AN ORDINANCE AMENDING THE DUBLIN CODIFIED
ORDINANCES TO PROVIDE FOR AUTOMATIC REZONING
OF ALL NEWLY ANNEXED TOWNSHIP PROPERTY TO
R -RURAL DISTRICT CLASSIFICATION, A "HOLDING"
ZONE CLASSIFICATION, AND DECLARING AN
EMERGENCY
WHEREAS, under Dublin Code Section 153.004(D), territory annexed to the City of Dublin
continues to be governed by the zoning regulations which governed the territory annexed
immediately prior to the annexation, as enacted by a Board of County Commissioners under
R.C. 303.01 to 303.25, or enacted by a Board of Township Trustees under R.C. 519.02
to 519.25, as the case maybe; and
WHEREAS, Section 153.004(D) further states that as soon as practicable after the annexation
of territory to Dublin, proceedings shall be instituted to include the annexed territory in one or
more of the zoning districts defined in the zoning ordinance, as amended; and
WHEREAS, Ordinance No. 46-74, Section 1, provides that all territory annexed to the City
shall be governed by the Dublin zoning regulation that most closely approximates the zoning
regulation classification it was governed by immediately prior to the annexation; and
WHEREAS, these sections have not provided expeditious rezoning in the past; and
WHEREAS, in order to ensure that Township property annexed to Dublin is governed by
Dublin Zoning Code regulations as soon as it is accepted by Dublin, Council proposes the
automatic rezoning of all Township property to the Dublin R -Rural District as soon as such
property is accepted by Dublin;
NOW, WHEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring:
Section 1. Dublin Codified Ordinances Section 153.004 (D) is hereby amended to read as
follows:
Annexed territory. Territory annexed to the municipality after the effective date
of the zoning ordinance shall be automatically rezoned to the R -Rural District
as soon as such property is accepted by Dublin City Council.
Section 2. Section 1 of Ordinance No. 46-74 is hereby repealed.
Section 3. This newly annexed Township property shall be, as far as legally practicable,
subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153 of the
Codified Ordinances) the City of Dublin Zoning Code and amendments thereto.
Section 4. Such newly annexed property maybe rezoned, pursuant to the procedures
outlined in the Dublin Zoning Code, upon the application of the landowner.
Section 5. That this ordinance is declared to be an emergency measure necessary
for the immediate preservation of the public peace, health, safety or welfare, and shall
therefore be effective upon passage.
