AN ORDINANCE TO AMEND SECTION 315.3 OF THE
1999 OHIO RESIDENTIAL CODE, AS WAS ADOPTED
. - BY REFERENCE, REGARDING WINDOW WELLS.
WHEREAS, the Dublin City Council adopted the 1999 Residential Code by reference
on March 5, 2001 bypassing Amended Ordinance 17-01; and
WHEREAS, the adoption of the 1999 Residential Code was codified in Dublin Code of
Ordinances, Section 150.001; and
WHEREAS, the Dublin Code of Ordinances, Section 150.002 provides for
amendments, deletions, and additions to the Residential Code; and
WHEREAS, the Dublin Chief Building Official is recommending an addition to
Residential Code Section 315.3, which pertains to window wells; and
WHEREAS, the addition to the Dublin Code of Ordinances would allow for enhanced
safety requirements for the buildings located in the City of Dublin.
NOW THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State
of Ohio, ~ of the elected members concurring that:
Section 1. Section 150.002(H) of the Dublin Code of Ordinances is hereby added to
read as follows:
(H) Include Section 315.3(a), which reads as follows:
(1) The open sides of window wells, stairwells or any other entrance well
feature having a total rise of more than thirty (30) inches above the
exterior grades shall be provided with a guardrail, not including those
that meet the exception in Section (H)(2).
(2) Exceptions to Section (H)(1)
(a) A guardrail shall not be required when landscape elements
preclude close approach to the upper side of the open well; or
(b) Grates meeting the design requirements of the guardrail may be
used in lieu of a guardrail.
(3) In no case may the use of such devises preclude use of a required means
of egress.
Section 2. This Ordinance shall take effect and be in force from and after the
earliest date permitted by law.

Re: Proposed Ordinance Requiring Protection For Outside Window Wells, 65-02

The attached Ordinance is being proposed to establish requirements for guards at window wells,
stairwells, and similar elevated exterior surfaces that occur outside asingle-family dwelling.
The Building Code, which the City has adopted, requires guards be provided on the open sides of
decks, balconies, and along open stairways. However, the Code does not require guards in the
additional situations, listed above. When the lack of a clear requirement was pointed out I
directed the inspection staff to follow the procedures which are outlined in this new Ordinance.
Therefore, I don't believe there will be any change for the building community as result of the
proposed Ordinance. The passage of the Ordinance will give proper legal status to our current
practice.
I recommend passage of Ordinance 65-02.
