An Ordinance Authorizing The Purchase Of Land Located Along David
Road For The Future Construction Of Village Parkway Extension, And
Declaring An Emergency
WHEREAS, a change in zoning fora 4.25 acre site located at the terminus of David
Road was approved on June 9, 1997 by City Council; and
WHEREAS, the change of zoning was requested by Columbus Southern Power for
the purpose of erecting an electric power substation; and
WHEREAS, Columbus Southern Power is in contract to purchase eight (8) lots on
David Road for the purpose of erecting the substation; and
WHEREAS, the City, for the future construction of Village Parkway extension,
desires to acquire a portion of the site from Columbus Southern Power; and
WHEREAS, sufficient funds have been previously appropriated for land acquisition
in the Capital Improvements Tax Fund.
NOW, THEREFO , BE IT ORDAINED, by the Council of the City of Dublin,
State of Ohio, of the elected members concurring that:
Section 1. That the City Manager is hereby authorized to execute a Real Estate
Purchase Agreement and any necessary closing documents related to the acquisition
of the property along David Road for the future construction of Village Parkway
extension.
Section 2. That this Ordinance is declared to be an emergency measure necessary
for the immediate preservation of public peace, health, safety, and welfare of this
City and for the future reason that this Ordinance is required to be immediately
effective for the timely execution of the Real Estate Purchase Agreement and the
subsequent initiation of the substation construction which is necessary to provide an
acceptable level of electric service for Dublin customers; therefore, this Ordinance
shall take effect and be in force immediately upon its passage.
