NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~, of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby zoned PUD, Planned Unit Development District, a preliminary development plan that shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. Clarke, Planning 1ctor / RE: Ordinance #89-02 - St. Brigid of Kildare Church -East Campus Rezoning (Case 02-0302) SUMMARY: Rezoning application 02-0302 for St. Brigid of Kildare Church -East Campus was submitted in June of 2002. This application represents a change in zoning from R-l, Restricted Suburban Residential District, to PUD, Planned Unit Development District. This PUD provides for the construction of a 102-space parking lot, a new 625-square foot garage, a 900-square foot cold storage building, and an unlit, multi-use athletic field. A copy of the proposed development text will become binding as part of the ordinance. Both staff and the Planning Commission recommended approval of this PUD rezoning. On September 5, 2002, the preliminary development plan for St. Brigid's East Campus received approval from the Planning Commission with 15 conditions (See attached Record of Action). The applicant's representative agreed to all the conditions. Much of the neighborhood opposition was addressed either prior to or at the Planning Commission meeting. RECOMMENDATION: Adoption of Ordinance #89-02 on second reading. It will serve a variety of support proposes for the existir~ church and school on the west side of Avery Road. Multi-purpose athletic fields will be located in the northeast corner of the sift. Paved parking for up to 102 cars will be provided in two main areas in accordance with the site plant developed for this application. A storage building (see definition below) will be Located adjacent the ball fields. The existing house on the southern part of the site will continue to be used for singlesfamily residential purposes. The existing outbuilding to the east of the residence will also be retained. Other structures will be removed. Anew, detached, two-car garage with storage will be constructed. A walking path from the southern lot shall be constructed with a footbridge over the drainage ditch, and a painted crosswalk will be striped on Avery Road. A public eoucrete sidewalk will be constructed along the Avery Road frontage of the site in conformance to City requirerzr,ents, as well as azr asphalt bikepath co~nz~,ection from the northern parking lot to the existing bikcpath system to the north. New structures shall include a 32' by 32' storage building and a 24' by 24' garage to serve the existing residence. The unkteated storage building will include restrooms. The restrvoms will be used during the warm weather months only and shut down during t)~e rest of the year following winterizaation. 5. Lot Coverage. The total sific area is approximately 345,610 square #'eet net of Avery Road R.O.W. The proposed and existing structures will not exceed 8,000 square feet in combined arcs. Vehicular and pedestrian paving areas will mot exceed 48,000 square feet, Z.ot coverage will be limited to 18 percent of the sift. 6. Lighting. The athletic fields shall not be lighted. Due to tha infrequency of use of the paticing areas at night (midnight mass and other rare night time sexvices), the lighting will be kept to a minimum. Low-level, residential-style lighting is permitted with a maximum fixture height of 20 feet. Security lighting shall be provided at the new cold storage building, the residence. and garage in the foam of cut-off design residential-style security light fixtures. 7. Fencing. The existing farm fence along the nozthern sito boundary and along the eastern boundary to the point were it reaches the existing drainage ditch will be removed tv connect all .the open spaces. Potential fencing at the ball field includes backstop fencing and sideline fencing. Chain link fencing with black vinyl coating is to be used for this purpose. The proposal includes the construction of a new 102- space parking lot, amulti-use athletic field, a 625-square foot garage, and a 900-square foot cold- storage building. The Planning and Zoning Commission approved a concept plan for this site on April 11, 2002 as did City Council on May 20, 2002 (Case 02-009CP). The concept plan included church property on both sides of Avery Road. However, Council recommended that only the portion of the site east of Avery Road move forward. This application only includes "off-site" facilities associated with the church on the east side of Avery Road, and no expansion of the existing church or school structures is proposed at this time. The concept plan was approved with several conditions, the foremost of which involved the applicant working with the adjacent property owners to redesign the proposed parking lot on the east side of Avery Road. A meeting was held between the residents, staff, and the applicant on August 27, 2002 to review the proposed plans. Several issues were raised by the residents which included: 1) Relocation of the proposed pedestrian path to the north of the Bear Run; 2) Investigating the feasibility of an additional raised crosswalk on Avery Road for traffic calming (or the relocation of the existing raised crosswalk); and 3) Investigation of a restrictive covenant to preclude future commercial development of the site and augment the proposed zoning text. The general purpose of the PUD, Planned Unit Development District is to permit flexible, alternative development that is designed in a coordinated, comprehensive manner. Such development should preserve the natural quality and character of the land consistent with accepted land planning, landscape architecture, and engineering principles. The preliminary development plan (rezoning) is the second of three stages in the PUD process and establishes the permissible uses, density, development standards and preliminary layout. In accordance with Section 153.056, the Code sets forth the criteria for approval of the preliminary development plan: • That the proposed development complies with the purpose, intent and standards of the zoning ordinance, development text, Code and prior