NOW, T~~~EFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby rezoned to Planned Commerce District and shall be subject to regulations and procedures contained in Ordinance No. 21- 70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. Section 3. This ordinance is declared to be an emergency measure for the preservation of the health, safety and welfare of the residents of this City, and for the further reason that AEP and the City's consultant concur that a substation in this area must be on line by June of 1998 to continue to meet the City's needs for electrical services. Therefore, this Ordinance shall take effect and be in force immediately upon passage. The Applicant, Columbus Southern Power Company, is a public utility and is generally exempt from zoning by the City of Dublin regarding the electrical substation, but is submitting to zoning for goodwill purposes. Notwithstanding anything to the contrary in this text or in the Location Plan or the Elevation View, no construction or future expansion or modification of the electrical substation shall be subject to development plan review or approval by the City of Dublin Planning and Zoning Commission so long as it involves only electrical substation equipment, facilities, or other property that will be located at least twenty (20) feet inside the station fence identified on the Location Plan and that will be within the height limits provided by this composite/development plan; provided, however, that such expansion or modification does not involve expansion of the "control house" identified on the Location Plan beyond the limits established herein. Further, underground electrical distribution, grounding, and other equipment, facilities and property shall be permitted anywhere in the electrical substation site, whether inside or outside the station fence, and the construction, installation, or replacement thereof shall not be subject to development plan review or approval by the City of Dublin Planning and Zoning Commission. A. General Development Character of the Site. The general development character of the site is shown on the Location Plan. The Location Plan shows the approximate location of building(s) and various items of equipment which may be installed and removed from time to time and a fence, all of which will constitute an electrical substation. The site is flat and unremarkable. 1. All structures and all or substantially all of the trees and other vegetation located on the site as of the date of this plan will be razed or removed, as applicable, before commencement of construction of the electrical substation. 2. The chain link fence which will surround the electrical substation and gate will be approximately eight (8) feet high and will surround the site with setbacks at least as great as those identified on the Location Plan. B. Utilities. The substation will not require any utilities except electrical and telephone service. C. Proposed Traffic Circulation Patterns. 1. The Location Plan shows the relation of the site to public right of way. The site will not have direct access to David Road and no construction traffic will have the use of David Road, which is located south of the site and extends to West Dublin-Granville Road. All access to the site will be via a driveway to be constructed by the City of Dublin across an easement to be obtained by the City of Dublin and which will connect the site with Village Parkway. Over time, it may be necessary to modify the driveway and/or access considerations, most likely as a result of road construction. The City shall assure that adequate access is maintained to the site during the life of the project. 2. The Applicant expects that during normal operations the substation will generate very low traffic usage. D. Schedule of Site Development. 1. Initial site preparation and development will include razing all improvements and removing all or substantially all trees and vegetation located on the site. 2 2. Applicant plans to carry out construction of the electrical substation in two or more phases after the site is prepared for construction. 3. After razing or removing existing improvements and vegetation, the first phase will include installation of the substation perimeter fence, a building and electrical equipment. Otherwise, phasing will generally follow a north to south pattern. 4. The second and subsequent phases of construction may involve installation of additional equipment or expansion of the control house. Additional equipment will be located on the electrical substation site. Equipment installed in any phase may be replaced from time to time. 5. The public street and associated utilities and improvements to be located on the strip of land approximately one hundred (100) feet wide, which is to be acquired by the City of Dublin and which is located along the northern end of the site, will be installed by the City of Dublin in accordance with a timetable to be established by the City of Dublin. E. Relation of Site to Existing Future Land Use. The site is north of an existing residential subdivision. The electrical substation site will be landscaped and the taller structures will be located on the northern and eastern portions of the electrical substation site, to the extent consistent with good practices and procedures for the operation of electrical substations. The electrical substation site will be buffered on all four sides by mounding and landscaping. F. Control of the Land. The Applicant is the holder of options to purchase the fee simple title of the owners of the various tracts in the site and has full authority to deal with the property pursuant to the terms of the options. 3 G. Deed Restrictions. The Applicant does not propose any new deed restrictions for the site. H. Development Standards Text General 1. The Applicant intends to use the site, except the northern approximately one hundred feet which is to be acquired by the City of Dublin, as an electrical substation site. The substation site may also be used as a site for communications towers, as hereinafter provided in Paragraph J. The City of Dublin intends to acquire an approximately one hundred feet wide strip of land located along the northern part of the site for purpose of extending Village Parkway westward along its east-west alignment, consistent with the Thoroughfare Plan. 2. It will not be necessary to submit plans or materials for the various structures and equipment to be located on the site for the purpose of ensuring quality standards. 3. The palette of colors utilized will be gray or other appropriate earth tones, subject to Paragraph V hereinafter set forth. 4. All electrical substation site planning will be done in the manner consistent with prudent planning principles and practices and any applicable electric codes, safety codes, laws and ordinances. A perimeter yard outside the fencing will be maintained generally in accordance with the Location Plan. It will be used to provide a buffer of landscaping, mounding, etc. It shall be free of all other uses or occupancy. A perimeter yard and buffer will be maintained on the eastern side of the substation site if required under Paragraph R. 5. The provisions of the paragraph entitled "Introduction" set forth above in this composite/development plan shall apply to these development standards and are incorporated herein. 