Form No. 30043 Ordinance No. 53-02 Passed 20 An Ordinance to Increase the Dollar Amount of the Furtherance of Justice Fund Maintained by the Dublin Police Department WHEREAS, the City of Dublin Ordinance No. 94-89, passed by Dublin City Council on November 6, 1989, established the Drug Fund, now known as the Furtherance of Justice Fund, to be used in drug enforcement and other undercover activities; and WHEREAS, transactions are initiated which require cash on hand or immediate access to cash to successfully complete, during the course of undercover operations; and WHEREAS, Ordinance 94-89 established the cash balance of the furtherance of Justice Fund at $2,000.00; and WHEREAS, the authorized cash balance is inadequate to support the level of undercover activity being performed by the Division of Police; and WHEREAS, the policies and guidelines to manage and account for the fund have been established by Administrative Order. NOW, THEREF~E BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. The cash balance in the Furtherance Justice Fund be increased to $5,000.00 Section 2. Total annual appropriations from the Furtherance of Justice Fund may not exceed the fund's authorized cash balance. Section 3. The original administrative order establishing policies and guidelines to } manage and account for the fund be amended to reflect the provisions of this Ordinance. Section 4. This Ordinance shall take effect and be in force in accordance with Section 4.04(a) of the Dublin City Charter. Passed this ~~-e't---day of , 2002. Grigsby, Interim City Manager Subject: Ordinance No. 53-02, An Ordinance to Increase the Dollar Amount of the Furtherance of Justice Fund Maintained by the Dublin Police Department Date: April 18, 2002 Initiated by: Mike Epperson, Interim Police Chief During the April 8, 2002 council meeting there was a brief discussion regarding this ordinance and further information as to the purpose of this fund was requested. In general this fund is used for proactive enforcement initiatives aimed at three broad areas: 1) Tobacco audits of our retail establishments 2) Alcohol audits of establishments that sell and or serve alcoholic beverages and 3) Drug investigations designed to target dealers in or near our community. Monies spent out of this fund are generally used for the purchase of the previously mentioned substances as well as to compensate confidential informants. The above listed activities, an accounting system approved by the State of Ohio Auditor, and other policy issues regarding this account are outlined in our accreditation standard 17.4.2. By design, these operations are covert and for that purpose we prefer not to discuss them in a public forum with any more specificity. This fund is used primarily as a source of ready cash, when needed, for "street buys" of controlled substances during undercover investigations. The cash is also used for other undercover activities, such as obtaining information from confidential sources, and transacting purchases of alcohol or tobacco products from business establishments by minors. Given the increase in investigation activity, the $2,000.00 cash balance established in 1989 is inadequate. To properly support the undercover activity the Division of Police will conduct this year, a $3,000.00 increase in the available cash balance is being requested.