conditions of approval; Dublin Planning and Zoning Commission Staff Report -September 5, 2002 Page 18 That the proposed development is consistent with sound zoning, planning and design techniques and conforms to applicable plans; That the development will advance the general welfare and provides benefits that justify deviating from the standard requirements of the Code; That it uses a variety of land uses incorporating proper relationships of proposed land uses and structures; and That the development exhibits proper density and development standards. _ Once .the Planning Commission makes a recommendation on the rezoning request, the application will then be returned to City Council for a public hearing and final vote. A two- thirds vote of Council is required to override a negative recommendation by the Commission. If approved, the rezoning will become effective 30 days following the Council vote. The preliminary development plan includes all preliminary platting requirements as well. Within 240 days following approval of the preliminary development plan, the applicant must submit a final development plan for a minimum of 20 percent of the site. A time extension for submittal of the final development plan may be granted prior to the deadline with a majority vote of the Commission. CONSIDERATIONS: Site Characteristics: • The site consists of two rectangular parcels totaling 8.387 acres located on the east side of Avery Road, slightly north of Holywell Drive. The home and barn on the northern parcel have been razed, and the only remaining structure there is a chain-link fence where a boat is stored. The home and barn on the southern parcel are to remain, but the attached garage will be removed and replaced with a detached, two-car garage. This site is relatively flat and contains about 620 feet of frontage along Avery Road, with 595 feet of depth. There are a large number of mature trees dispersed about the site. The Bear Run flows through the south and eastern portions of the site. The "regulated" floodplain on this site terminates immediately northeast of the site. There is a large open field toward the northeast portion of the lot. An old, wire farm fence runs along the north and east property lines. The two parcels are currently zoned R-1, Restricted Suburban Residential District. To the north, south, and east of the site are single-family subdivisions zoned PLR, Planned Low Density Residential District. To the northeast, east, and southeast of the site is the Dublinshire subdivision (Dunmere), with homes on Holywell Drive and Brigids Close Drive. To the west, across Avery Road, are the St. Brigid of Kildare Church and elementary school, zoned R-1. There is a small public park (tot lot) located between the site and the homes to the northeast. Site Layout/Development Text: • A 102-space parking lot, adual-use athletic field (baseball/softball and football/soccer), a cold-storage building, and a freestanding two-car garage are proposed. Parking Lot: The proposed parking lot is broken into two main areas, one at the southwest corner (45 spaces) and another area located further north that has a circular component (57 spaces). At the closest point, the parking lot is 70 feet from the south property line and 100 feet from the north property line. Landscaping and mounding is Dublin Planning and Zoning Commission Staff Report -September 5, 2002 Page 19 proposed to buffer the parking lot. The southern buffer will consist of an average three- foot mound with 6'-8' evergreen trees spaced eight feet apart. A deciduous hedge will also be provided to add screening. The parking lot is set back 50 feet from Avery Road. The parking lot is designed to minimize the impact on the existing mature trees. No lighting is proposed for the parking lot. Dual-Use Athletic Field: A dual-use athletic field (baseball/softball and football/soccer) is proposed in the grassy area at the northeast portion of the site. No lighting is proposed for the athletic fields. The proposed football/soccer field is oriented north/south and measures 300 feet by 100 feet. It is about 30 feet from the north and east property lines and "overlaps" the outfield of the baseball/softball field. Home plate for the proposed baseball/softball field is oriented to the northeast, and the infield may be dirt. The baseball/softball field is 250 feet down the left and right field lines and about 300 feet to center field. The baseball/softball field is zero feet from the north and east property lines. From home plate to the tot lot is about 340 feet. Staff recommends investigating protective fencing or netting to protect users of the tot lot. Backstop and sideline fencing is proposed for the athletic fields, is to be black or green vinyl coated chain link. No maximum fence height is established in the text. The text limits use of the athletic fields to daylight hours. Bleachers and dugouts are permitted by the text. In comparison to the plans submitted at the concept plan stage, the parking lot has been shifted north 35 feet. There is now a 70-foot pavement setback along the south property line. The plans include an "Option B" layout for the southern parking lot. This plan provides less separation between the lot and the south property line (55 feet instead of 70 feet). Staff does not recommend implementation of Option B. The proposed garage is 24' by 24' (576 square feet) and is 14 feet in height to the top of the roof. The proposed cold storage building is 32' by 32' and is 16 feet in height to the peak of the roof. The text limits these structures to 1,000 square feet and 25 feet tall to the peak of the roof. The text limits lot coverage to a maximum of 18 percent for pavement and structures. Minimum buildin setbacks are 100 feet from Avery Road right-of--way and the north property line, 200 feet from the eastern property line, and 90 feet from the south property line. Minimum pavement setbacks are 50 feet from Avery Road, 200 feet from the east property line, 100 feet from the north property line, and 70 feet from the south property line. A three-rail, cedar fence, four feet in height is proposed to the rear of the existing