VF.>R AN ORDINANCE PROVIDING FOR A CHANGE IN ZONING FOR 134.4 ACRES LOCATED ON THE EAST SIDE OF DUBLIN- BELLEPOINT ROAD, GENERALLY BETWEEN DONEGAL CLIFFS DRIVE AND DUNLEARY DRIVE, FROM: PUD, PLANNED UNIT DEVELOPMENT DISTRICT, TO: PUD, PLANNED UNIT DEVELOPMENT DISTRICT (DONEGAL CLIFFS TEXT UPDATE/FILE N0.98-1232) NOW, THEREF9RE, BE IT ORDANIED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby rezoned PUD, Planned Unit Development District, and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) to the City of Dublin Zoning Code and amendments, thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. Section 3. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law. Site Data Site data information for all sections of Donegal Cliffs is as follows: Total Acreage: + 134.30 acres Total Units: 251 lots Gross Density: + 1.87 dwelling units per acre Park Land/Open Space: +10.474 acres B. Permitted Uses Land and buildings in Donegal Cliffs shall be used only for the following purposes: (1) Single-family dwelling with attached two or more car garage. (2) Public and private park. Nuisances No noxious or offensive trade or activity shall be committed, suffered, maintained, or carried on upon any lot, nor shall anything be done thereon which may become a nuisance to the neighborhood as established by Public Nuisance Regulations, Section 153.076, and other related sections of the City of Dublin Code. Temporary Structures Trailers, mobile homes, tents, shacks, garages, barns, and temporary structures shall not be used at any time as a residence, either permanently or temporarily. Additionally, these structures shall not be used for storage purposes. : ro~ Accessory Structures In-ground pools and wood playground equipment/swing sets are permitted as accessory structures. Sheds and aboveground pools are prohibited. C. Animals and Livestock No animals, livestock, or poultry shall be raised, bred, or kept on any lot. Dogs, cats, or other household pets are permitted, provided they are not kept, bred, or maintained for any commercial purpose. Development Standards Lot Requirements Minimum Lot Width: Seventy-five (75) feet of width, as measured twenty-five (25) feet from the edge of dedicated road right-of--way. Lot Coverage: Only one principal use shall be permitted on a lot, and such lot shall not be covered more than twenty (20) percent by the structure. Minimum Livable Floor Area: All finished and heated portions of a house, except for basements, garages, and open porches shall be calculated as part of the livable floor area. The minimum floor areas permitted are: 1,800 square feet for aone-story dwelling 2,000 square feet fora 1 %s-story dwelling 2,000 square feet for atwo-story dwelling 2,400 square feet for a split level (multi-level) dwelling on no more than three levels Maximum Height: Thirty-five (35) feet, as measured per Dublin Code. Minimum Building Setback: Twenty-five (25) feet, as measured from the right- of-way; however there is a required setback variation (see below). Corner lots shall have two front building setbacks; one on each public street. Required Setback Variation: No more than two (2) adjacent dwellings fronting on the same public street may be constructed at the same building setback. There must be a minimum variation often (10) feet. ~`,,,, Minimum Side Yard Setback: Sixteen (16) feet total, with a minimum of six (6) feet per side. Minimum Rear Yard Setback: Fifteen (15) feet, except for lots on the periphery of the subdivision. The rear yard for periphery lots shall be (20) percent of the lot depth, but shall not be less than twenty-five (25) feet nor more than fifty (50) feet, unless otherwise specified on the plat. Building Materials ~.. The individual exterior elevations of each house shall be finished and compatible with each other. All exterior elevations of each dwelling shall be finished with only the following materials: wood, stone, brick, stucco, or a combination of these materials. Stucco is not a permitted material for the exterior elevation that faces the public street. These materials must be provided with, or finished in, earth tone and neutral colors that blend with the existing development. Doors, windows, and ornamental trim do not have to be composed of the required materials. No exposed block, with the exception of the foundation, shall be permitted as a part of any elevation. Roof Pitch, Style, and Color All roof slopes shall be of a 4/12 pitch or greater for any new construction or improvements. Mansard roofs are not permitted. Gable, hip, shed, and combinations of these roof styles are permitted. All exterior roof materials shall be dark red, brown, black, or gray. Fencing and Walls No wall(s) or fence(s) shall be placed on any portion of a lot between the street and the front building setback line (corner lots have a front building setback line from each public street). Only split rail and privacy fencing, as detailed below, are permitted on a lot. All vinyl fences, chain-link fences, and chain-link materials of any nature are prohibited anywhere on any lot within the Donegal Cliffs subdivision. Fences and walls are prohibited within in "no-build zones". Split-rail fence is a fence of either two or three rails, with posts not exceeding forty-two (42) inches (3 %2 feet) in height from ground level and typically spaced eight (8) feet apart. Split-rail fencing is permitted along the perimeter/boundary of the lot, provided it is behind the front building setback line. The fence post and rail colors shall be natural, and welded wire mesh is permitted though it must be applied on the interior side of the fence. If wire mesh is used, it must be a rectangular pattern and shall be black or dark green in color, either applied vinyl or painted. Light colors or galvanized aluminum finishes are not acceptable for any portion of the fence. See attached detail. Privac, f~ is a fence of wood, stone, brick, or wrought iron not exceeding six (6) feet in height. A privacy fence may only be erected around the boundary of a patio, deck, in- ground pool, spa, or hot tub. This fencing may not exceed that boundary and must be ~, ~~~.. ~N located outside all required rear and side yards. Privacy fences may not be used to enclose the yard. See attached detail. Landscaping Seed or sod must be established in the yards prior to occupancy. Exterior Front Yard Lighting The owner of each new home shall provide a minimum of one exterior pole lamp to be located near the drive entrance. T'he light pole may not exceed eight (8) feet in height, and should be a cutoff fixture to reduce the emitted light. The permitted colors are earth tones, such as black, gray, and brown, or another neutral color that matches an exterior color of the house on the lot. Identification of the owner may be added provided it is similar in material and color to the pole, no larger than eight inches, and only states the last name of the residents and/or the street address. Street address signs shall otherwise conform to the Dublin Code. Mailboxes All mailboxes must be placed in the tree lawn next to the street. The height of the mailbox may not exceed four (4) feet from top of adjacent curb. The mailbox may be pole-mounted with the base to be composed of stone, brick, or wood. Vinyl and/or plastic mailboxes are not permitted. The color must be an earth tone or other neutral color that matches an exterior color of the house on the lot. The mailbox itself shall be of a type as approved by the United States Postal Service. D. Review of Plans by Donegal Cliffs Homeowners' Association Plans for all new homes or additions must be submitted to the DCHA for review prior to formal submission to the City of Dublin for building permits. The DOHA is to review plans to ensure they meet the requirements of this text and that the exterior design is architecturally compatible and equivalent in design, character, quality, aesthetic appearance, and materials to existing homes already constructed in the Donegal Cliffs Subdivision. No building permit shall be requested, construction commenced, excavation made, nor building erected until three (3) sets of complete building plans and specifications for the building intended to be erected are submitted by the lot owner to the DCHA for review. These plans shall include a detailed site plan to scale showing the specific location of the building(s) on the lot and the proposed grading plan showing elevations, slope, and new grade. The DCHA shall have no more than twenty (20) days to review the plans, provide feedback to the lot owner, and make a recommendation to the City of Dublin staff. E. Other Standards Signs Signs indicating the sale, rental, or lease of residences shall be permitted, provided such signs are limited in size to seven square feet in area and three feet in height. Free- standing signs must be located so that they do not interfere with the safe movement of vehicular and pedestrian traffic, and all signs shall be removed within 14 days after the sale, rental, or lease has occurred. Only one such ground or window sign is permitted per street frontage. All other residential signs shall be permitted per Dublin Code. Drives All drives and parking areas shall be paved with brick, paver, asphalt, or concrete. Drives and parking areas shall otherwise conform to the Dublin Code. On-Site Vehicle Parking No trucks, commercial vehicles, boats, trailers, campers, or mobile homes shall be permitted unless they are parked or stored completely within a garage. Utilities All utility pipes and lines, including but not limited to electrical, cable, telephone, gas, storm, water, and sanitary sewer shall be locate underground in accordance with the Dublin Code. Antennas No television or radio antennas of any type are permitted to extend above the roof or chimney line of any residence nor shall there be any free-standing antenna of any type in the front or side yards of any lot. Antennas shall otherwise conform to Dublin Code. '~"" Refuse All rubbish, trash, garbage, and other waste shall be kept in sanitary containers. All "'~" equipment and containers for the storage or disposal of such material shall be kept in a clean or sanitary condition and shall otherwise conform with Dublin Code. Property Maintenance All lots, or parts thereof, on which residences are constructed shall be graded and landscaped promptly upon completion of such residence, and shall thereafter be maintained neatly and shall otherwise conform to Dublin Code. F. Non-conforming structures An existing structure within Donegal Cliffs that does not conform to the requirements established herein shall be permitted to remain until such time as more than fifty percent (50%) of it is to be substantially altered or replaced. At that time it must be made to conform to these standards. ~. G. Homeowners' Association Membership The purpose of the Donegal Cliffs Homeowners' Association is to ensure the protection, benefit, and mutual advantage of all property in Donegal Cliffs and to perpetuate the existing character and aesthetic appearance of Donegal Cliffs as originally established by deed restriction/covenant and by agreement with the developers of the subdivision: Donegal Cliffs Development Corporation (Sections 1-4) and the Homewood Corporation (Sections 5-7). The DCHA is charged with the responsibility of owning and maintaining certain reserve ~,,, areas of the subdivision. The Donegal Cliffs Homeowners' Association (DCHA) exists and is incorporated with the Secretary of the State with bylaws set forth in the DCHA Code of Regulations. Every lot owner is a member of the Donegal Cliffs Homeowners' Association as set forth in the Articles of Incorporation. This membership shall be conveyed to each successive grantee of each lot. H.
