129-97 OrdinanceRECORD OF ORDINANCES ,~ Dayton Legal Blank Co. 129-97 Ordinance No.____________ Passed______ Form No. 30043 -- --- 19- - -- An Ordinance Amending The Annual Appropriations Ordinance For The Fiscal Year Ending December 31, 1997 WHEREAS, Section 5705.40 of the Ohio Revised Code allows for supplemental appropriations to be made to an appropriations measure provided sufficient resources are available; and WHEREAS, the Ohio Revised Code requires, when necessary, amendments to the annual appropriations to be made in order that appropriations are not over expended; and WHEREAS, Columbus Southern Power recently purchased property along David Road for the purpose of erecting a substation; and WHEREAS, the City of Dublin subsequently purchased property from Columbus Southern Power along the northern portion of David Road for the future construction of Village Parkway extension; and WHEREAS, in cooperation with Columbus Southern Power and in accordance with the Real Estate Purchase Agreement, the City agreed to provide certain improvements to provide access to the substation site; and WHEREAS, it is necessary that access to the substation be provided as quickly as possible because of the critical need to have the substation operational in mid-1998; and WHEREAS, it is necessary to amend the annual appropriations ordinance to provide sufficient funding for the improvements. NOW, THE FORE, BE IT ORDAINED, by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. That there be appropriated from the unappropriated balance in the Capital Improvements Tax Fund the amount of $63,800 to account 40-03-14-2550 for the purpose of providing roadway access to Columbus Southern Power's substation site. Section 2. That there be appropriated from the unappropriated balance in the Sewer Fund the amount of $96,600 to account 61-06-14-2560 for the costs associated with relocating the David Road sewer line. Section 3. That the public hearing be waived in order to provide immediate funding for the improvements necessary to provide access to Columbus Southern Power's substation site and for the further reason to provide for the initiation of the substation construction which is necessary to provide an acceptable level of electric service for Dublin customers. Section 4. That this Ordinance shall take effect and be force in accordance with Section 4.04(a) if the Dublin City Charter. Grigsby, Director of Finance~-~- In accordance with the Real Estate Purchase Agreement entered into between the City of Dublin and Columbus Southern Power, the attached Ordinance provides the funding necessary to complete improvements agreed to as part of the negotiation process for the acquisition of right- of-way necessary for the future construction of Village Parkway extension. Attached please fmd a copy of a memo prepared by Chuck Petty, Assistant City Engineer -Utilities, which provides a detailed breakdown on the improvements and their associated costs. The acquisition of the right-of--way was authorized by Ordinance 104-97 on July 7, 1997 and the acquisition was executed on August 29, 1997. It is the purpose of this memo to estimate the costs associated with each of those obligations. The following items are City obligations per the agreement: 1) Acquisition of an access road easement. 2) Acquisition of sanitary sewer easements for the relocation of the David Road sewer. 3) Construction of an access road. (See attached CSP typical cross-section detail) 4) Payment of a proportionate share of the design and construction cost of the relocated David Road sewer. In general, the City will pay for approximately 400 feet of the East- Westportion of the sewer. 5) Vacation of the northern portion of David Road. 6) Reimbursement to CSP for the demolition of 6672 David Road. The following item, though not specifically mentioned within the agreement, is necessary also: 7) Construction of a tee-turn-around at the terminus of David Road. M-E Engineering has already begun work on the preparation of easement descriptions for the access road. A copy of their proposal is attached. McDaniel, Director of S Date: October 2, 1997 Re: Ordinance 130-97 Attached you will find Ordinance 130-97, authorizing the City Manager to enter into an agreement with Nexus Telecommunications. As you are aware, Nexus Telecommunications (Jan Murphy), has been working with staff over recent months on several wireless telecommunications issues. These issues have included: 1. Working with several PCS and cellular companies on locating their facilities in Dublin. This work has been performed on a "flat rate" basis. 2. Developing a comprehensive inventory of potential sites for telecommunications structures and prioritizing these sites. This work is nearing completion. 3. Developing a Wireless Telecommunications Ordinance which received its final staff review on October 2. 4. Worked with Sprint PCS and led negotiations with them on the Avery Park site. Jan has done a fine job of working with staff; other local public agencies, business and the "wireless" industry as a whole in representing Dublin. Staffanticipates activity in the "wireless" area to increase due to the current level of issued licenses and those soon to be issued by the FCC. Staff desires to "outsource", as an extension of staff, this expertise to pro-actively work with the "wireless" industry. It is stall's desire to accommodate this industry's needs while maxiriuzing the City's ability to guide these locations to the advantage of the City and its residents. ncil er 1 e~ ~ Key points of the agreement include: 1. Scope of Services (attached) 2. The term of the contract will be through December 31, 1998. 3. Cost for services received are both "success-oriented" and "flat-rate" based. In the case of successful locations of wireless structures onto City owned property, the consultant shall "~" receive 12% of the lease stream for the first term of the lease not to exceed $15,000, payable annually. In all other cases, the City shall pay the Consultant aflat-rate of $100.00 per hour. It is also the intent of staff to include the recently approved Sprint Agreement in this contract, retroactively, for services rendered by Nexus Telecommunications. Staff desires to continue the relationship it has established with Nexus Telecommunications. Receive the referral of wireless carriers from the City of Dublin. 2, Review with carriers potential sites for the location of wireless telecommunications facilities in accordance with local code, objectives and wireless master plan on behalf of the City. 3. Review the carrier's proposal to include all related equipment drawings. 4. Survey the proposed site. 5. Request additional information from the carrier as needed. 6. Using the information acquired in steps 1 through 5 above, as well as knowledge of the state of technology and general industry requirements, identify and develop options and alternatives to the Proposal to the extent such options and alternatives are feasible, further the interest of Dublin, and promote the co-location of additional wireless sites. 7. Review the options and alternatives with a designated representative of Dublin. 8. Review the options and alternatives with the appropriate personnel from the Columbus Water Department, if applicable. 9. In cooperation with the designated representative of Dublin, review the options and alternatives with the Operator. (Steps 1 through 9 above are collectively "Services".) 10.