home, and will contain an area between the remaining house and barn. Its purpose is to distinguish between the recreational and residential uses on the site. The existing wire farm fence will be removed. Land Use/Zoning/Community Plan Issues: The text states that the East Campus will be used fora "variety of purposes" including a single-family residence, a parking lot, amulti-purpose athletic field, and a cold storage facility. Permitted uses should be listed individually in the text for clarity. The PUD text should be clear, especially on an in-fill site. It should be modified to limit uses to permit residential uses such as single-family homes, parks, schools, and churches. The Future Land Use Map in the Community Plan identifies the site as existing residential. Churches, schools, and parks, are permitted uses within the R-1 District. Dublin Planning and Zoning Commission Staff Report -September 5, 2002 Page 20 Parking lots (independent of a church, school, etc.) are not permitted uses within the R-1 District. Both parcels are currently zoned R-l, Restricted Suburban Residential District. A church or a school is a permitted use on a lot of at least five acres. The proposed parking lot and related facilities would be permitted if they were on the same parcel with the church. Because they are across the street, the current R-1 zoning does not permit them. Under the current zoning, the existing church and school on the west side of Avery Road may expand without public review. The R-1 District permits single-family residences (on 40,000 square foot lots), churches, parks, and schools. The Thoroughfare Plan designates Avery Road as a scenic road with a projected right-of- way width of 60 feet. Dedication of right-of--way consistent with the Plan is required at the time of rezoning, and the text does not address this issue. The Community Plan recommends maximizing setbacks along scenic roads. The Bikeway Plan indicates an existing eight-foot asphalt bike path along the west side of Avery Road. There is no pedestrian link currently along the east side of Avery Road. A concrete sidewalk is proposed along the east side of Avery Road in the text. There is a tot-lot with public access from Avery Road immediately east of the site, along the Bear Run. The text does not address restroom facilities or concessions for the site. Staff recommends that no concession stand (or similar) or portable restrooms be permitted. Access Considerations/Traffic Management: The existing driveways into the eastern parcels are to be replaced by a single access aligning with the church's northernmost access (420 feet north of Holywell Drive). The text limits vehicular ingress/egress to this newly-created access drive. The installation of a northbound left-turn lane was discussed at the concept plan stage in order to maintain "through" vehicular movements at all times along Avery Road. This discussion was based on the assumption that the existing church and school on the west side of Avery Road would be expanding. There is no plan for a southbound left-turn lane into this site. The speed limit in front of the church/school was lowered to 25 m.p.h. A raised crosswalk was constructed on Avery Road with signage/flashers just north of Holywell Drive. The proposed parking lot on the east side of Avery Road will have a new painted crosswalk. As proposed, the pedestrian path is about 120 feet from the parking lot to the sidewalk. Input from residents along Holywell Drive suggests that this raised crosswalk may not be effective, and that an additional or relocated raised crosswalk may be appropriate. (See attached letter.) A concrete sidewalk will be constructed along the east side of Avery Road. This will provide a connection to existing sidewalks north and south of the site. A wooden footbridge is also shown over the Bear Run Ditch, but no detail has been submitted. Staff recommends using a design that minimizes the potential for obstructing stormwater flow. Input from residents along Holywell Drive suggests that this path be relocated north of the Bear Run. (See attached letter.) Pavement within the parking areas should meet the Engineering requirements for strength, durability, and geometric elements. Turning movements of emergency vehicles Dublin Planning and Zoning Commission Staff Report -September 5, 2002 Page 21 must be accommodated in designing curves and turning radii. The driveway approaches within the public right-of--way and sight triangles must meet Engineering standards. Landscaping/Tree Preservation: • Along the southern edge of the parking lot, a landscape buffer is proposed. This buffer includes an average three-foot high mound planted with a row of 28 six- to eight-foot tall spruce trees. The trees will be spaced eight feet apart. In addition, a hedge of 68 2%2- high deciduous shrubs is proposed. This proposed buffer will be in addition to the existing tree row along the Bear Run. Staff recommends diversifying the proposed evergreen trees, and the proposed mounding must be consistent on the landscape and grading plans. The text does not address irrigation of plant material.. • According to the text, 96 caliper inches of protected trees are to be removed from the site. [A "protected" tree is defined as any tree at six inches in caliper or greater. A "landmark" tree is defined as any tree 24 inches or greater in caliper.] These will be replaced on an inch-for-inch basis, per Code. Tree protection fencing is shown on the plan, and replacement trees are located mainly on the northern and western perimeter of the site. Tree survey information shown on Sheet L-1 must be overlaid on the site plan to show proposed buildings and Stormwater management. Tree protection fencing is shown on the plan; it should be extended in the northwest and southeast corners of the site. Staff recommends reducing the percentage of honeylocusts included as replacement trees. • A 3.5-foot high perimeter screen is required by Code. The plan is deficient around most of the parking lot and driveway. The applicant is proposing to use existing trees to meet the parking lot perimeter tree requirement, which is permitted