AN ORDINANCE TO ACCEPT THE LOWEST/BEST BID FOR THE 2002 STREET MAINTENANCE PROGRAM AND DECLARING AN EMERGENCY WHEREAS, after advertising, receiving and opening bids on May 29, 2002 bids were received for the 2002 Street Maintenance Program; and WHEREAS, Council has determined that the lowest and best bid for said project is from Kokosing Construction Company, Inc. in the amount of $1,791,148.97; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities; and WHEREAS, it is in the best interest of the City to execute this contract as soon as possible so that construction can start early in the spring of 2002, NOW, TH FORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio, of the elected members concurring: Section 1. That the bid from Kokosing Construction Company, Inc. in the amount of $1,791,148.97 be, and hereby is, accepted. Section 2. That the City Manager is hereby authorized and directed to execute a contract with Kokosing Construction Company, Inc. for completion of said project pursuant to the bid specifications and documents on file in the office of the City Engineer. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health or welfare of the residents of this City, and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Kindra, Director ofEngineering/City Engineer ~~ ~~~ Subject: Ordinance No. 85-02 2002 Street Maintenance Bid Acceptance Project No. 02-001-CIP Date: May 29, 2002 On May 29, 2002 four bids were received and publicly opened and read for the 2002 Street Maintenance Program, as was previously submitted to City Council on April 8, 2002. All bids have been reviewed and it is recommended that we award this contract to Kokosing Construction Company, Inc. of Fredericktown, Ohio, the lowest and best bidder. Kokosing Construction Company's bid was $1,791,148.97. The Engineer's estimate was $1,783,611.00. The bid is $7,537.97 (0.42%) over the Engineer's estimate and $6,648.97 over budget. Construction activities will be monitored to keep the contract within the budget amount. I recommend approval of this contract to Kokosing Construction Company. Attached is an emergency Ordinance for approval by City Council prior to awarding the contract to Kokosing Construction Company.
