AN ORDINANCE DIItECTING THE LAW DIRECTOR OF THE
CITY OF DUBLIN TO PETITION THE COUNTY
CONEVIIS5IONERS OF FRANKLIN COUNTY, OHIO FOR
ANNEXATION OF APPROXIMATELY 157.339 ACRES OF LAND
TO THE CITY OF DUBLIN, AND TO CONSOLIDATE THIS
PETITION WITH THE PREVIOUS PETITION AUTHORIZED BY
ORDINANCE 165-97, AND DECLARING AN EMERGENCY
WHEREAS, the City of Dublin is preparing to expand Cosgray Park and provide
parkland and recreational facilities for the residents of the City of Dublin; and
WHEREAS, the subject property is owned by the City of Dublin and, when consolidated
with the parcel that was authorized to be annexed by Ordinance No. 165-97, is located
contiguous and adjacent to the City of Dublin; and
WHEREAS, the municipal annexation procedure must be initiated by petition to the
Franklin County Board of Commissioners pursuant to Ohio Revised Code Sections 709.14
through 709.16.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, ~ of the elected members concurring that:
Section 1. The Council considers it necessary to consolidate the subject property with
the land authorized to be annexed in Ordinance No. 165-97, and to annex both parcels to
the City of Dublin for the purpose of expanding Cosgray Park and providing parkland and
recreational facilities for the residents of the City of Dublin.
Section 2_ The Law Director of the City of Dublin is hereby directed to petition the
Franklin County Commissioners for annexation of the subject parcels located in
Washington Township,. Franklin County, Ohio, in accordance with Ohio Revised Code
Section 709.14.
Section 3. This ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public peace, health, safety or welfare, and is necessary in
order to meet the various deadlines previously established for the stadium proposal with
respect to the stadium land annexation. This ordinance shall therefore take effect and be
in force upon passage.

TO THE CITY OF DUBLIN, OHIO, OF
172.80 ACRES, MORE OR LESS
WASHINGTON TOWNSHIP, FRANKLIN COUNTY
The undersigned City of Dublin, Ohio ("Petitioner") petitions for the annexation
of the real property described in Exhibit A attached to this Petition (the "Territory") to the City
of Dublin, Ohio (the "City"), according the statutes of the State of Ohio. The Territory consists
of 172.80 acres, more or less, is owned by the City, and is located contiguous and adjacent to
the City.
Petitioner has attached as Exhibit B and made a part of this Petition an accurate
plat showing the boundaries of the Territory. The number of owners of real estate in the
temtory is one, the City of Dublin. Stephen 7. Smith, Law Director, Carlile Patchen & Murphy
LLP, 366 East Broad Street, Columbus, Ohio 43215, (614) 228-6135, is appointed agent for the
Petitioner and is granted full power and authority to amend, alter, change, correct, withdraw or
refile this Petition, increase or decrease the size of the Territory and do any and all things
necessary pertaining to the granting of this Petition. The agent's authority includes, but is not
limited to, the authority to make any amendment and/or deletion in order to correct any
discrepancy or mistake noted by the Franklin County Engineer in his examination of this
Petition, description and plat. An amendment for that purpose shall be made by the presentation
of an amended plat and description to the Board of County Commissioners on, before or after
"°~" the date set for hearing of this Petition.
' Dublin City Council enacted Ordinance No. 165-97 on December 15, 1997, and
Ordinance No. 04-98 on January 20, 1998, authorizing the Law Director to file this Petition to
annex the Territory. Certified copies of Ordinance Nos. 165-97 and 04-98 are attached hereto
as Exhibit C, collectively.

located in VMS 6748 and 6954, being all of a 2.357 acre tract and a 17.220 acre tract,
totaling 19.577 acres as conveyed to the City of Dublin by O.R. 17936 J-13 and part
of a 157.339 acre tract conveyed to said City by Instrument Number
199801050001734 of the Franklin County Recorder's Office and being more
particularly described as follows:
Beginning at the southwesterly corner of the Cosgray Park Subdivision as recorded in
P.B. 50, Page 36 of the Franklin County Recorder's Office, said point being THE
TRUE POINT OF BEGINNING;
Thence easterly, a distance of 459 feet along the southerly line of Lots 1 and 2 of
said subdivision to a point;

1998; and
Section 2. That the Zoning Director to the Board of County Commissioners be and hereby is
directed to notify the agent of the petitioners of the time and place of said hearing; and
Section 3. That the map or plat of The City of Dublin is hereby referred to the County
Engineer of Franklin County, Ohio, for the checking of its accuracy of description.

WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the

WHEREAS, the Commissioners make the following findings based upon the exhibits
and testimony presented at the hearing of this matter:
i 1. The Petition contains all of the matters required by Ohio Revised Code Section 709.15
including, without limitation a full description and accurate map or plat of the territory to
be annexed.
2. The territory sought to be annexed is adjacent and contiguous to the City of Dublin,
Ohio.
3. Notice of the petition and the hearing has been published as required by law, and all
notices of filing the petition and the hearings thereon have been given and delivered as
required by law.
4. The map or plat and the description of the territory contained in the petition are accurate.
5. The City of Dublin has complied with Ohio Revised Code Section 709.14.

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANI~L,IN
COUNTY, OHIO:
That the prayer of the Petition be APPROVED, and the territory sought to be annexed
by the petition filed herein shall be annexed to the City of Dublin, Ohio, in accordance
with the law; that the orders and proceedings of this board relating to the Petition, and
map and description attached thereto, and all papers on file relating to this matter be
delivered forthwith to the Clerk of Council, City of Dublin, Ohio.