by Code. • Additional buffer plantings should be incorporated along the eastern edge of the athletic field. All mechanical units and other service structures must be screened per Code. • Street trees are proposed along Avery Road. There are existing overhead utility lines that preclude the planting of Sweetgum trees on the both sides of the road. The alternate street tree for Avery Road is the `Pacific Sunset' Truncatum maple (25-30 -feet tall at mature height). Utilities and Stormwater: • A water quality and detention basin is shown at the southern portion of the site, about 40 feet from the property line. Special attention should be paid to the design of this basin to ensure that there are no negative impacts to the adjacent single-family residences. The entire site must comply with the Stormwater Regulations. No Stormwater calculations have been submitted. • The remaining home on the east side of Avery Road should be connected to public utilities. Abandonment of septic systems must comply with OEPA and all other applicable health standards. Water is available to the site from an existing 12-inch line along Avery Road. Sanitary sewer service is available from an existing 18-inch line to the north. Lighting/Signage: • The text states that no lighting will be provided for the athletic fields or parking lot. Residential-style security lighting is proposed for the single-family home and cold storage facility. These lights will remain on all night, and must be cut-off or shielded to Dublin Planning and Zoning Commission Staff Report -September 5, 2002 Page 22 assure no light trespass. For safety purposes, staff recommends installing some degree of low-level, residential-style lighting for the parking lot. Special attention should be paid to the lighting design to avoid glare or light trespass in the adjacent residential areas. The text limits signage to a post-type sign to match the existing church signage across Avery Road. As proposed, the sign is 6'S" tall to the top of the pole and will read "Brigid Green." The sign will be wooden with four-inch letters. Sign setbacks, height, etc. are per Code. The maximum number of signs (one) should be added to the text. Architecture: The text states that exterior materials for new structures (cold storage building and garage) shall be cultured stone or other natural material. The roofs will have a minimum 6:12 pitch and will utilize asphalt shingles or standing seam metal roofing materials. All future construction will require final development plan review and approval by the Planning Commission. STAFF RECOMMENDATION: The preliminary development plan submitted is consistent with sound planning practices and has generally addressed the issues brought forth at the concept plan stage. The parking lot has been shifted to the north from the initial concept plan. This provides increased separation between the adjacent residences, and the landscape buffer has been expanded. However, staff cannot endorse reducing the buffer to 55 feet as proposed in Option B. Rezoning 02-0302 -Preliminary Development Plan - St. Brigid of Kildare Church Off- Site Facilities - 7210 and 7240 Avery Road Chad Gibson said the Commission and City Council approved the concept plan, involving both sides of Avery Road. City Council requested that only the east side proceed with the preliminary development plan. He said there was a recent meeting with the applicant and the residents. Several letters were in the Commission packet, and another letter was presented tonight. He said the correct text was delivered a few days ago to replace the text included in the packet. Mr. Gibson said this is a rezoning application for two parcels totaling 8.38 acres. The site is located on the east side of Avery Road, 150 feet north of Holywell Drive. This proposal expands the facilities for St. Brigid's Church which is located on the west side of Avery Road. A 102- space parking lot, amulti-use athletic field, and a 900 square foot cold storage building are proposed. He gave a PowerPoint presentation. Houses on Brigid's Close Drive back up to this proposed site. Both this site and the existing church are zoned R-1, Restricted Suburban Residential District. The proposed access is from one point on Avery Road opposite the northern curbcut into the church. The two parking lots will have 102 spaces combined. The multi-purpose athletic field is in the northeast corner of the site and can be used for baseball, softball, football, and soccer. The house and barn on the southwest corner of the site are to remain. A 900-square foot cold storage building and a new garage south of the house are also proposed. The garage for the existing home is to be removed. Mr. Gibson said there was much discussion about the distance between the parking lot and the south property line and neighboring houses. It was increased from 35 feet to 70 feet. There will be a landscape buffer between the lot and the neighboring backyards. There will be a pedestrian path from the parking lot to the sidewalk. An at-grade crosswalk to the church was another issue discussed. Several residents requested relocating the path to the north side of the Bear Run, more or less perpendicular to Avery Road. He noted there is a City tot lot to the northeast. Mr. Gibson said a proposed cedar fence delineates between public and private areas on the site. There is a proposed condition for protective fencing along the tot lot to protect against fly balls. He said several residents have questioned the effectiveness of the existing raised crosswalk. Some report that construction traffic is not slowing down for the crosswalk, and this creates a noise problem. They would like it to be relocated or to have another traffic calming approach. Mr. Gibson said the existing sidewalk ending at the property line will continue northward and connect to the existing sidewalk to the east. The farm fence will be removed. He said no lighting is proposed for the athletic field or the parking lot. Staff believes that some low level of lighting within the parking lot should be installed. Mr. Gibson said staff cannot support Option B submitted for the parking