AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE NO. 56-94, AS PREVIOUSLY AMENDED AND
SUPPLEMENTED BY ORDINANCE NO. 128-99 PASSED
DECEMBER 13, 1999, TO PROVIDE FOR THE EXECUTION
OF ADDITIONAL TAX INCREMENT FINANCING
AGREEMENTS; AND DECLARING AN EMERGENCY.
WHEREAS, pursuant to Ohio Revised Code Sections 5709.40, 5709.42 and 5709.43, this
Council, on June 20, 1994, passed Ordinance No. 56-94 (the "Original TIF Ordinance" and, as
subsequemly amended and supplemented by Ordinance No. 128-99, passed December 13, 1999,
the "Amending TIF Ordinance" and collectively with the Original TIF Ordinance, the "TIF
Ordinance") thereby declaring improvements to parcels of certain real property located in the City
(as described and depicted in the TIF Ordinance and referred to therein as the "Property") to be a
public purpose, exempting those improvements from real property taxation for a period of time,
specifying public infrastructure improvements (as described in the TIF Ordinance and referred to
therein as the "Infrastructure Improvements") to be made to benefit those pazcels, providing for the
making of service payments in lieu of taxes (the "Service Payments") by the owner thereof, and
establishing a municipal public improvement tax increment equivalent fund into which those
Service Payments were to be deposited; and
WHEREAS, this Council finds that the parcels comprising the Property have various
owners and that it is necessary to enter into tax increment financing agreements with each of those
owners to provide for the development of the Property, the construction of the Infrastructure
Improvements and the payment of Service Payments; and
WHEREAS, this Council has determined to amend and supplement the TIF Ordinance to
• authorize the execution of tax increment financing agreements with any owner of the pazcels
comprising the Property;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Delaware, Franklin and Union Counties, Ohio, that:
Section 1. Notwithstanding the recitals in and Section 3 of the Original TIF Ordinance
and Section 2 of the Amending TIF Ordinance, the tax increment financing agreement referred to
in Section 3 of the Original TIF Ordinance and Section 2 of the Amending TIF Ordinance may be
between the City and the owner of any of the pazcels comprising the Property. The Agreement by
and between the City and any such owner, in the form presently on file with the Clerk of
Council, providing for, among other things, the payment of such service payments in lieu of
taxes, is hereby approved and authorized with changes therein not inconsistent with the TIF
Ordinance and not substantially adverse to this City and which shall be approved by the City
Manager and Director of Finance. The City Manager and Director of Finance, for and in the
name of this City, are hereby authorized to execute that Agreement, provided further that the
approval of changes thereto by those officials, and their character as not being substantially
adverse to the City, shall be evidenced conclusively by their execution thereof.
Section 2. Except as provided herein, all other provisions of the TIF Ordinance shall
remain in full force and effect.
"` Section 3. This Council finds and determines that all formal actions of this Council
concerning and relating to the passage of this Ordinance were taken in an open meeting of this
Council and that ail deliberations of this Council that resulted in those formal actions were in
meetings open to the public in compliance with the law.
Section 4. This Ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public peace, health, safety and welfare of the City, and for the
further reason that this Ordinance is required to be immediately effective in order to support and
facilitate construction of the I~nfrastivcture Improvements as quickly as possible, which is necessary
to provide transportation improvemerns at the earliest possible time and thereby improve the safety
of the citizens of the City; wherefore, this Ordinance shall be in full force and effect immediately
upon its passage.

Ordinance No. 128-99 authorized the execution of a Tax Increment Financing (TIF) Agreement
with Ruscilli Development Co., Ltd. only. The parcels that comprise the TIF district have
various owners which will require TIF Agreements with each of those owners.
This Ordinance authorizes the execution of tax increment financing agreements for any property
owner of the parcels comprising the TIF district.
