Passed AN ORDINANCE AMENDING SECTIONS 70.01, 72.061, AND 76.01 OF THE CODIFIED ORDINANCES OF THE CITY OF DUBLIN WHEREAS, the City of Dublin, Ohio (the "City") is vitally concerned with preservation of public peace, health, safety and welfare of its citizens, and; WHEREAS, the Parks & Recreation Advisory Commission has identified a potential threat to the public safety by motorized vehicles driving and/or parking on bike paths; and WHEREAS, Sections 70.01, 72.061, and 76.01 restrict motorized vehicles from driving and/or parking on the sidewalk, sidewalk area, street lawn area, the curb of a street, but are silent regarding bike paths; and WHEREAS, Dublin City Council concurs with the recommendation of the Parks & Recreation Advisory Commission; NOW THEREFORE IT BE ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. §70.01 of the Code of Ordinances, be amended to include a definition of "bike paths" as follows: Bike Paths. Those paved portions of a street between curb lines, or the lateral lines of a roadway, and the adjacent property lines or separately paved travelways/paths through park lands, City owned property and/or easements intended for the use of pedestrians and bicycles. Section 2. §72.061 of the Code of Ordinances, be amended to include the words "bike path" in the following statements/sections: §72.061 Driving Upon Sidewalks, Bike Paths, Street Lawns or Other Areas. (A) No person shall drive or operate any vehicle, other than a bicycle, upon a sidewalk, sidewalk area, or bike path, except upon a permanent or duly authorized temporary driveway. Section 3. §76.01 of the Code of Ordinances, be amended to include the words "bike path" in . the following statements/sections: (A) On a sidewalk, curb, street lawn area, or bike path, except a bicycle; Section 4. This ordinance shall take effect and be in force from and after the earliest date allowed by law. McDaniel, Assistant City Manager/Director of Service Date: April 2, 2002 Re: Ordinance 58-02, Bike paths The Parks & Recreation Advisory Commission raised the issue of motorized vehicles and parking on bike paths. This issue came to light as members read about Columbus revisiting certain motorized vehicles on sidewalks, and certain members witnessing citizens blocking bike paths by parking on them. As a result, staff researched the Code and discovered that bike paths were not addressed. It appears that bike paths were not addressed in Dublin Code because at that time there were very few and not considered a vital part of the overall transportation system. It is now obvious that bike paths are a vital part of the overall transportation system for bicycles and pedestrians. Ordinance 58-02 if passed would limit bike path use to bicycles and pedestrian (non-motorized) transportation, similar to sidewalks. Additionally, the Ordinance will not allow parking on bike paths.