lot. It is closer to the south boundary than Option A. Mike Close, attorney for the applicant, said they agree with Conditions 1, 2, 3, 4, 6, 8, 9, 10, and 11. He expressed appreciation for Mr. Gibson's work on this case. Mr. Close said after City Council approval in May (Case 02-009CP), they reworked the plan and met with the residents last week. They attempted to address most of the concerns, and they have agreed to the restriction. Many residents feared this property could some day be developed commercially, and he said that will never happen. They will do a straw man transfer to put a restriction on the land against commercial and industrial development to satisfy the residents. Mr. Close said a "residential level" lighting plan was submitted for the parking lot. This parking lot will only be used a few nights per year, such as for Easter and Christmas midnight masses. Those cause a serious parking overflow. In the winter it is also dark for the mass at 5:00 p.m. on Saturday evenings. The neighbors and church do not want the parking lot lighting. If Dublin requires it, however, they will comply. Mr. Close presented several pictures of the pedestrian path. He said the path will come through at a diagonal 60 feet from the corner lot, but this disturbs that resident. He described the pictures and the views from both sides of Avery Road. He proposed landscaping that included evergreens planted eight feet apart, to provide 100 percent opacity along the walkway. He said moving the path another five feet to the north does not make sense. Ms. Boring asked if they could move it straight out to the bikepath without crossing the creek, and then come down the bikepath. Mr. Close responded that things will not line up visually. He said anyone could turn left and go out the bikepath and then across. They could put the crosswalk on the north side, but it would not be used. This location was planned well. Ms. Suarez, 6152 Holywell Drive, the corner lot being discussed, said there is not full coverage in the winter. She said at the public meetings, the church was directed through Mr. Close to work with the residents as a condition of approval. She said they were contacted only one week ago, and this is a disappointment. They had expected a great plan -an access with a steeple which ties into all the property lines on the church property. She said there should be limits on Dublin Planning and Zoning Commission Minutes -September 5, 2002 Page 14 what the church can do. She had been informed that moving the line of access five feet off, would make the walkway north of Bear Run, then the residents would have no argument since it would be away from their line of sight. They would not see church-goers crossing behind their property. Ms. Suarez said Mr. Gibson had done an excellent job. They do not oppose this parking lot. She asked the Commission follow the staff recommendation and consider the safety of their children. Kyla Frith, a Holywell Drive resident, said the church had failed to work with the homeowners as promised previously. They were not included in creating a plan on which they all can agree. The existing tree line provides no winter screening, and the mound is little more than a raised flowerbed. She noted the mounds on the other side of the church are much larger and provide a nice barrier. Ms. Frith wanted a nicer barrier between the parking lot and their homes. Jamie Smith, a Holywell Drive resident, said the proposed buffer plan will be totally inadequate in the winter. The sidewalk was too close to the back of their homes and should be moved. Mike Killian, a Holywell Drive resident, was concerned about sound pollution. His patio is now quiet and serene, but the ballpark noise may change that. He also wanted the path relocated as Ms Suarez had suggested. Greg Gray, athletic director for St. Brigid's, said the school has one football team with 18-24 kids, and daylight baseball/softball programs. Sunday games are not permitted before to 1 pm. He said the current baseball and softball diamond will be used. He said the noise level is limited due to the team size. It will not compare to games seen at Avery Park. Larry Kuhn, Dunmere Homeowners' Association, asked for the path to be relocated into an L- shape, away from the residents. He understood the church's desire for a sight line to the parish hall, but the parish hall is to be replaced by a gym in the future. The deed restrictions prohibit privacy fences. The foot traffic behind homes is a concern for the children's safety. Mr. Ritchie asked about protecting Bear Run. Mr. Gibson said the Tree Preservation ordinance protects trees that are six inches in diameter, but nothing protects the understory growth. Mr. Ritchie asked if the applicant could pipe the ditch, if they did not disturb the trees. Mr. Gibson said engineering standards would have to be met. Mr. Ritchie wanted the text to be amended to protect the Bear Run itself rather than just the vegetation. Mr. Gibson agreed. Mr. Ritchie is familiar with the Avery Road raised crosswalk. He said the church's six access points on Avery Road (raised crosswalk, Holywell Drive, new parking lot area, new pedestrian crossing, and north and south church accesses) are all separate. They should be coordinated, aligned, and planned together. It should be determined if the raised crosswalk should remain or be relocated, and where pedestrians should cross. He suggested a turn lane might be needed. Ms. Boring said protective fencing was a good idea, but how could it be used with the Fence Code. She asked how it was permitted on the Bash site. Mr. Gibson said it was a commercial site. The Commission could allow fences higher than four feet in the text. Dublin Planning and Zoning Commission Minutes -September 5, 2002 Page 15 Ms. Boring asked if the church school had requested the raised crosswalk on Avery Road. Mr. Gibson did not know. The speed limit was reduced to 25 mph, and the raised crosswalk was installed for traffic calming. Ms. Boring understood it was also for safety. She said the school should be contacted before making changes because she thought a committee had