the three (3) landowners, to sign the petition in order to submit the annexation petition to the Franklin County Commissioners. NO~V, 'I'I IEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. Dublin City Council authorizes the City Manager to sign a petition on behalf of the City to be one of the landowners in an annexation of 2.697 acres, more or less, located on Shier-Rings Road in front of the new service complex. This Ordinance is declared to be an emergency measure for the immediate preservation of the public peace, health, safety or welfare, and for the filrther reason of signing the petition; therefore, this Ordinance shall take effect and be in force immediately upon its passage. So we just submitted it with two out 2 of the three signatures, which would still give us a 3 majority. 4 As Director Nichter mentioned, as this 5 was filed on March 22, it will be according to the 6 old law, according to the Franklin County 7 Prosecutor's opinion; and all the requirements have 8 been met. 9 One of the main purposes for bringing 10 this roadway in, it continues the City's commitment 11 to bring in that roadway. As you'll remember back 12 in February, we brought in another part of 13 Shier-Rings Road running east to west. And in this 14 particular stretch, there is a school district bus 15 complex there, if you'll notice that from the ortho. 16 It's still up there. That's what all those little 17 lines are, buses. 18 Next door to that they're building 19 actually a new City service complex. With that 20 increase in traffic with both the City school 21 district and City maintenance facility, the City had 22 a strong interest in bringing that into the into 23 the City in order to maintain the roadway for police 24 and other services.
