Kindra, Director of Engineering/City Engineer DATE: March 24, 1998 SUBJECT: Ordinance No. 23-98 Agreement Between the Ohio Department of Transportation and the City of Dublin for Maintenance of the Enhancement Elements of the I-270 Bridge Over the Scioto River Attached, please find a copy of the proposed ordinance authorizing the City Manager to execute an agreement with the Ohio Department of Transportation (ODOT) regarding the subject matter. Dublin's participation in this project was initiated by the City and agreed upon by ODOT. The proposal consists of painting the steel fascia girders, the addition of concrete buttresses to outside pier fascia, and the addition of concrete finials to the top outside piers. $200,000 has been budgeted for these items. Attached, please find a copy of pier details showing these items. Also attached are copies of previous correspondence and a memorandum regarding this matter. IN THE MATTER OF AGREEMENT BETWEEN THE OHIO DEPARTMENT OF TRANSPORTATION AND THE CITY OF DUBLIN FOR WORK TO FACILITATE THE ADDITION OF ENHANCEMENTS TO THE WIDENING OF INTERSTATE 270. PROJECT FRA-270-20.740 PID 12494 SCIOTO BRIDGE ENHANCEMENT MAINTENANCE AGREEMENT THIS AGREEMENT, made this day of , 1998, between the State of Ohio, acting by and through the Director of the Ohio Department of Transportation, hereinafter referred to as the STATE, and the City of Dublin, acting by and through its City Manager, hereinafter referred to as the CITY. WITNESSETH: WHEREAS, the STATE proposes to improve Interstate 270 in Franklin County, said project being known asFRA-270-20.740, and WHEREAS, the CITY has determined that it will be beneficial to include the enhancements of the Scioto Bridge to the construction project which includes building new structures over the Scioto River, and WHEREAS, the STATE and the CITY have determined that it is feasible, practical, and more economical for the STATE to accomplish these enhancements on the widening project, and WHEREAS, these costs are not eligible for project participation, and WHEREAS, the CITY has agreed to maintain those enhancements to the Scioto Bridge constructed as part of the FRA-270-20.740 project, and WHEREAS, the STATE and CITY now desire to enter into an agreement with respect to such maintenance. NOW THEREFORE, in consideration of the mutual covenants hereinafter stipulated to be kept and performed, it is agreed between the STATE and CITY as follows: 1. The STATE hereby agrees to construct the enhancements to the Scioto Bridge as set forth in the plans for the FRA-270-20.740 project. This work includes painting steel fascia girders (outside web and flange faces), adding concrete buttresses to outside pier faces, and adding concrete finials to top outside pier faces. EXHIBIT A Page 2 2. Once the enhancements have been constructed, the CITY agrees to assume and bear 100% of the cost and perform the work necessary to maintain the enhancements in accordance with the maintenance procedures which the CITY has adopted for its own structures within the CITY. The CITY agrees to obtain any necessary permits and to follow standard maintenance of traffic procedures as set forth by the STATE. The CITY also agrees to notify the STATE at least 48 hours before commencing work. 3. The STATE grants the CITY the right to enter upon the right-of--way of the FRA-270-20.740 project in order that the CITY may fulfill its maintenance obligations as set forth above. Therewith, the CITY agrees to indemnify and hold the STATE harmless from and against any and all damage or destruction arising from the entry by the CITY upon said right-of-way or the performance by the CITY of its maintenance obligations hereunder. Subsequently, I wrote a letter to ODOT encouraging them to retain maintenance of the painted facia beams. However, ODOT has refused to accept responsibility for enhancement items. Attached please find a copy of their response to my letter of June 11, 1997. The painted beams will have the IZEU paint system which will require touch-up in + 15 years and repainting in + 25 years. ,,, I believe we have the following two options for consideration. 1. Accept responsibility for maintaining painted facia beams. or 2. Accept ODOT proposal for rusting beams. Repainting of the beams, though, is a cumbersome job, however it will be done at ± 25 year intervals. Since the City has agreed to the application of stone enhancement work at pier locations, it is only prudent that we do our utmost to preserve and protect the appearance of the bridge. Therefore, I recommend that we accept responsibility for repainting of the beams. Should this suggestion be unacceptable to you, please let me know at the August 11, 1997 meeting. In this letter, you agreed to two of the three conditions outlined in Deputy Director Flynn's letter of May 7, 1997. However, you requested that we remove the third condition concerning maintenance responsibility of the enhancement items. I, as Mr. Flynn's successor, am holding to "maintenance responsibility" as a non-negotiable condition. Your understanding of ODOT's policy on painting steel overpass bridges is, with all due respect, mistaken. Section 3.2.4.1.1 of the Bridge Design Manual states ... "Unpainted A-588 steel should generally be used for stream crossings and roadways over railroads." The type of structure selected in this case is consistent with ODOT's policy as outlined in the Bridge Design Manual. Furthermore, the widened structures carrying I-270 over the Olentangy River and Alum Creek will also utilize unpainted A-588 steel. Therefore, it is our opinion that no exception has been made for this structure. Rather, we have merely adhered to our standazd practice for stream crossings. The first two conditions of the terms stated in the letter are acceptable. However, we would like to discuss maintenance responsibility issues. The concrete massing and painting of the exterior girder fascia is a simple enhancement package requiring little maintenance over the next 50 years. It is our understanding that it is ODOT's policy to paint the steel overpass bridges in these locations, but in order to save money in fiscally limited times, an exception was made. The City has not requested ODOT to stand by this policy. However, the City has offered to paint the outside girder to a desired color. The I-270 bridge over the Scioto River will be a landmazk structure for the next century for the state of Ohio. The enhancement elements will be enjoyed and appreciated by all Ohio citizens. Maintenance responsibility respectfully, for these small items, belongs to the State of Ohio. In the spirit of cooperation, as the City stands ready likewise to cooperate in regards to helping fund the Single Point Urban Interchange at Sawmill, it respectfully requests the Department's cooperation to remove the third term. } ' '~ Mr. Jack Marchbanks, P.E. You have requested that the following enhancements be incorporated into the I-270 widening plans currently being prepared by Burgess & Niple, Limited(B&N): Painting steel fascia girders (outside web and flange faces) a neaz concrete color; Adding concrete buttresses to outside pier faces; Adding concrete finials (ornamental caps) to top outside pier faces. We are not agreeable to the City of Dublin entering into a separate agreement with B&N to incorporate these items into the subject plans unless the following conditions are met: All work related to the design and construction of these items will be at 100% City of Dublin expense. This work will not delay the completion of the project plans. All future maintenance of these enhancement items will be the responsibility of the City of Dublin.