requested it. Ms. Boring thought lighting for safety is needed even if the parking lot is only used occasionally. Mr. Gibson suggested low level lighting with cut-off fixtures to address safety. Lighting should avoid light trespass and glare to the neighbors. Any lighting would assist police patrols. Ms. Boring asked if this plan had been modified from the approved concept plan. Mr. Gibson said yes. This only addresses the eastern side of Avery Road. The parking lot in the concept plan was 35 feet from the south property line, and this plan shows it at almost 70 feet. A circular element to the northern portion of the parking lot for ease of turnaround has been added. Mr. Zimmerman asked that the boat being stored on the northern section be addressed. Mr. Gibson said the police department had not been consulted on the lighting. The Code addresses glare and light trespass. He suggested short light poles, not to exceed 12 feet in height, or perhaps even bollard-style lighting. Mr. Zimmerman asked if a locked gate could be installed to prevent unauthorized parking. Mr. Gibson said it could be considered. Mr. Zimmerman suggested turning the pathway north and making it go straight across. That proposed path is a privacy issue for the residents. Mr. Gibson said more landscape screening was proposed since the initial plan. Since it is to be infrequently used, the location should not be a problem. Solid evergreens could block it, but shooting it straight across solves that issue. Mr. Zimmerman and Mr. Messineo were both concerned about noise and asked if the pathway could be moved. Mr. Close did not think a pipe could be put there because of the Army Corps of Engineers' regulations. He noted the parking lot entrance was moved to align with the northern entrance to the church. He said the church did not request the speed bumps. They will do whatever engineering says makes sense. He said they had no problem helping with the traffic calming. He said the turn lane will be addressed with the western parcel. Mr. Close said the neighbors did not want lighting and the church agrees with them. If they are required to do so, they will install lighting. He said with a 3'/2-foot mound in front, the police will not be able to see into it from the road. Mr. Close said the stored boat belongs to the Suarez's. Mr. Zimmerman reminded him that there is zoning text on it. Mr. Close said locked gates would impractical because the parking lot will also be used for the athletic fields. He said keeping the residence will result in a caretaker onsite, and this increases security. Visiting priests may use it. It was not practical to put up a gate. Mr. Close said he was not authorized to move the path. The church wants it in the place shown. However, he will promise to screen it with 100 percent opacity evergreens on the church's site. Dublin Planning and Zoning Commission Minutes -September 5, 2002 Page 16 There will be complete 100 percent visual blockage from their lot and along the bikepath. He did not think that would affect the stream. It will be on the south side of the stream and not within the subdivision boundaries. It can be either partway or fully across - as the Suarez's wish. Mr. Messineo asked about security on the site. Mr. Close said the cold storage building will not have restrooms, etc. opened during the winter. He thinks it is a good idea to keep the house to deter improper usage by people who have no legitimate business there. Mr. Gibson said a stormwater dry detention basin is proposed south of the existing barn. Mr. Gerber said the text has some small typos. He said he presumed the applicant will be responsible for maintaining the fencing at their cost. Mr. Gibson and Mr. Close agreed. Mr. Gerber asked if there were plans for any outdoor music or entertainment. Mr. Close said no, except perhaps once a year for a parish festival. No amplified sound or electronic scoreboards are anticipated. Mr. Gerber asked for this to be added to the development text. Mr. Close said regular outdoor gatherings could be prohibited. He guaranteed that the church would not do bingo, or church or commercial carnivals. He said it would not be fair to the residents. Mr. Gerber asked about DYA use. Mr. Close said they will not let any organized athletic groups unaffiliated with the church, use the ball fields. Mr. Gerber preferred that be included in the text. Mr. Gerber respected the view of the residents about lighting, but safety is also a concern. Mr. Close suggested that lighting, as determined by staff could be used. Perhaps two or three downward looking security lights over the entire lot could be used. Mr. Zimmerman asked about lighting on the cold storage building. Mr. Close said two security lights are proposed. Mr. Gerber asked that the residents be included on the lighting decision. Mr. Ritchie recommended a condition be added: That the City Engineer examine the various proposed accesses and the raised crosswalk on Avery Road, and make a recommendation to this Commission as to what modification should be made in the final development plan. Mr. Close agreed. Mr. Ritchie was uncomfortable with so many access points and the raised crosswalk. Mr. Close said he did not want the pedestrian crosswalk to the parking lot eliminated. Mr. Hammersmith said there are few options based on the sidewalk and existing crossing point locations. Those were used to locate the current raised crosswalk. He will look at the access points again. The raised crosswalk provides safer pedestrian access for children going to school. Mr. Ritchie said he understood there would be another marked crosswalk north of the raised crosswalk, where the path intersects with the sidewalk. Mr. Hammersmith said that was not his understanding. Mr. Ritchie said pedestrians may cross there whether it is marked or not. He wanted to facilitate the maximum safety and do what makes the most sense. Ms. Suarez said the landscaping Mr. Close proposed is acceptable. She thanked Mr. Ritchie for requesting that the access points be checked. The length of the proposed walkway is illogical. She was thrilled that the church needed this because it is a