4 6. If these standards conflict in any way with the City of Dublin Codified Ordinances, then the Planned Commerce District shall prevail. I. Stages of Development. This text will be applied to use of the site in one or more stages. All of the following development requirements shall apply to all stages unless specifically stated otherwise. 1. Sta a ne. Raze the existing residential and related structures and remove all or substantially all trees and vegetation and construct or install fencing, a building and electrical equipment and structures. 2. Subsequent Stages. Construction of subsequent phases of the electrical substation in the order above indicated. The one-story control house located on the electrical substation site may be expanded to a maximum area of 1,200 square feet. 3. The Applicant will not be responsible for the construction, installation, repair, replacement or maintenance of any street, sidewalks, bike paths, street lighting, or other facilities located on or associated with the street to be located on the approximately one hundred (100) feet wide strip of land located along the northern part of the site to be acquired by the City of Dublin. J. Permitted Uses. 1. The permitted uses shall consist of a public road and associated utilities and an electric substation. The site may also be used for a communications tower which equals or exceeds thirty five (35) feet in height and related facilities as provided in the following Subparagraph 2. No other uses are proposed or are permitted on this property. 2. The electrical substation site will be electronically linked to off-site monitoring equipment. This is to be accomplished by using communications equipment which is 5 under 35 feet in height. Further, one communications tower which equals or exceeds 35 feet in height, plus related facilities, will be permitted to be mounted on the existing electrical substation structures if approved by the Board of Zoning Appeals or other appropriate governmental body or official. K. Permitted Density. (Not Applicable.} L. Electrical Substation Yard and Setback Requirements. The setbacks along all sides of the electrical substation site are as shown on the Location Plan. M. Electrical Substation Hei hg t Requirements. The maximum height for electrical substation structures other than poles and "take off' structures shall be thirty-five (35) feet above the surface of the ground, and the maximum height of poles and "take off' structures shall not exceed ninety (90) feet above the surface of the ground. The ninety (90) feet tall poles will be located within the existing transmission line easement along the eastern property line of the site and will be guyed within the existing transmission line easement azea. Other poles and "take off' structures are generally identified on the Location Plan. N. Electrical Substation Parking and Loading. The electrical substation will not be a staffed site. Personnel will visit the site as needed to provide monitoring, maintenance and upkeep, and security. There will also be no fleet vehicles stationed or maintained at this site. As such, all pavement areas will be utilized at only minimal levels, and will be constructed of compacted gravel. Providing asphalt or concrete pavement on this site will not be necessary. O. Circulation. David Road, as it runs through this site, is to be vacated by the City of Dublin. The right-of--way area of approximately one-half acre will be transferred to the applicant for the 6 purpose of constructing an electrical substation. It is understood that David Road to the south of the site is to be maintained as a residential street at least for the initial period. During that time, David Road shall not be utilized for access to the site for maintenance, construction, installation or monitoring of the substation and its equipment. Initial access to the site is to be provided to the north side of the site from Village Parkway. The City of Dublin is responsible for providing right of way, easement, and/or necessary permits for such access. Installation of this access shall be the responsibility of the City of Dublin. At some later point, the access arrangements may be altered if agreeable to both the Applicant, or its successor, and the City of Dublin. In no case shall David Road, so long as it remains a residential street, be used for access. 2. All on-site circulation may be constructed of compacted gravel. A sealed surface, such as asphalt or concrete, shall not be required. P. Waste and Refuse. The electrical substation is not a staffed location, and no waste or refuse will be generated at this site as part of its routine operation. Because of this, no facilities are required to be installed on site for trash accumulation, such as a dumpster. All trash, containers, etc. must be contained in the building or removed immediately from the site. Q. Storage and E uipment. 1. No exterior storage of materials, supplies, equipment or products shall be permitted on this site, other than during construction periods. 2. All equipment shall be installed in accordance with the approved Location Plan, or any subsequently amended plan. 3. The substation equipment shall be screened by mounding and evergreens as generally shown on the Location Plan. 7 R. Landscaping. 1. It is understood that the site is not required to provide landscaping in accordance with the Dublin Landscape Code. However, all of the landscaping that is required under this PCD for the electrical substation shall be maintained, including replacement, in good condition by the property owner during the life of the project. 2. The electrical substation site shall be landscaped by mounding and evergreens as generally shown on the Location Plan. This includes a 5 foot mound on the north, west and south sides and landscaping. 3. The eastern side of the substation is currently screened by an existing six foot mound and landscaping on the adjacent property. If that screening along the east property line should be removed for any reason, a similar screen will need to be installed on the substation site, subject to acceptable electrical clearances and safety restrictions. The plan will be subject to administrative approval by the staff, and the replacement screening should be installed during the next planting season, or as soon as practicable, following removal of the existing screening. 4. Street trees will be installed along the north edge of the property as part of the future road construction project and will not be the responsibility of the Applicant. ,._ S. signage and Graphics. The site will require safety signage and a nonilluminated station label. The station label shall not exceed twenty square feet in area. No other signage or graphics may be used. T. Lighting. 1. Lighting standards or poles on the electrical substation site shall not exceed twenty-eight (28) feet above the surface of the site. 8 ~~. 2. No colored lights shall be used to light the exteriors of the substation structures. 3. All exterior lighting shall follow the Dublin Lighting Guidelines as closely as practicable. All fixtures shall be of cut-off design. Efforts shall be taken to avoid light trespass across all property lines which may result from this development. U. Fences/Walls. A fence of chain link with barbed wire on top shall be permitted and will not exceed eight (8) feet in height, in total. V. Architecture. Improvements to be constructed on the site shall use earth tone colors (e.g., gray, beige, brown, clay, grayish blue) where possible, except that any substation equipment may be of any color or material that is customary or required by applicable electric or safety codes.
