YE.aR AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONDUIT USE AGREEMENT WITH AMPERION, INC. WHEREAS, the City of Dublin has demonstrated great innovation in the area of telecommunications and right-of--way management; and WHEREAS, Amperion, Inc. desires to beta test new technology in the City of Dublin that may ultimately benefit Dublin businesses and residents; and WHEREAS, the City of Dublin desires to contribute to Amperion's beta test by providing temporary access to certain portions of City-owned conduit and to use equipment provided by Amperion; and WHEREAS, by providing the access and use the City of Dublin may contribute to the advancement of technology to obtain "the last mile" while gaining first-hand understanding of this technology. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, r~ of the elected members concurring that: Section 1. 1. The City Manager is authorized to enter into a conduit use agreement with Amperion, Inc. 2. The General Right of Way Permit requirement is hereby waived during the beta testing period. 3. The City Manager is authorized to expand the beta test area using DUBLINK conduit on a temporary basis as needed. 4. The City Manager will report to Council on a periodic basis the progress of the beta test. 5. Amperion is authorized to install the necessary equipment in order that City staff can participate in the beta test. Section 2. This Ordinance shall take effect and be in force on the earliest date permitted by law. McDaniel, Assistant City Manager/Director of Service Date: July 18, 2002 Re: Amperion Conduit Capacity Use and Service Agreement Several months ago, Amperion contacted staff regarding the desire to conduct a "beta" test on potential new technology. This technology, if successful, could bring fiber optic-like bandwidth to consumers over existing electric service lines. Amperion and its new technology are serving as a catalyst to bring together multiple players to test this new possibility to include the City of Dublin. Amperion requests access to certain City of Dublin conduit within DUBLINK through which to pull fiberoptics. This fiber will be temporary and enable them to conduct their testing. The testing sites will be the American Electric Power (AEP) substation at Emerald Parkway and Shier Rings Road and the City's 5800 Building. Amperion will provide and setup computer hardware in the 5800 Building to be used by City employees. They will monitor the effectiveness of this technology. Amperion is targeting this area for its initial beta test and may expand the beta test in this area to include other government facilities, schools, businesses and residents. The City will benefit by gaining the temporary use of additional computers; additional access and capacity to Internet and Intranet services; first hand knowledge of this new technology, its use and potential capabilities. DLM/tb Amperion PLC Beta Test Overview Amperion is the leading developer of medium voltage (MV) power line communications (PLC) technology. The company was formed in June 2001 by American Electric Power, Cisco and Redleaf Group and is based in Chelmsford, Massachusetts, with a regional office in Columbus. The Amperion vision is that everyone who has electricity can also have broadband access. Amperion's mission is to enable broadband communication over medium voltage (MV) electric distribution lines. To this end, the company is designing, developing and marketing equipment and supporting software and services that enables multi-Mbps data transmission over electric utilities' MV electrical infrastructure, and includes the final linkage to the end use application. The Dublin test will be among the first of its kind in the world, intending to prove that the Amperion technology successfully delivers multiple Mbps of bandwidth to customers over the MV electric infrastructure. It will also prove that applicable FCC Part 15 regulations can be met, core utility applications can be supported and that the economic potential justifies further testing. Amperion has formed several partnerships to perform this technology trial as efficiently as possible. World-class partner companies include an Internet service provider, network operator, aDublin-based systems integrator, and American Electric Power. Testing will begin in July and is anticipated to last approximately 120 days. The city of Dublin was selected as the test site because of the proximity of trial customers and potential future customers to the Dublink fiber system and Dublin's reputation for being a city that deploys cutting-edge technology. A DS3 circuit will be provided from a POP in central Ohio to a point (manhole #54) in the Dublink system, where new fiber will be spliced and pulled approximately 1300' through the city's conduit. This use of the city's conduit will be temporary and used only for the duration of this project. Amperion will then trench 177' of new fiber to a point outside the AEP Service Center, where a broadband signal will be injected onto the MV power lines and transmitted to a demo site inside the AEP building. At that point, there will be multiple computers displaying a number of different applications such as high-speed Internet access, streaming video, and utility applications using that broadband signal. Phase 2 of this project, to be completed in August, will then transmit the broadband signal to the city's building at 5800 Shier Rings Road and demonstrate similar applications at that site. This phase will demonstrate another aspect of Amperion's technology, that the signal can be transmitted on overhead power lines. The city will have use of these computers, applications and the Internet access for the duration of the trial. Amperion and its partners look forward to working with Dublin beyond the completion of this trial in order to potentially deploy a commercial product to customers in the city in 2003, providing them with an alternative method of receiving broadband services in their homes or businesses. This would bring economic and other benefits to the city and its citizens, and further enhance Dublin's reputation as being a progressive, leading-edge city.