benefit to our community. Mr. Close said he used the comments at the Commission and City Council meetings to devise this plan. It was not practical to involve the residents in drawing the plan. Mr. Messineo seconded the motion. Ms. Boring asked if all the concerns had been addressed. Ms. Frith said the proposed screening on the south side of the parking lot was just a raised flowerbed. It is an insignificant height. Mr. Close referred to page 4, paragraph 10 of the development text: Buffer shall include an average three-foot high earthen mound planted with six to eight-foot high spruce trees spaced at eight feet on center, which is 100 percent opacity. Along the south end of the site is the Bear Run stream that travels to Brand Road, so there were issues raised regarding pedestrian safety across Brand Road and the Bear Run. The most cormoversial issue was buffering for the parking lot and its appropriate distance from the property line. P&Z assured the residents that there would be future opportunities for input, and the applicant was strongly encouraged to provide appropriate buffering and to shift the parking lot as much as was reasonable. This is anon-binding review and is the fast stage in a PUD. The next stage is a re2oning application, which must be filed within 6 months of concept approval. Mayor McCash asked about the distance from the rear property line of the houses to the paving as presently shown. Ms. Clarke believes it is 35 feet Michael Close indicated that he represents the applicant The application will be consistent with what has already beta built on the site. Mr. Kranstuber stated that the purpose of a concept plan is to provide informal feedback to the applicant This is a fairly active church and the neighborhood's concerns must be addressed in the process. Mr. Close noted that them are two issues which will be brought forward: 1) the parking lot lighting ,on the cast side -the residents don't want lights and the applicant doesn't believe they are necessary; and 2) the propriety of a tam lane for traffic that is generally random versus predictable. Mr.l2einer stated that the lot is undautikized as proposed and impacts only two properties directly. He doesn't see a major issue with the parkiriQ lot for the remainder of the adjacent residents. Concept Plan 02-009CP - St. Brigid of Kildare Church - 7179, 7210, and 7240 Avery Road Chad Gibson presented this concept plan for a religious campus located on both sides of Avery Road. This is the first step in the Planned Unit Development District process and it is non- binding on the parties. If approved, this authorizes the applicant to file the formal rezoning application or preliminary development plan within 180 days. He showed several slides. Mr. Gibson said the site has three parcels zoned R-1, Restricted Suburban Residential District. The combined church and school site is 15 acres on the west side of Avery Road. On the east side of Avery Road are 8.3 acres containing a house, barn and a heavily treed area along the Bear Run. The adjacent public parkland has a tot lot and a bikepath connection to Avery Road. A raised crosswalk was recently installed across Avery Road and the speed limit is now 25 mph. The proposal includes development of an 85-space parking lot, a dual use athletic field, and a cold storage facility on the eastern site. The driveway will align with the northernmost church driveway. There is an existing bikepath along the west side of Avery Road, and a new sidewalk is proposed along the east side of Avery Road. The school shows two future expansion wings. The primary 300-space parking lot is between the school and church. The overall goal is to add an 87-space overflow parking lot. The southern area has 44 spaces, and the balance aze farther to the north. A cold storage building is proposed between the proposed pazking lot and the athletic field. Anew gazage is also shown on the eastern tract. Mr. Gibson said the proposed pavement is about 32 feet from the reaz lot line, and 90 feet from the homes along Holywell Drive. The plan needs better landscaping and buffering along there. He said the pazking lot will tie into a sidewalk, which leads to the raised crosswalk, and that is the location of the proposed pedestrian bridge at the Beaz Run. It is not a regulated floodplain. Mr. Gibson said no lighting is proposed for the pazking lot or the athletic fields, and staff is concerned about the potential safety of the pazking lot after dazk. Staff is also requesting a turn lane into the site along Avery Road. Mr. Gibson noted two letters from adjacent residents were distributed to the Commissioners. He said the text will be a critical part of the preliminary development plan. Architecture, stormwater management, permitted uses, landscape buffering, etc. will also be reviewed. Mike Close, attorney for the church, said some Sundays they have tremendous parking problems. He said this plan started as a solution for parking problems and relocating an athletic field. He filed this request as a PUD concept plan as the staff advised. He said the long-term master plan for the western tract includes the possible school expansion and expanding the sanctuary to the north. They will probably remove "Yankee ~-Iall", the old stable. The existing farmhouse is being used as a parish office and will probably be razed and replaced by a building addition. Mr. Close said he expects to file a preliminary development plan only for the first phase on the east side of Avery Road, which is critical from a safety aspect and address the pazking issues. He said several times per year the adjacent streets are impassible due to parked cazs. After talking to the neighbors abutting the eastern parcel, it is cleaz to them they will have to improve the proposed plans for the pazking lots. They can move the parking lot all the way to the north property line, but this increases walking distances. 