AN ORDINANCE AUTHORIZING THE CITY MANAGER TO SIGN A PETITION TO ANNEX 2.697 ACRES, MORE OR LESS, LOCATED ON SHIER- RINGS ROAD IN FRONT OF NEW SERVICE COMPLEX, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin has determined that there is the necessity to annex the portion of Shier-Rings Road ("roadway"), consisting of 2.697 acres, more or less, which is located in front of the new service complex, into the City; and WHEREAS, the City will construct alert-hand turn lane, which will be built to City engineering specifications, within the portion of roadway that is currently owned by the City; and WHEREAS, the portion of roadway, as depicted in Exhibit "A" and described in Exhibit "B", is currently owned by the City of Dublin, the Dublin City School District, and Alvin A. Rings, Jr.; and WHEREAS, the City will need a majority of landowners under the current Ohio law, therefore requiring two (2) of the three (3) landowners, to sign the petition in order to submit the annexation petition to the Franklin County Commissioners. NOW, TH~REFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. Dublin City Council authorizes the City Manager to sign a petition on behalf of the City to be one of the landowners in an annexation of 2.697 acres, more or less, located on Shier-Rings Road in front of the new service complex. Section 2. This Ordinance is declared to be an emergency measure for the immediate preservation of the public peace, health, safety or welfare, and for the further reason of signing the petition; therefore, this Ordinance shall take effect and be in force immediately upon its passage. Corey Colombo DATE: March 13, 2002 RE: Ordinance Authorizing City Manager to Sign Annexation Petition In the upcoming weeks, this office intends to file a petition with the Franklin County Commissioners in order to annex 2.697 acres of Shier-Rings Road into the City of Dublin. This portion of roadway is located in front of the City Service Complex, which is under construction and located at 6665 Shier-Rings Road. The City intends to build a turn lane in this roadway, which will be built to City specifications. This roadway is owned by three landowners: the City of Dublin, the Dublin City School District, and the Alvin Rings family. The attempts to contact the Rings family had been unsuccessful. Therefore, the decision was made to secure the signatures of the City and School District in order to have a majority of the landowners sign the petition. Christopher Mohr, Treasurer and Director of Business Affairs for the School District, has already signed the petition on behalf of the School District. This ordinance would authorize the City Manager to sign the annexation petition on behalf of the City of Dublin. Ohio 43016 Re: Proposed Shier-Rings Road annexation Dear Dana: As we discussed, this office will immediately begin the annexation process for the 2.697 acres of Shier-Rings Road, which is located in front of the service complex that is being constructed. As you are aware, the plat map and legal description for this proposed annexation were recently completed by Patridge Surveying. A copy of the plat map is enclosed for your reference. Despite all diligent efforts, the current owner of the Alvin Ring's property could not be located. Therefore, in the interest of time, it will be best to proceed by securing the "signatures" of a majority of t11e interested landowners, which includes the City of Dublin and the Dublin City School District. According to the Franklin County Commissioners' annexation hearing schedule, any petitions submitted between March 1 and April 5, 2002 will have a hearing date of June 5, 2002. This will allow sufficient time to provide notice to the necessary parties and to publish the notice of the hearing in a newspaper of general circulation for four consecutive weeks. Additionally, you have indicated that it is the City's desire to build a turn lane within the area that is proposed to be annexed and which is currently owned by the City. Based upon the Franklin County Chief Duty Engineer of Operations Gary Palatas' acknowledgement of the City's intentions, it would be this office's recommendation that you proceed with building the turn lane to the City's specifications forthwith. A copy of this letter to Mr. Palatas is enclosed for your reference. As indicated in the letter, the City will aggressively pursue annexation of this parcel. As you know, the City of Dublin is constntcting a new "Service Center" at 666 Shier-Rings Road, immediately west of the existing= nublin Schools' bus garage. As part of the construction, the City submitted to the County a turn lane design for the new center, since that portion of Shier-Rings Road is not yet in the City of Dublin. The turn lane design submitted vas approved b}~ the City's engineering staff and is consistent with other turn lanes within the City. The County's review appears to use a design standard exceeding what the City would do in this particular case. The City of Dublin appreciates and respects the County's design standard, however, the City desires to install its own standard for the following reasons: 1. The City intends to aggressively and immediately seek annexation of that portion of the road. As you know, the City did annex the road in front of the existing Service Complex and school bus garage. Also, the City recently annexed the portion of the road at Shier- Rings and Eiterman Road to the west of the site. 2. The City does plan to widen Shier-Rings Road in this area in the not too distant future. 3. The City will provide ditch mowing, snow plowing, pot hole and shoulder repair to this section of Shier-Rings Road between the existing bus garage and Eiterman Road.
