Form No. 30043 Ordinance No.---116-97_--------- Passed --- -- - -- - ---- --- - 19-- --- AN ORDINANCE ACCEPTING THE LOWESTBEST BID FOR VENTURE DRIVE APPROPRIATING FUNDS AND DECLARING AN EMERGENCY WHEREAS, the City of Dublin has entered into a Tax Increment Financing and Economic Development Agreement (TIF/EDA) with Ruscilli Construction Co., Inc. Profit Sharing and Trust, Old Poste Properties, Columbus Building L.L.C., and Brentlinger Enterprises, which provides for the construction of certain public improvements by the City of Dublin; and WHEREAS, after advertising, receiving and opening bids on August 6, 1997, for Venture Drive, as outlined in the TIF/EDA; and WHEREAS, Council has determined that the lowest and best bid for said project is from Performance Site Management of Columbus, Ohio, in the amount of $1,109,272.44; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocationof the utilities in connectionwith the above-referencedproject as a "single source" procurement for reason that the company owning the utilities in question has the exclusive right to relocate such utilities; and WHEREAS, it is necessary to amend the annual appropriations ordinance to provide sufficient funding for the project; and WHEREAS, it is in the best interest of the City to execute this contract as soon as possible in fulfillment of it's TIF/EDA obligations, and so that construction can take place as outlined in the TIF/EDA. NOW TREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the bid from Performance Site Management in the amount of $1,109,272.44 be, and hereby is accepted. Section 2. That there be advanced from the General Fund the amount of $1,375,663.31 to the Ruscilli TIF Fund for the purpose of constructing Venture Drive as provided for in the TIF/EDA. This advance is to be reimbursed to the General Fund from future service payments in lieu of taxes that will be received from the Franklin County Auditor. ection That there be appropriated from the unappropriated balance in the Ruscilli TIF Fund the amount of $1,275,663.31 to account 46-03-14-2551 for constructionof Venture Drive and $100,000 to account 46-03-14-2349 for construction design cost as identified in the TIF/EDA. ecti n 4. That the City Manager is hereby authorized and directed to execute a contract with Performance Site Management for completion of said project pursuant to the bid specifications and documents on file in the office of the City Engineer. ecti n That competitive bidding requirements, if necessary, are waived for the procurement of services that may be necessary for the relocation of existing utilities in the private rights-of--way and/or easements by American Electric Power, Columbia Gas, Ameritech, Time-Warner and other utility companies in connection with this project. • RECORD OF ORDINANCES Dayton Legal Blank Co. Hansley, City Manager / Subject: Venture Drive Bid Acceptance -Ordinance No. 116-97 Date: August 7, 1997 On August 6, 1997, bids were received and publicly opened and read for Venture Drive. Three bids were received as shown on the attached bid form. Performance Site Management submitted the lowest bid in the amount of $1,109,272.44. All bids submitted have been reviewed, and it is recommended that we award this contract to Performance Site Management. The Engineer's estimate for this project is $1,400,000.00. Attached is an emergency Ordinance for approval by City Council for award of the contract to ~.. Performance Site Management, and for appropriation of $1,275,663.31 from the Tax Increment Financing budget line 46-03-14-2551. The purpose for the emergency ordinance is to meet obligations and commitment of the Tax Increment Financing and Economic Development Agreements.