'They have not done storm water plans yet. Mr. Close said the pavement in the southwest corner may simply have to be eliminated. He said the neighbors do not want lighting. If requested, he would install residential type lighting. He agreed to the conditions as listed above, with the exception of Condition 4 regarding the turn lane. He said traffic counts and times need to be studied. He thought the best solution to get people across the road would be a traffic light. He agreed to a turn lane, if necessary. He said they are not ready to discuss development on the west side. He said they submitted this concept plan for all three parcels, because staff requested it. Kris Suarez, 6152 Holywell Drive, read her letter that had been distributed to the Commission. She was completely opposed to the idea of a parking lot behind her home. The headlights will shine into their homes, and it will affect their property values. She wanted to see a specific plan for trees, mounding, or a privacy fence. Ms. Suarez said there is a drainage problem now. She said there is traffic congestion now, and it will worsen after the Dublin- Jerome High School is built. Ms. Suarez requested assurance that specific designs for safety of the street be included. She wanted the parking lot pushed back as far as possible with the maximum light blockage. Larry Kuhn, president Dunmere Homeowners Association, read his letter. He said the 44-space parking lot shown directly behind the homes on Holywell Drive should be moved to the north of the proposed parking lot entrance with a raised crosswalk added. This would not be as detrimental to the homeowners. Mr. Kuhn included with his letter, a copy of a letter from John Matthews of ODNR who recommended keeping at least 50 feet between pavement and the Bear Run Ditch. Mr. Kuhn said the neighbors fear this parcel could be sold later for commercial or multi-family usage. They would like a strict zoning text that is binding. The landscaping plan should eliminate any sight line of the asphalt parking lot. They requested that no lighting be required east of Avery Road. Ms. Reyes of 6128 Holywell Drive said she opposed the proposed parking lot. They want to keep their property safe and maintain property values. When she purchased her house two years ago, she. was told the property behind her house was residential, but now she is being asked to accept a change in zoning. She thought the parking lot should be centered so that homes on either side would be fully screened, but the church rejected this because parishioners would not walk that far. The church did not contact them regarding this plan in the last year. She said her home is currently on the market, and this is directly affecting its sale. She was concerned about the houses and the wildlife that uses the creek. She suggested that an underground pedestrian tunnel be considered and asked who would pay for it. She said she and her neighbors did not object to having cars parked in front of their homes on Sunday mornings. Victor Golden, 6105 Holywell Court, said he was a parishioner with a child attending St. Brigid's. His concern was that as the school and church continue to expand beyond this proposal, where will future parking will be built. Mr. Zimmerman said he had visited this site, and any lighting should be minimal. Mr. Close responded that he would submit a development text specifically stating what can be developed. He said the only increased need for parking would be if the sanctuary were enlarged. The text will limit the parking, and only the parking approved by the Commission can be added. Mr. Close said they had no objection to moving the parking lot north, and they will submit the rezoning with added mounding to shield the residents from lights and noise. He asked if a well- designed parking lot would be likely to be approved. Mr. Gerber said any parking should be moved away from the neighbors and fully buffered. Mr. Ritchie said his concerns were if this accessory parking lot is needed on the east side of Avery Road, at what point is the site overdeveloped, and that no more parking can be accommodated. He said it was not addressed in the staff report. The athletic field will cause noise in backyards. Mr. Gibson said 70 percent is the maximum commercial lot coverage and 45 percent is the maximum for residential sites. Mr. Close said churches have some federal protections that exceed what the City can control. Mr. Sprague said Dublin favored reasonable religious settings within a residential area. Mr. Close said when a church is on five acres, it is a permitted use that does not require Commission approval. Ms. Clarke said the site has over-development symptoms now, but allowing parking all over the neighborhood does not seem to be the best answer. It is fortunate that the church could buy additional land to solve their parking problem. If this vacant land were on the same side of the road and contiguous, there would be no hearing. This is only an issue because the parking is across the street, off-site. She said the next door neighbors have legitimate concerns. This is a very unusual set of circumstances, but she believes there is an amicable solution somewhere. Mr. Gerber said he was in favor of this concept. It made sense for health and safety to keep this in a campus area. However, he is very concerned about the neighbors' views and encouraged Mr. Close could to work through their concerns. Mr. Messineo reiterated this. Mr. Ritchie said he also supported this concept plan. It meets the intent of the PUD regulations. Mr. Zimmerman understood the parking was necessary, but said the applicant should work with the residents to see how the lot could be moved and screened. Mr. Close said he would do the best he could to address the residents' concerns. Mr. Sprague said moving and redesigning of the parking lot and buffering should be considered. Mr. Banchefsky said the Commission needs to vote on concept plans, but the approval is non- binding and does not vest any rights. It also needs City Council approval. Mr. Sprague said lighting could be addressed in the conditions. Mr. Hammersmith said the turn lane should not be based on a warrant study. Dublin's policy is based on maintaining the through movements of the primary route. Mr. Close said the church off peak hours have an impact as to whether the left turn lane is necessary.
