Form No. 30043 Ordinance No. 60-02 Passed , 20 An Ordinance Amending The Annual Appropriations Ordinance For Fiscal Year Ending December 31, 2002 WHEREAS, Section 5705.40 of the Ohio Revised Code allows for supplemental appropriations to be made to an appropriations measure provided sufficient resources are available; and WHEREAS, the Ohio Revised Code requires, when necessary, amendments to the annual appropriations ordinance to be made in order that appropriations are not over expended; and WHEREAS, it is necessary to amend the annual appropriations measure to provide funding authorization for the development of the community park at the entrance to the Ballantrae residential and golf course development. NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. There be appropriated from the unappropriated balance in the Ballantrae Park Construction Fund the amount of $790,000 to account 437-0314-780-2511 for construction costs related to the community park at the entrance to the Ballantrae development. Section 2. The public hearing be waived to provide immediate funding authorization for the project. Section 3. This Ordinance shall take effect and be in force in accordance with Section 4.04(a) of the Dublin City Charter. Passed this ~ of 2002. Grigsby, Interim City Manager/Director of Finance Subject: Ordinance No. 60-02, An Ordinance Amending the Armual Appropriations Ordinance Date: April 2, 2002 As you are aware, the City entered into an Infrastructure Agreement and a Park Development Agreement with Multicon Development Co. (Multicon) for the construction of the public infrastructure improvements, including the development of a community park, needed for the Ballantrae residential and golf community. The Infrastructure Agreement provided for the construction of roadway improvements, the extension of water and sewer lines, and the completion of secondary improvements as available funding allowed. The secondary improvements included the burial of existing power lines, landscaping and irrigation improvements, lighting, and other parks and recreational facilities and improvements. As a result of the favorable bids received by Multicon, it was previously identified that funding would be sufficient to continue the extension of Eiterman Road to the southern property line of the Ballantrae development and to complete the secondary improvements identified in the Infrastructure Agreement. A copy of the May 17, 2001 memo is attached for reference. The attached spreadsheets reflect the expenditures and encumbrances in the Golf Course Roadway Fund through March and identifies the balance available for remaining roadway work and the transfer to the Ballantrae Park Fund. Financial information on the project water and sewer improvements is also included. Ordinance No. 60-02 appropriates the funds that will be transferred from the Golf Course Roadway Fund to the Ballantrae Park Fund for construction costs related to the development of the park as identified in the Park Development Agreement. The Ballantrae Park is being developed in accordance with the park plan presented to City Council at the August 13, 2001 Council meeting. The current total estimated cost of the park is $2,489,093. The Edwards Companies will be contributing $452,000 towards the development of the park in accordance with the Development Agreement and the park Infrastructure Agreement. The attached information also provides a recap of the public investment in the infrastructure improvements related to the Ballantrae development. Grigsby, Director of Finance As stated in the Ordinance, additional appropriations are being requested for the sanitary sewer odor control program and the infrastructure improvements related to the Ballentrae golf course community. The 2001 Operating Budget included funding for the sanitary sewer odor control program through June. The biofilter odor control system is being installed by the City of Columbus. They have experienced project delays as a result of unanticipated rock excavation and a conflict with utility lines. At this time, we are unsure of the project completion date. This appropriation should allow Dublin to continue the odor control program through year-end. Sections 2, 3 and 4 provide for the establishment of separate funds for the infrastructure improvements related to the Ballentrae golf course community. The Infrastructure Agreement executed by the City of Dublin and Multicon Development Co. (Multicon) requires that separate funds be used to account for the financial activity of the projects. Funding for the necessary roadways, water and sewer improvements were included in the 2001 Operating Budget in existing City funds. These appropriations reflect the balance between the amounts originally appropriated in the Capital Improvements Tax Fund, the Water fund and the Sewer Fund and the project payments that have been made to date. The attached spreadsheet reflects the original appropriations, actual expenditures made and estimated expenditures to be made for right-of--way acquisitions that have not been finalized. The bids have been received by Multicon. We do not have a final recap of the bids; however, they were very favorable. There will be excess monies that will be available for the completion of the secondary improvements identified in the Infrastructure Agreement. In addition to the secondary improvement identified, we currently anticipate that sufficient funds will be available to continue the extension of Eiterman Road to the southern property line of the Ballentrae development. The extension of Eiterman Road was shortened early in the project due to the estimated costs and the estimated resources available. In the Development Agreement, this continued extension was identified as a future obligation of the City. Being able to continue the extension of the roadway now will benefit the development of the golf course and allow the City to take advantage of the bid prices received by Multicon. When we receive the final bid recap we will provide that information to City Council along with a recap of the additional improvements that will be able to be completed.
