AN ORDINANCE TO ACCEPT THE LOWEST/BEST BID
FOR THE WATERFORD DRIVE SIDEWALK
IMPROVEMENTS PROJECT FOR THE CITY OF DUBLIN,
APPROPRIATING FUNDS THEREFOR, AND DECLARING AN
EMERGENCY
WHEREAS, after advertising, receiving and opening bids on February 25, 2002
four (4) bids were received for the Waterford Drive Sidewalk Improvements project;
and
WHEREAS, Council has determined that the lowest and best bid for said project is
from Decker Construction Company in the amount of $94,729.88; and
WHEREAS, Council has determined that there may be a legitimate need to declare
the relocation of the utilities in connection with the above-referenced project as a
"single source" procurement, for reason that the company owning the utilities in
question has the exclusive rights to relocate such utilities; and
WHEREAS, it is necessary to amend the annual appropriations ordinance to
provide funding for the project.
NOW THEREFORE BE IT ORDAINED by the Council of the City of Dublin,
Ohio, ~ of the elected members concurring:
Section 1. That the bid from Decker Construction Company in the amount of
$94,729.88 be, and hereby is, accepted.
Section 2. That the City Manager is hereby authorized and directed to execute a
contract with Decker Construction Company for completion of said project pursuant
to the bid specifications and documents on file in the office of the City Engineer.
Section 3. That there be appropriated from the unappropriated balance in the
Capital Improvements Tax Fund the amount of $99,500 to account number 401-
0314-780-2579 for the purpose of constructing sidewalks in Historic Dublin.
Section 4. That this ordinance is declared to be an emergency measure necessary
for the immediate preservation of the public peace, health, safety or welfare, and
shall therefore be effective upon passage.

On February 25, 2002 bids were received and publicly opened and read for the
Waterford Drive Sidewalk Improvements project. Four (4) bids were received, as
shown on the attachment.
All bids have been reviewed and it is recommended that we award this contract to
Decker Construction Company, the lowest and best bidder. Decker Construction
Company's bid was $94,729.88. The previous quote from McDaniels Construction
Company was $100,082. The Engineer's estimate was $111,000.00.
I recommend approval of this contract to Decker Construction Company. Attached is
an emergency Ordinance for approval by City Council prior to awarding the contract to
Decker Construction Company.
