AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
ACCEPT AND EXECUTE AN AGREEMENT TO RECEIVE
PROPERTY DONATED BY POST-HYLANDS CO., LOCATED
SOUTH OF POST ROAD AND EAST OF PERIMETER DRIVE,
CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF
OHIO.
WHEREAS, a goal of Dublin City Council is to continue to acquire land for
greenspace purposes; and
WHEREAS, the City desires to enter into an agreement to receive as a donation from
Post-Hylands Co. a 0.924 acre parcel of land described in the attached "Exhibit A"
located in the City of Dublin, Counties of Franklin and Union, State of Ohio.
WHEREAS, this agreement will require Post-Hylands Co. to execute a Quit Claim
Deed conveying its fee simple interest in the 0.924 acre parcel to the City of Dublin
without consideration or compensation being paid to Post-Hylands Co.
NOW, THEREFQRE, BE IT RESOLVED by the Council, of the City of Dublin,
state of Ohio, _~ of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute an Agreement to
Donate Real Property related to the donation of a 0.924 acre parcel from Post-Hylands
Co.
Section 2. This Ordinance is declared to be an emergency measure for the
immediate preservation of the public peace, health, safety or welfare, and for the further
reason of executing the Agreement to Donate Real Property; therefore, this Ordinance
shall take effect and be in force immediately upon its passage.

Dublin, Virginia Military Survey No. 3452, also being 0.577 acres out of an
original 3.682 acre tract as conveyed to Post Hylands Co. as recorded in Deed
Book 3096, Page 99 Franklin County, Ohio and 0.347 acres out of an original
4.605 acre tract as conveyed to Post Hylands Co. as record in Deed Book 244
Page 95 Union County, Ohio (all records being of the Recorder's Office, Franklin
and Union County, Ohio) and being more particularly described as follows:
Beginning for reference at a iron pipe found, said pipe being the southeasterly
corner of a 40.108 acre tract as conveyed to CASTO Affinity Ltd., of record in
Instrument No. 199712190171121 and the southwesterly corner of a 81.149 acre
tract as conveyed to BJL Limited Partnership of record in Official Record Volume
10507D06 and also the northerly right of way line of State Route 33 (FRA 33-
0.34) at STA 31+74.42 being 103.00 left;
Thence North 04°27'01" West, with the easterly line of said 40.108 acre tract a
distance of 2087.08 feet to the northeasterly corner of said 40.108 acre tract;
Thence South 83°34'22" West, with the northerly line of said 40.108 acre tract a
distance of 150.02 feet an iron pipe set with a EDG cap and the true point of
beginning;
Thence South 83°34'22" West a distance of 96.43 feet to an iron pipe set with a
EDG cap and a point on a curve;
!s*° Thence with anon-tangent curve to the right with a radius of 450.00 feet, a
central angle of 7°21'24", the chord of which bears North 08°07'45" West for a
r.~ chord distance of 57.74 feet to a point to an iron pipe set with a EDG cap;
Thence, North 04°27'02" West a distance of 181.87 feet to an iron pipe set with a
EDG cap and a point of curvature;
Thence with a tangent curve to the left with a radius of 700.00 feet, a central
angle of 10°57'44", the chord of which bears North 09°55'54" West for a chord
distance of 133.72 feet to an iron pipe set with a EDG cap;
Thence, North 34°06'44" East a distance of 32.09 feet to an iron pipe set with a
EDG cap and a point of curvature;
Thence, with anon-tangent curve to the right with a radius of 315.50 feet, a
central angle of 17°16'04", the chord of which bears South 88°25'47" East for a
chord distance of 94.73 feet to an iron pipe set with a EDG cap;
Thence, South 04°14'50" East a distance of 384.43 feet to the true point of
beginning and containing 0.924 acres of land more or less.

The above matter arises out of the Perimeter Loop Road and Perimeter Drive extension,
which is part of the Rail Van (Ruscilla) TIF. As part of this project, the City is acquiring real
property for the extensions of the two roads from nine property owners. The necessary property
acquisition is complete with respect to four of the property owners. All others have provided
right of entry agreements so the project is moving forward.
At this time, the City has reached a tentative agreement with Post-Hylands to settle the
acquisition of +/- 3.341 acres of right of way, 1.441 acres for utility easement, and approximately
2 acres for temporary construction easements. In conjunction with the settlement agreement,
Post-Hylands Company has decided to donate a portion of the remaining property to the City.
This portion of property is located to the south of Post Road and east of New Perimeter Drive. It
encompasses approximately 1 acre and is highlighted on the attached map.
An ordinance has been placed on the agenda authorizing Tim Hansley, as City Manager,
to enter into an agreement to accept the donation of property from Post-Hylands.
